  1. Hi I can email the witness statement from Abbey along with their attached evidence. I do not think it appropriate to post it for all to see.

  6. The stay was lifted a) because they did not submit a defence to say why it should remain and b) that I am accruing charges (interest) on a balance made up of charges. The DJ was not best pleased that they never showed up or submitted a reason to keep the stay in place.

  8. Hi there Yes I have recieved a copy of the witness statement from Abbey and have it in PDF format. It appears to be a standard version they have compiled as it is reflective of the OFT ruling
  9. I have successfully had a stay removed. Howwver, Abbey are now re-applying for the stay to be re-applied and have sent an application to the court with a fee and witness statement asking that the court reapply the stay. Following my initial stay removal, the hearing date was set for the 8th Jan. Can anyone help? the application hearing date is 3rd Jan
  10. I have now recieved the info from the court regarding the application from Abbey to have the court re-apply the stay that was removed by the DJ. The hearing date for the application is now 3rd Jan and the hearing for the case itself is the 8th Jan PLEASE CAN ANYONE ADVISE?:o
  11. Hi Gary Abbey did not turn up at the removal of stay application hearing. The district judge appeares non to pleased that they did not even submit any objections. I have tried to negotiate with Abbey as per the DJ advice, but instead they sent me info about them re-applying to have the stay put back

  13. Hi all On 9th Oct this year I attended Bury county court in relation to my application to remove the stay impsoed by the courts. THE DISTRICT JUDGE KINDLY REMOVED THE STAY ON THIS OCCASION AND SET A HEARING DATE for 7th January 2007. Today I have recieved a copy of an appl;ication by Abbey to have the removal of the stay overturned which they have sent to the court with a solicitors witness statement referring to the OFT case. The court to date have not contacted me as yet, only abbey who sent me the paperwork. ANY ADVICE GLADLY WELCOMED
  14. Recently my local court BURY stayed my claim for bank charges reclaiming until Sept 2008 pending OFT test case decision. Having read the advice on CAG, I did the following: * Sent the N244 application for hearing form to the county court detailing concerns regarding the staying of the case. I have now rwecieved a letter from the court inviting me to a hearing on 6th October. I telphoned them as it said that for furter info, contact them and they said that I needed to attend and that it was a 'direction hearing' and that both claimant & defendant was sent the same letter. What does this mean?

I have recieved an order from the district judge of the court that MCOL transferred my claim to asking for: *Statement of Case *Comprehensive costings I have not been sent an AQ and assum that I will be sent one once the above is submitted as the judge struck it out but I assume has given me a chance to submit this information. I initially sent some extra info (Statement of charges) to MCOL to accompany the claim I did online, but somehow my local court never recieved this. Can anyone help me with the statement of case and what I should include
