  1. I recently switched from 3 to EE after getting the letter saying I was being kicked off the £15 one plan and my bill was doubling in price to £30. Got my pac code, switched to EE and they charged me a early termination fee - my contract ended in July 2014 and was on rolling month to month. It took 3 calls on same day to actually get the pac code and by time it came through it was too late to give to EE so ended up costing me an extra day on 3. Took a while arguing the early termination fee but they finally agreed to waive the fee but what a nightmare. It should be more easy than this. My mate did exactly the same and it took him 3 separate tries to get a PAC code and again charged him early termination fee which eventually got cancelled.

  3. Took out a mortgage in 2008 and shortly afterwards lost my job. It was a £120K mortgage of which I owe £98K on of which about £1.5K are arrears. A local estate agent said I should put it on market for £100K which even if I got asking price I wouldn't be able to sell as i'd have £2K early repayment charges and about the same estate agent/solictors fees. My mortgage switched back to repayment a few months back meaning I had to find £250ish a month which I couldn't afford so they agreed to accept the £100ish I'd been paying each month on top of mortgage support from government, but obviously getting further and further into arrears. I started a part time job a few weeks back meaning if pushed I could pay the mortgage minimum payment but as I also have quite a few other debts totalling tens of thousands, two of which totalling £15k as charging orders on my property and I'd kind of accepted the fact that I will be losing the house. Bankruptcy is the only option for me but i've been holding off to keep the family home as long as possible but was wondering what the best option would be... I could keep up full payments for the next 4-5 months or so until I don't have early £2k repayment charge and sell my brother the house for exactly what I owe mortgage provider and then rent it back off him. Problem I have here is what happens with charging orders and could they stop the sale of the house when realise they will be getting nothing from the sale. Doing it this way I'm only selling for market value or at best very tiny amount less so don't see why they could stop the sale? He hasn't agreed to it but I'd like to think he would do this. Or I could continue paying the £100ish I'm paying now and just sit and wait for them to evict in the hope that the £100 will delay it longer than just cancelling the standing order outright and stop all payments. Ultimately i'd prefer the first option as we get to stay in our home but i'm prepared to move if need be.
  4. I've been almost sanctioned a few times but luckily now in employment. One time it was at the JC when they said I hadn't applied for enough jobs although I had but due to the directgov site playing up meaning I didn't add a few on and when it was later working I forgot to add them, but when she pointed this out I told her about the missing jobs and I don't think she was too impressed. Other times its always been the WP's fault. They have cancelled appointments because the advisor was ill and then I got "a doubt has arisen on your claim..." letter which I then had to explain it wasn't my fault, then another time I got another letter which I didn't have a clue about. I rang up the WP and they said it was because I didn't attend an appointment for a job for a local company that they were holding pre-interviews for. The thing was they claimed the appointment was on a Friday and that it was a mandatory thing, but it wasn't mandatory and I actually turned up on the Monday after that as was arranged, then the Wednesday for a follow-up pre-interview and then yet again on Friday for an actual interview with the employer as I had passed their two days of time wasting nonsense. They reluctantly admitted fault in the end and I wasn't sanctioned but I'm so glad I don't have to go in that place no more! One other time I went for my appointment but as I'm a single parent and it was school holidays I had no choice but to bring my child with me to the appointment. They said I couldn't come in as they don't have insurance to cover children in the building and said they would mark me as did not attend. I ended up having a rather heated argument with the stuck up old cow as they knew I was a single parent and every other time they had made me an appointment it was within school hours. They keep leaving me answer phone messages to check up on me. What a joke, if they ring when I'm not at work and I answer the phone i'm going to tell them where to go, its bad enough having to put up with the idiots when your forced to but they can F.O. now I had no obligation to have anything to do with them.
  5. Well I have 3 charging orders in my property all for over £1000, but there is no equity in my home and I am currently £1500 in arrears on my mortgage anyway. So personally i'm more worried of my mortgage provider taking the house than the scumbags that turned an unsecured debt into a secured one.

  9. I didn't have PPI on the card. I don't have any credit card statements anymore and I don't suppose I could apply for them now that they are taking me to court for what they claim I owe them?
  10. About 8 years ago I took out a Visa credit card with Lloyds TSB. After a few years LLoyds TSB sent me Mastercard and Amex credit cards out and about a month later canceled my visa credit card as they no longer do credit cards with visa. Anyway I became unemployed last year and could no longer afford to pay my credit card and bank loan with them. After a call to CCCS they finally agreed to temporarily accept £1 a month for each debt and I paid the Credit Card for first two and months and the loan every month since then. I sent off CCA requests to both however as the loan was quite new I wasn't expecting it not to be in order but I knew there'd be no valid CCA for the credit card as it came out of the blue without my knowledge and I never signed or agreed to anything. Lloyds eventually sent me a photocopy of part of the original VISA CCA without signature and a covering letter saying they had completed the request and they did not need to send an agreement with signature but about a month later they sent a photocopy of the original VISA CCA with signature. I sent them the dispute letter and kept getting the threats through the post which I still have in the cupboard but then it went quiet and I got a county court summons through the door on Monday. I'm going to fill the form in online and dispute the full amount but could someone give me some guidance on what to write not really good with legal matters. Not that it matters but about £500 of the "debt" is just charges and interest they have added on since I "defaulted" on the "debt" so obviously if worst comes to the worst and they somehow manage to persuade a judge that I have to pay it (which I can't anyway) then how do I go about having them remove that? Really need some advice here guys. Cheers

Sent my credit card and van finance company a CCA request letter and had another letter off the company the van finance company are using to persue me yesterday saying i'm trying to avoid the "debt" so ignoring that for now I know they have got the CCA request as I tracked it on royal mail website. Anyway got a letter off lloyds tsb regarding my credit card which I can't scan right now but basically they say.... Enclosed copy of executed agreement, a copy of your current terms and a signed statement of my account. They then claim this satisfies there obligation under section 78. They say they do not have to provide a copy of the original signed agreement. They are now saying its fully enforcable and will treat it as such. Is this right?
  13. Just received another junk letter from BCW, don't think the clowns got the hint with the stat barred letter. Have I to report them or just leave them to it after all theres nothing they can do except fill up my recycle bin?
  14. OK will shred it I've been thinking about the lloyds tsb credit card debt. When I took out my card it was a visa credit card but a few years ago it automatically switched over to mastercard and american express duo cards. I never signed a fresh credit agreement with them so that should mean if I CCA them they won't have anything to send me and legally they can't enforce it?

Just got a letter off the van finance company asking me for a incoming and outgoing and it has to be signed from the job centre and if I don't fill it in they said they'd revoke the agreement of £1 a month. I've binned at as only been paying for 2 months and my situation hasn't changed but am I right in doing so. I have a good mind to send them a CCA request and hope to god that they can't provide it (I wish)
  16. I sent them both stat barred letters and think i'm gonna CCA the legitimate people I owe money to cos i'm sick of getting calls off LLoyds and them charging me £100 a month.
  17. First one first...just had a letter from CL Finance Limited acting on behalf of the Lewis Group I believe they said on the phone. It wasn't sent to my address but to an address I haven't lived at in about 8 years. I thought it was a bit strange as the amount was quite small just a few hundred quid and the only legit debt I have is for a lot more than that. Anyway I rang the number to ask them what this was about and CL Finance passed me through to another company I think they were called the lewis group. I asked them what this alleged debt was from and they said it was from "Shopacheck Financial services", it took me a few mins to realise what this was. It was one of them home loan things where you borrow £100 and you pay back £300 or something along those lines. This was from an address I lived at 9 years ago and after moving out all those years ago I have had no contact with either shopacheck or any DCA about this so I told him good luck in chasing a statutory barred debt and he then went on about do I know what one was blah blah blah and I said yes now good luck and bye. He was still waffling on as I hung up on him. Pics of front and back of letter... Second one is from a company called Buchanan Clark & Wells, on behalf of Aktiv Capital for a "debt" from Barclays Bank. This debt is the same age and again i've never received anything from these clowns up until a couple of weeks ago, I binned the first one so this is a scan of the second one. I did have a default on my credit file from Aktiv Capital but I didn't bother chasing it up as I already had a credit card and didn't need to be in any more debt so didn't care, besides I never owed barclays the debt, it was fraud on my bank account and they were very unhelpful so I just switched banks and moved shortly after. I never received a default notice if it matters and it cleared off my credit file about 2 years ago so thought it was the end of it until I get these two letters. For both i'm inclined to just shred them and forget about them but wanted advice before I did this... Also on another matter last year I owned a franchise last year and had to buy a van which as I was ripped off in January this year by the franchisee had to return to the finance company. Since closing down the business in January I stopped paying the monthly direct debit and shortly after I contacted them to take the van away and paid £70 to voluntarily hand it back. They sold it at auction and now claim I owe them almost £8k which considering the van was only £13k to start with and I paid back £3k in monthly fees and they sold the van for almost £8k, the only thing I can think of is they are charging me full interest on the loan even though they have received quite a large chunk of it back. I also had to stop paying my credit card and bank loan with lloyds tsb. The credit card i've had for years but the bank loan was only from last year, in total they both amount to about £14k + interest. I spoke to CCCS about this and they sent me a letter to send to all 3 creditors offering them a token payment of £1 a month. The van finance company have accepted it on the condition its reviewed in 6 months. I have made 2 payments on each account so far. Both lloyds tsb loan and credit card will not accept the offer (but I am still paying it as per CCCS recommendation) and they keep ringing me every few weeks leaving me answer phone messages to contact them. Another problem is here is the credit card company are charging me £12 per month for not making the minimum payment, £12 for being over the limit and about £80 in interest. Really need help here guys.
  18. Can't just sit and take it m8, its going to small claims court but I wanna know what to put in a letter to them and finally to the court so they can't just mess me about any more.
  19. Well it would seem i'm not alone with these cowboys. Anyway, i'll put down my story... Approximately 6 years ago I had a mobile phone contract with Singlepoint. I had lots of problems with them (as did everyone else it seems). In month 11 I sent in my notice of termination along with a final cheque for over £300 to pay off the account. They received this cheque and banked it so obviously got the notice of termination which they require to terminate the contract. On the date the contract should of ended I snapped up the sim but Singlepoint never honored the termination of the account and kept sending me bills getting £20 dearer every time. I rang them up on many occassions to sort this out and they said it was just a computer error and would be sorted. Anyway I moved not long after this and its the last I hear of it until about a year ago. I was wondering why I was getting turned down for credit so decided to get my credit report from equifax, turned out I had a couple of Defaults on my account (one from 3 which has since been paid off and removed from credit file) and one from 1st Credit Ltd. Equifax give me there phone number and I ring them up. They say its to do with this "debt" with Singlepoint and I owe 1st Credit Ltd £86.13. I said I never owed Singlepoint any money and ask for there phone number, but Singlepoint don't exist no more. Vodafone took on Singlepoints customers/business whatever so I get the number for Vodafone. I ring them up and they say the amount is £84.13 and give me the account number, phone number and a date to which it ended or something like that. They couldn't tell me any more info than this as they said such records are no longer kept. I get back onto 1st Credit Ltd, who in turn couldn't tell me anything more apart from the fact I owed it and said I should of paid it back then instead of moaning about it now. In the end I got sick and paid them the £84.13 but now I've found out about my rights I want my money back and am willing to take them to court to get it back! To make matters even worse they told me it would be removed from my credit file, but it hasn't its just been marked as settled, which I suppose a lot of lenders would still see in a bad light. I never got a default notice (in fact i've never had a single letter at all) from them so therefore they have no legal right to show this on my credit file, is that right? Anyway I'm going to send them a recorded delivery requesting my money back and this took completely off my credit file but could someone please tell me what laws they have broke so I can go about it right.
