  1. Not surprised that i never got a call back as promised and still no money getting a bit fed up now will be back on the phone again tomorrow.
  2. Well today i phoned the D.w.p and spoke to a very nice lady to ask when i would receive a payment, she was puzzled why it was stopped as i was appealing the decision,she emailed the benefit department to send a payment through and call me back, hopefully be today as i still haven't had a payment yet. She also informed me that i am now on the support group for 18 months which was odd as i received a WRAG letter telling me to attend, but she told me to phone up and inform them i no longer need to go to it, what a lot of hassle!will let you know when things are sorted.
  3. Sad news, although i never knew Martin i know by looking at the comments he was a very big help to all those he gave up his time to help, my condolences to his family and friends R.I.P.

  5. Thanks for the replies just had a letter from the d.w.p this morning it says that, your appeal will not be sent to an independant tribunal as the decision has been changed in your favour, so i take it my money will start up again.

Hi i went for an Atos medical in november and surprise i was passed fit for work for the second year in a row even though i am diagnosed with severe agoraphobia, depression and have anxiety/panic attacks, i have sent away an appeal form gl24 with a letter wrote with guidance from the citizens advice bureau plus a doctors covering letter with sick note. Now my question is the esa was stopped from the 13th jan last month i was then told over the phone by D.W.P that i would still receive esa at the basic rate while on appeal, i sent everything away on the 23rd jan and thought i would receive payment as normal on monday but nothing so i phoned them to which they said i would not receive any payment until next wednesday at the latest as it was on referral, this never happened last year and as you can imagine the stress knowing that i have no money for 10 days has left me feeling very sick and upset. Can anyone tell me if this has happened to anyone else or is this a new way of breaking you.
  7. hi all you need to do is go to the financial ombudsman website click on bank charges and on the left of that page it says our complaint form download it give the fos as much info as possible letters, phone calls amount of charges owed and they will get in contact with your bank. they will tell you that they give the bank 8 weeks to reply if they dont contact you or send a letter stating that the charges applied were fair and correct send that letter and anything else that can help your claim ie statements showing charges etc thats what i did and two weeks later, the bank decided to pay out rather than letting the fos do a formal investigation on them good luck
  8. hi tootsmaloots contact the financial ombudsman they seem to be the best approach to dealing with banks when you live in scotland im getting my charges back when the financial ombudsman were going to do a formal investigation and the bank of scotland decided to pay back charges in full rather than let it go that far im getting £1342 just waiting for the money to go into my account.
  9. hi dolphin939 the fos have sent me a letter today to send back with my acceptance slip for the money so once i send it back then the bank knows i have accepted the money and the fos will back that up dont know when the money will be in my account but have waited this long so another week or so will be a breeze knowing i have won.
  10. hi dolphin 939 i started the ball rolling back in january which i gave them 8 weeks as stated in my letter nothing so got in touch with the fos who took my claim and after 8 weeks with them got a reply from the bank stating that the charges applied to my account were correct and i would recieve nothing back so i gave the fos there decision and within 3 weeks the fos replied by email saying that they were sorry for the delay and the bank were offering £1342 back rather than letting the fos do an informal investigation so its been longer than some people but im glad i have been succesful and not had to go to court.

Hi i have just been made an offer of £1342 from the bank of scotland which is slightly more than i asked for but im not complaining, got an email from the fos and they told me that the bank think that there charges are fair but do not want to be investigated further by the fos so will recieve letter tomorrow with aceptance slip and, whoo hooo another victory for the good people out there. To all consumers who have been ripped off GO DO IT DO IT NOW, if your from scotland get in touch with the fos its an easier route than going to court if your owed more than £750, as you would have to take out more than one court action i did and am now just another statistic in the ever growing campaign to get whats rightfully yours good luck to everybody who has made a claim or is thinking of one.
  12. hi yes i got my statements two weeks after i asked for them but the fos are having to investigate further as this has been ongoing for over 3 months had two letters from the bank both saying that the charges applied were fair so sent the last one to fos who hopefully will get my charges refunded otherwise court action if a bank cant tell you what the charges were used for then they should be repaid thats why most banks have never gone to court i thought the process wouldnt have gone on this long as per other consumers who acted against there banks fingers crossed i get paid in full in the not too distant future good luck with your claim.

Hi daisygirl i too am trying to claim against the bos and got the exact same letter saying that charges applied to my account were correct and would be given no refund, its now in the hands of the fos who are now going to look further into it as the bank still refuse to pay back charges. One time the charges took me over 100 pounds over my overdraft and they had the cheek to charge me interest for being over, but what ticks me off is that if there was not enough money in my account to pay the direct debits how could they then take money out of an account that had insufficient funds lets hope i get the money back and good luck with your claim.
  14. Hi this is my first forum on here but needless to say it wont be my last. I have been trying to get charges totalling £1264 from the bank of scotland, i wrote to them in january and they are saying that the charges are not going to be returned i then contacted the fos and they are looking into the claim but this has been ongoing since march 17th when the financial ombudsman got involved they sent the bank of scotland my letter asking for repayment of charges giving them 8 weeks and just before the eight weeks were up a letter arrived again saying that they will not be repaying charges so i sent it of to the fos who are now going to ask the bank where they get the figures to charge as much as they do i thought i had a good chance of getting some if not all of my money back but as it has taken so long im starting to think i wont recieve anything has anyone else had to wait for repayment of charges from the bos.
