"Your request for Judgment by Default has been accepted" - eek!
Stakkertoo replied to Stakkertoo's topic in Lloyds Bank
Nope, i used my branch address. But they returned an acknowledgement so they obviously got it. (??) -
After reading another thread on here I have called MCOL and asked them to put a bar on this judgement i asked for as I have been led to believe that a judgement by default will just end up with the bank having it set aside and then another month or so of nothing, plus the £55 fee for a warrant. So, do i just wait it out for the bank to mount a defence?

I just called MCOL on the advice of another thread and they told me that I was able to get a judgement by default as they had heard nothing from the bank and I was overdue. Should i just click it on the website then?

Also, I haven't sent a spreedsheet of my bank charges to the court. Am I meant to? Thanks for any advice, I am quite sure I am going to mess this up if left ot my own devices! Also, I have just checked on MCOL and the Judgment column has changed to 'continue' and if i click that it says "At this moment you are allowed to request a Judgment by Default." Shall i do that? I am sure they are way over their deadline.

I got my statements back in November after waiting about 5 weeks for them. I then got round to counting up the totals, adding interest and then sending my claim via MCOL. This was what i used in the Particulars of Claim box: It was issued on the 27/04/07, so i figured I would hear from them within 2 weeks. On the 14/05/07 my MCOL login told me that the claim had been acknowledged, and it said that The Defendant is allowed a total of 28 days from the date from when they are served with the claim to reply. Does this mean that I can apply for a judgement by default, being that the 28 days from when it was served expired on the 25th. OR does it mean that they have 28 days from when they acknowledged on the 14th? (which would be the 11/06/07) (the paperwork i received from the court contained a photocopy of the LLoyds response and they had ticked the 'Defend the entire claim' box)
