  1. Do i need to pay this before i could take it to court orcan you go to court prior to payment if in dispute?
  2. update. I spoke to black horse who confirmed that there is a shortfall insurance policy mentioned on my account but it is not with them. They also mentioned that i should have confirmation documentation which i definately do not have. However, apparently the shortfall insurance details will be held by the car dealership! so i need to speak to card dealership.

  4. Hire Purchase Agreement created to purchase a car in 2005. I have a copy of the original agreement which admittedly i find quite confusing. However the car was 5820. There is a section in a box entitled key financial information next to total amount payable (a+d+e) = 8153.72 I missed several payments and therefore the account is defalted. However the outstanding balance of 1197.63 is being sought by a debt collection company. I have a updated statement of account and the outstanding balance is entirely made up of late payment charges! also interestingly the opening balance on the statement of account is 7640.76, a figure which is not mentioned in any of the boxes of the original agreement I have sent various letters requesting proof of the debt etc and have been offered a reduced settlement figure of 898.22 Am i liable for these charges? my credit file is ruined but i need to remove this default to start improving the file for the future. JUst would like to know whether it is worth trying to challenge this.

No response from local authority so far i wrote the following letter to phoenix commercial collections: "i have been informed that you have visited the above address regarding the above reference. the address is a postal address as i have moved through several addresses. as a result there is sometimes postal problems. I am writing to request a true copy of the warrant you are seeking to use and a breakdown of the allegedly owed sum. I am willing to make formal complaints should your certified bailiff deviate from recognised protocols. Furthermore, i request that you cancel or suspend the bailiff to allow me to resolve this issue. " they replied: " we refer to your recent contact with our office and write to inform you that this case is with our field agaent jxxx mxxxxx and advise you to contact our agent direct on 07515130116 to resolve this matter" well i am not prepared to make telephone calls as i am unable to record them and continue the evidence trail. I might send further reply to phoenix and to local authority.
  6. i have emailed local authority requesting that bailiffs be suspended or cancelled. if i do not receive response soon then i will attempt to submit a form to Traffic enforcement centre - Northampton in the meantime advise everyone to keep door locked and answer to no one unless recognised seems he best course of action. Apparently you can get letter drawn up from a solicitor saying that all items in the house belong to my my family members and not me to prevent an seizures if bailiff gained entry but not read enough abut this yet.
  7. the reason has to be stupidity, the old cliche burying your head in the sand. i had lost my job, relationship in tatters and had debts coming from what seemed left right and centre. got a new job and tying to remedy all this mess with various bodies. I thought that it would be possible to go back to court and put my case seeing as i didnt respond or attend to any previous instruction. set aside judgement etc. even f i cannot resolve ongoing problem i am still interested to know whether resident parking zones can be challenged, for educatonal purposes at least
  8. yes i dont have copy of pcn. I only have letters post penalty. i could probably take pictures of the area. however, as a general description it has white lines making the parking bays and small signs on posts.
  9. the door was answered by them so now they know. no break downs just the amount requested and that it was a penalty charge notice. in fact i had to rummage through all junk/debt mail to identify what it was in reference to. Phoenix commercal collectors on behalf of local authority
  10. i have received a ticket for parking in a residents parking zone without displaying resident permit. Has anyone ever challenged this sort of ticket? the road in question is not fully resident parking. as one end of the road is not but the area parked unfortunately is! any advice appeciated apart from "dont park there agin!" lol
  11. regarding parking in a residents permit area without a permit. dont have anything in front garden, the problem is im staying with family temporarily so most items would not be mine

I have been informed that a bailiff has visited my home today. i checked whether thbailiff is registered and he is and also the company until next month funnily enough he left a letter in a envelope which states hat 350.58 i required for a penalty charge notice. it says on this occasion,i have not removed goods but he will be returning on or after 3/9/09. it provides his mobile number to make payment and avoid further costs it seems expensive for a penalty charge notice. certainly worried at moment. any advice?
  13. I entered into a hire purchase agreement to purchase a car with Black Horse in August 2005. The agreement was for 4888 on a 36 month duration. Therefore total amount payable was 8153.72. APR 30.8% I have made various defaults which has led to the debt being passed to nationwide collection services. To date i have repaid 8689.77 and they are still requesting 1197.63 I sent the following letter to nationwide collection services: "as you confirmed in your letter dated xxxxx the amount of credit agreed on xxxxxxx was xxxxx to date i have paid xxxx. i am writing to request that my balance be closed and that you repay all the default charges that have been applied to my account since xxx. i do not believe these charges reflect the true cost to black horse.I believe the charges have been unlawfully depriving me of the money and i therefore ask that you repay me the full amount. " pretty poor and rushed letter and i also was under the impression that nationwide was part of black horse collections! They responded by sending a black horse headed paper with their address on and statement of my account. a faxed copy of my original agreement and a compliment slip saying what has been attached what sould my next setp be? do i have any chance of callenging the amount owed or not? if you need further information such as what the terms and conditions say then please ask. i didnt want this post to be too onerous as a starting post
  14. On 17th AUGUST 2005 i entered into a hire agreement for a car from a large car dealer. The agreement was with Black Horse. I was advised to take out PPI but i did not fully understand and do not seem to have any policy paperwork about the policy. The gist of what i was told was that i would never be out of pocket if i had crash and claim did not cover value of the vehicle due to depreciation etc. i have since had my car stolen and written off. i did not receive enough for the vehicle to fully repay the loan. the debt was passed to nationwide collction services and when i requested details of the insurance added to the account i received a reply from nationwide "with regard to insurance please call lloyds insurance on 08450700107 who will advise you" i do not intend to waste an expected pointless runaround phonecall on this. Im considering writing another letter to both nationwide and black horse explaining that i am not happy with this response. any suggestions and does this sound like a PPI claim?
  15. Just got a reply to my letter from black horse. They have conducted a review of my account and of the £110 collection activity fee and they have established that although the charges were added within the terms and conditions of the agreement they have decided on this occasion to waive 50% of the fees as a gesture of goodwill. They enclosed a copy of the terms and conditions and highlighted the following term; 4. Charges if you break this agreement 4.1 If you fail to pay a monthly repayment on time then we may charge you a fee of £25 after you have been in arrears for at least 9 days. If after that you remain in arrears for this month then charge a further £30 for each month . etc etc (also mentions £15 charge for returned unpaid by bank) So think i will settle for that and pay £55 to resolve matter. Any thoughts?
