hi submissiveguy, i prefer to make and keep the issues seperate. i think they will pay your card charges after a bit of posturing but as enron says the ppi is different . there are so many issues with ppi. anyway good luck

can you believe it, 6 phone calls today from Cobbetts, discussions on the figures to settle. initially refused any interest but are now going to pay, but will not cover any of my claim for costs. last call of the day have agreeed a settlement figure which is virtually what i wanted. a cheque should be on its way as we speak.

hi lenny, i find the fos to be very long winded way of getting a result. i am in court with cap1 in 9 days as i dispute the box thats been ticked on the application form. have you done the sar and requested all the details regarding ppi. then take them to court, they might pay up.

that was the judges instructions but they faxed them to court today and i have recieved by carrier this afternoon. will have a look through them and let you know.

its getting worse now , cap 1 have supplied their court bunde to the court but i have not recieved anything, i thought i should have had their defence 14 days before the hearing,??

have had the card a long time so i doubt if any agreement exists. they still havnt supplied anydetails of the ppi agreement or insurance company, so i will fight that one first. about to issue the claimfor the ppi this week as they didnt respond to any letters.

just a few worries but hey if they turn up they will be paying for their time . i think i have a good case. any way 9 days left . thanks for suport and good luck bgb:)

10 days to go , nervous now, thought crap 1 would have given in and settled.

sure will , they have a choice - pay in full or go to court. i feel confident they will pay in the end.

thanks for you reassurance zootscoot, had a letter from cobbetts today offering a settlement. there is no costs or interest added to thier offer and they say that i should accept because if it goes to court they will win. cobbetts always come up with suprises dont they.

rbs have submitted their defence for court today. it seems they are not going to give in.

hi brw, i have read somewhere about the original agreement has to be produced and check the appeal court ruling Wilson and others v The secretary of state for trade and industry(appellant) . cant remember where i got it from but try this http://www.publications.parliament.uk/pa/ldjudgmt/jd030710/will-6.htm. i hope it might be of use at some stage.

thanks hell and alanalana, will be planning everything as you suggest hell, i think i have got them with some of their own admissions but will see in a couple of weeks, will keep you all informed.

go for it, bgb. just a point , mbna turned up saying they had not recieved my court bundle, if i had taken the proof of delivery with me i think the judge would have awarded me the case. you can take other info to the court if you need to. good luck .

thanks ammani, but i think now that its to late for them just to refund the ppi. i will want the costs and interest now, the stupid thing is the original calim was for £192.00 i cant work them out. thanks bathgatebuyer and sparkle , at least being at this position with mbna i know a little about the system

hi dj1898, write to crap 1 stating you were missold this policy, also have you got your credit finance agreement and a copy of the ppi policy. this will be the first step, and believe me crap 1 will deny everything.

hi wills , sent you my witness statement that i used against mbna, hope it is ok for you to adapt.

hi wills7 you need to put the misrepresentation act in your court bundle as a start. list all the letters with a complete record of all the delivery dates, ie recorded slips and the replies. that is part of it. produce a witness statement, which is basically a background of the main points and there is a template in the bank bundle which you can adapt. if you go to the stickies at the start there will be more information to get. you have to do 3 copies of everything , 1 for court, 1 for wf and the originals for you.

issued a claim under the data protection act and recived a letter from ge today to pay the whole amount, no mention of supplying the requested documents though.

recieved notice today that citi are closing my account even though no default notice has been issued or that i have any arrears on the card.

!!! cheque cleared . sent off notice to court and MBNA. going to make a donation to this great site, then on to the closure of the account with them paying back my money !
