  1. Can you post an announcement for me someone! When we were at the court today, we had a discussion with another claimant who was claiming against Yorkshire Bank. He stated that there are a lot of cases where the claimants had not turned up - possibly thinking that the case had gone to STAY, because of the banks sending letters stating they were applying for a STAY (which is the courts decision not the banks). I wonder whether people think there is no need to turn up in court. There is a possiblity that these cases will be thrown out because they did not turn up!!!! Can you post somewhere prominent for people to be aware, that they have to turn up if the case is going ahead! They need to confirm with the court concerned first. Many thanks
  2. WELL WE ARE BACK FROM DURHAM COUNTY COURT!!!!! AND ABBEY HAVE MANAGED A STAY ON THE PROCEEDINGS THEY SENT A BARRISTER, WHO HAD A MEETING WITH US PRIOR TO THE PROCEEDINGS AND TRIED TO TELL US THAT ALL CASES IN THE COUNTRY ARE BEING STAYED!!!!??? I THINK THE JUDGE HAD ALREADY MADE HER MIND UP! DIDN'T MATTER WHAT WE STATED. SO DISAPPOINTED! THE JUDGE STATED THAT: WE WOULD NEED TO WAIT FOR THE OFT TO GO TO COURT WITH THE TEST CASE IN JAN '08, IF NOT CONCLUDED, THAT WE WOULD NEED TO APPLY TO THE COURT BEFORE OCT'08 FOR FURTHER DIRECTIONS OR THE CASE WOULD BE THROWN OUT! CAN ANYONE HELP WITH THIS AND IS THERE ANYTHING ELSE WE COULD DO IN THE MEANTIME??????? AND WHAT DO WE DO WITH FURTHER DIRECTIONS? WE ARE SO ANGRY - THE JUDGE WAS VERY NICE AND POLITE, BUT SHE WAS NOT GOING TO CHANGE HER MIND. WE STATED TO HER THAT: ABBEY DID NOT COMPLY WITH THE DIRECTIONS OF THE COURT WITH A BUNDLE - LETTER SENT TO COURT TO EXPLAIN. ABBEY HAD ALREADY HAD A MONTH TO RESOLVE THE MATTER WITH THE ALLOCATION QUESTIONAIRE - BUT NO CONTACT HAD BEEN MADE TO RESOLVE. THE ACCOUNT IN QUESTION HAS AN OVERDRAFT, WHICH IS NOW BEING PURSUED BY ABBEY - JUDGE STATED THAT WE SHOULD APPLY TO THE COURT FOR A STAY ON THIS!!!!!!!??????? - CREDIT RATING WILL BE AFFECTED!!!!???? THE TEST CASE COULD TAKE UPTO 2-3 YEARS WITH APPEAL AFTER APPEAL???? FINANCIALLY WE HAVE LAID OUT MORE MONEY TO GET TO THIS STAGE (£350.00) - WE FELT THAT THIS CASE SHOULD GO AHEAD. THE JUDGE STATED THAT THIS WOULD BE UNFAIR, AS ABBEY HAVE NOT BEEN ABLE TO PUT THE CASE FORWARD WITH THE OFT HAVING A TEST CASE?????!!!!!!!!!!! sHE STATED THAT WE COULD APPEAL TO THE STAY, BUT THIS WOULD HAVE TO GO TO A CIRCUIT JUDGE??????!!!!!!! WHAT A FRUSTRATING AFTERNOON!!!!! CAN ANYONE HELP US NOW!!!!! SORRY TO PUT THIS IN CAPITALS, BUT WE ARE SO ANGRY!!

  6. This is my first time with the site. We are off to court today Wednesday 15th August '07! Only with the help of all the people on the site have we felt confident enough to proceed! Thanks to everyone! We are looking for over £6000.00 at court today Abbey have not sent the bundle to ourselves, but they have sent the normal letter to us stating - they will be applying for a stay to the case! I do hope they don't turn up! We have been looking for information to help us convince the Judge that we should have the case concluded today in our favour, because of the following: 1. Non compliance from Abbey with the directions from the court - Notice of Allocation to the Small Claims Track (Heraring) - We have sent the letter to the court to inform them of this and to make a judgement. 2. Abbey had already requested and had 4 weeks stay within the Allocation Questionaire (Delay tacktic?) - If this had not agreed, we may have won by default! 3. No contact from Abbey within the period before the court case to resolve the matter as requested again by Abbey within the Allocation Questionaire. 4. We have an unpaid overdraft on the account and they have threatend to take legal action from Equidebt for Approx £700+, they will not put this off for ever! 5. The test case could possibly take anything from a few months up to 2-3 years to resolve, with appeals after appeals! financially we can not wait that long! 6. We have laid out more money to take this to court (350.00) and we feel this is our legal right to have this resolved through the small claims court within a reasonable timescale! Can anyone help me any further info before we go today - We are leaving the house at 1pm. CONGRATULATIONS TO EVERYONE WHO HAVE ALREADY WON AND GOOD LUCK TO THE ONES STILL ON THE LADDER!
