  1. Suprise suprise it wasnt lifted, they were offered costs but declined!!! Wait until March 7th, Ill put the Court Order up when I have it........back to the wait!!!
  2. Sorry its been a while but I guess not a lot has really happened, a brief summary......... Applied for my stay to be lifted....Court in 11 hours, but am very prepared, hopefully!!! for every eventuality Had a default entered against me by Abbey, and now have a firm of debt collectors sending me threats!!! Guess who I found out owns the Debt Collection Agency..........yep Abbey Abbey have not replied back to me since August despite many letters been sent to them, In short BRING IT ON!!!! :-x Let you all know tomorrow

  4. I had written a letter to Nick Gibb ages ago, also Gordon Brown, Nick Gibb wrote a lovely response saying he had concerns and had himself written to the Dept of Business, Enterprise and Regulatory Reform and would get back to me with there answer!!!
  5. OK lots to update everyone the FOS acknowledge mycomplaint!!!! Abbey entered a Defence to my claim My MP has written to the Dept of Business Enterprise and Regulatory Reform on my behalf, Gordon Brown has yet to reply!!! I have had the standard letter re the OFT test case from both the legal dept and the Complaints team. My account is now in the hads of Collections and Recoveries, although there maths is so terrible they cant get the amount correct in any letter!!! Apparently Worthing CC is staying all bank related cases although I have a pre written letter asking for it to be removed. Yep that should cover it!!!! LOL

  10. I spoke to my Court today and they told me that I carry on. "Wheels are in motion" they said, I asked if HMCS had had any meeting regarding the test case and what it meant to other litigants, he replied "they might well of done but we wouldnt hear about it till xmas"!!!!!! Seven days before they have to defend after they Notified thier intention to defend so I guess I'll know more then.

Mr ********** Whereas I have been a customer of Abbey for over 15 years and whereas I consented in my contract with you to the disclosure by you of certain data to third parties, at no time did I consent and neither was it within the contemplation of the parties to the contract that I did consent to the processing by you of that data in any manner which would be unfair or inaccurate or which in any way would breach The Data Protection Act 1998. Therefore Take Notice that I require that you cease from processing within 7 days of the receipt by you of this notice or else that you do not begin to process any personal data of which I am the subject insofar as that processing involves the communication or passing of personal data of which I am the subject to any third party and insofar as the said data relates wholly or in part to the implementation by you of charges which have been applied to my account in respect of defaults or contractual breaches and where the said charges which have been levied at a rate which is in excess of the administrative costs incurred by you as a consequence of the said defaults or breaches contrary to The Common Law. This Notice is given on the grounds that the processing or continued processing by you of the said data will be likely to affect my credit rating and my reputation and cause substantial damage and/or substantial distress to me and my family members in addition to that which may already have been caused and that as the processing of the said data in the way referred to in this notice would violate the fourth, first and sixth principles of The Data Protection Act 1998 to do so would be unwarranted. Further I would draw your attention to my previous correspondence to you where asked you to confirm that you indeed have my multi-function card and cheque book, you have still not done so. Additionally you have not responded to my request as to when I would receive payment from you. Also I am unsure whether you are aware from other departments within your organisation that I commenced legal action against Abbey for the full amount and costs on **th July, 2007. May I also point out that another department has already sought to offer a gesture of goodwill payment in settlement, this I have rejected as it was not for the full amount.
