I called the court today and asked if the following: 1) Each party shall deliver to every other party and to the court office copies of all documents (including experts' reports if the court has given permission for expert evidence to be used) on which he intends to rely at the hearing. means what it says... 'i should prepare and deliver to Barclays and the court, documents on which i will rely at the hearing. To be honest half of the suggested court bundle does not make sense to me i'm afraid and i have only included what i feel is evidence in my case and if questioned on anything in my 'bundle' i feel confident i can support it on the day. when i mentioned to the lady at the court what was suggested on here to be included in the bundle, she said it is best to supply what i have been asked for and would see no need to provide more information then i see necessary, so here goes..... I have included: 1. Statement of Evidence, mainly taking out the bits that i fell were not needed 2. Unfair Terms in Consumer Contracts Regulations 1999 3. Office of Fair Trading report, April 2006 4. House of commons early day motion, May 2006 5. BBC commission conclusion - BBC NEWS | Business | The Money Programme bank commission 5. All pre-litigation correspondence sent to the Defendant Who knows if it will be correct or sufficient information to win me the case....but atleast i still have my sanity! Whatever happens i will update when any progress (hopefully good!) is made! Thanks again everyone!
  2. Hi I am claiming back charges from Barclays and I have a court date of the 3rd August! I have just noticed that my 'Notice of Allocation to the Small Claims Track (Hearing)' letter from the court does not actually ask for any 'court bundle' Infact all it says is; The following directions apply to this claim: 1) Each party shall deliver to every other party and to the court office copies of all documents (including experts' reports if the court has given permission for expert evidence to be used) on which he intends to rely at the hearing. 2)The copies shall be delivered no later then 14 days before the hearing. 3) The original documents shall be brought to the hearing. 4) The court must be informed immediately if the case is ettlted by agreement before the hearing date Does everyone's say this?!?! Does this mean that i don't actually need to provide a 'court bundle', this may be a really silly question but can i just provide the letters i have sent from the beginning of the claim? as the letters themselves explain why i am reclaiming 'unlawful' charges. Desperate for any info or advice now. Many Thanks:(

I have spoken to the court who have said that aslong as i send the court bundle in before the hearing it should be ok....so i have abit longer now, Is it now worth me requesting copies of the letters i don't have from Barclays (altho the chance of getting them by next week is pretty minimal, isn't it?) shall i request them from the customer svc team or the lit team....i haven't heard back from Paul Quinn yet but i could contact him today...any advice would be very very helpful!
  4. I don't even have the letters that they sent saying theuy had aknowledged my complaint and the partial offer! Should i just give up now?!?! And excuse what is probably a really stupid question but i guess eventho i didhn't have an AQ i still need to provide the whole soe? :(

Hi Trucker, thanks very much! i am getting very worried that i don't actually have any penalty notification letters, i didn't keep any, shredded then straight away and i never thought to request any from Barclays until reading all of this 'stuff' now. I'm getting so worried, i need to post this latest on Wednesday! i get the feeling i am doing the bare minimum and it will be struck out because of my lack of knowledge about it all. I know it's my fault but i dopn't feel i've had enough time between receiving my court date and the bundle deadline! Yikes! i'm really feeling sick with it!!
  6. Oh no Paul Quinn is apparently dealing with my case!! he's only got 1 star! I'm half way through my court bundle and has to be in on Thursday at the latest! I'm still a little confused as to what the Statement of evidence is, any help would be fab! Thanks! :?

  8. One other thing...I didnt receive an Allocation Questionnaire as it was deemed not necessary buy the judge, where does this leave me with regards to the Statement of Evidence? Bree :?
  9. Thanks saintly_1 and Thanks again oneofakind! with regards to contacting the litigation team...does it not matter that i already called the customer service team yesterday and asked if they were prepared to settle out of court...ofcourse they said no!
  10. Hi Everyone, Just wanted a little advice (and reassurance! i'm abit worried) i now have a court date for 3rd August. I am currently in the process of claiming back charges from Barclays (as of today charges are £1795.43 incl. court fee and int.) , i have now received a court date of the 3rd August, my court bundle has to be in by next Friday (20th) i have absolutely no idea what i need to send and how it should be presented. I was going to send a final 'nudge' letter today but waiting for a reply would be painful!!! so i called them, they have previously offered me £900 but i refused it and today they said the will only make an offer once and as i had refused it this will have to be settled in court...the thought of appearing in court scares the hell out of me but i need to get a wriggle on with the bundle so any information or advice would be greatly appreciated!   11. Hi Calculator, Sorry for the confusing post, i have drafted a letter to Barclays Solicitor. The £120 court fee was included in the original claim online and i did state that i would be claiming interest. I think my main concern was the interest calculations, wether this was something i had to do myself and state in the 'nudge' letter what the total interest was up to the date of the letter. I will be sending the letter today, Many thanks for your help!
  12. Hi, This is my first post so i hope i'm creating it in the right place. I am in the process of claiming my charges back from Barclays. Yesterday i received 'Notice of Transfer of Proceedings'. I must admit that up until now i haven't really been too involved in this and not really given it much thought. Silly really, now i'm getting abit worried that i don't actually know what i'm doing and timelines are being set. My notice states the same thing as most it seems... '1.The filing of an allocation questionnaire be dispensed with in this case unless the District Judge at the court of transfer orders otherwise.**' I have just drafted a 'nudge' letter to send to the solicitor including the spreadsheet of charges. Do i stick to the original amount on the claim form with Money Claim or can i update the charges adding the new interest charges plus the £120 fee paid to start the claim? Any advice would be greatfully appreciated!!!
