  1. sorry if there is a thread with this on but couldn't find it. i'm now going to start doing a friends charges for them due to their lack of internet but was wondering 1) should i start now or hold of until test case is sorted and 2) whats happening with test case and is there anywhere i can read up on whats happening with it?
  2. hi sash050677, went through the whole process, i was 4 days away from my court date when i got the letter from dg saying it had been paid into my account.

  4. Looks like i'm the first to post the good news on this thread, got my money back on 3rd august paid in full courtesy of HSBC. Don't give up anyone may take a bit longer but you will all get there in the end and the wait is well worth the satisfaction of beating the bank let alone the money as well! :p
  5. got letter in post from dg saying money been paid into my hsbc account and could i contact court by letter to call of action and send copy of letter to dg. checked bank money in there so wont bother about insisiting on a cheque just happy to have recieved it. again cheers to all for the help in getting my money back!
  6. Cheers hardcore seems you don't need to much spurring on you, didn't do to bad with halifax ya self! Sent the acceptance letter jowalshy gave me by recorded delivery on tues morning and also faxed it across monday afternoon but still no cheque, lets hope its down to the postman on strike and not a change of heart on HSBC's part:confused: Court date is still on for next tuesday at mo, how late can i still call of the court action, day before or same day ok?

JACKPOT!!! got in earlier and found a letter from dg saying they think there clients charges are all legal but due to the legal costs associated with litigation in the small claims regime they are prepared to make me an ex gratia payment of £2417.16 (the full amount). do i have to contact the court and stop the claim or should i wait for the money to be bank first but bearing in mind the court date is next tues (7th aug) so need to act quick? would like to say thanks again to all on this website who have helped me to get this money back, not sure i could have done it without your help, Thank you all!!!!
  10. does anyone know where i stand with my claim now a test case is being heard from all banks? i sent the letter wed as lat said and still not heard anything should i just continue as normal or will dg and judge not bother doing anything until test case is heard?
  11. As expected nothing in the post so letter is going in post first thing in morning but do i need to send a copy of the letter to the court as well?

It's deadline day tommorrow for dg to submit there defence and i'm guessing it won't be in the post so was wondering should i send this to dg [date] Dear Sir/Madam, [You] –v- HSBC Plc Claim No: ******** I write in relation to the claim as detailed above, and specifically the order made by District Judge ******* dated [date]. You were ordered by the court to by [date] file and serve the documents upon which your client intends to rely at the forthcoming hearing. Just re-read the letter from court and see what you mean, So just sit on it for now then and wait till 24th july which is 14 days before hearing and hopefully when they don't respond the judge will strike it out. Should i still send your option 3 letter then pete or wait till 24th as well? Sorry for the stupid questions just don't want to do anything wrong in the home straight!
