  1. Hi I want to send a combined offer refusal, conditional acceptance and LBA. This is what I've got so far. Would it be possible for somone to check it over for me as I don't want to hand them any ammo? If somone could help me out that would be great. Thanks, PatsyTheCat ----------------------------------------------------------- Response To Settlement Offer And Letter Before Action WITHOUT PREJUSTICE Dear Sir or Madam, Thank you for your letter dated xx/xx/xx. I will accept your reduced offer of £xx.xx instead of the full £xxx.xx on the strict condition that the default you have entered on my credit file is removed completely and you confirm that this has been actioned within the next 14 days. I am prepared to do this for the sole reason of saving both the courts time and ours. This default occurred merely in respect of unlawful charges levied by you or was the result of impecuniosity caused directly by you taking penalty charges that you had applied unlawfully to my account. In addition I have requested a true and signed, certified copy of the original default notice in my letter dated xx/xx/xx which I have received no response to. I have never received such a notice and as I’m sure you’re aware, without this, the default is unenforceable. Please note that I require complete removal, mere correction or amendment to the entry will not be acceptable. If you are not prepared to remove the default then I respectfully decline your offer of Full and Final settlement and request, once again, that you return to me all charges imposed on this account, totaling £xxx.xx. Again, if you are not prepared to remove the default then I will accept the sum offered only as part settlement and on the clear understanding that I will pursue recovery of the remainder along with default removal, with a County Court claim if necessary. As a side issue payment will need to be made by cheque or bank transfer and not into my Capital One account as this account was closed some time ago. My “Request for repayment of charges and removal of default” letter dated xx/xx/xx indicated that you had until xx/xx/xx to respond before I proceeded to the next stage of my request. This deadline has now expired so I am giving you a further 14 days in which to respond. If you do not respond favorably before the expiration of this second deadline I will commence a court claim against you without further notice.   2. Hi guys, I currently have an all singing and dancing bank account with Barclays but do fear that when they cough up they'll take my account away. Due to a poor credit history it's very likely that I'll have to take a 'basic' account of some kind. By having a basic account - can this effect my credit rating even further or would it make no difference at all? Any information on this would be very much appreciated. PatsyTheCat:)
  3. Hi all, I have two Defaults on my credit file, one from Citi and another from Cap 1. Both of which were issued 4 or so years ago according to my experian credit file. I cant remember receiving the 'default' documentation or if I signed anything but I do remember being contacted via telephone by DCA on their behalves. If i send them both this letter requesting the information and they are able to provide me with it - could it cause me any further problems?

  6. Hello, I'm not sure if this is the right place but it seems kind of relevant. I'm very protective of my credit history as I've had issues in the past which have caused me problems and things are just starting to improve for me. I'm a little bit nervous about claiming back my charges because of this. I just really wanted to know if they close my account whether this will have a negative effect on my credit rating? A bit more background: I've just paid off my overdraft but I do have a loan with them but this is all up to date. Just wanted to know the potential consequences if they close my account... Thanks
  7. Cumon guys first post and all... In brief what I wanted to know was: 1) If the debit has been sold on from the original creditor who do I claim the money back from? 2) Should I send the letter requesting info on my default notice or will the S.A.R - (Subject Access Request) cover this? Its just I don't want to wait 40 days and then find out that the info is not included and I should of requested in specifically? Any help would be really really appreciated. Thanks
  8. Hi there, I'm new to this forum and hope that you guys will be able to guide me:) I've just sent off my S.A.R - (Subject Access Request) forms to Citi card and Cap 1. But I have a few q's... Firstly on my Capital 1 account they agreed to settle back in 2004 with a partial payment (although I cant remember or find paperwork relating to it now!). My original credit limit was £200.00 but the balance went up to about £490.00 which I believe was mainly due to charges etc ( but I will not know this for sure until I receive my stmts). I just wanted to check if the 'partial payment' will make any difference to my claim. As far as I can remember this was dealt with via an outside agency they employed called AIC. Again, does it make any difference to my claim if the debt was sold on? I've also received defaults on this account and another through Citi card. I understand there is a letter I can send to request info about the original default notice (as I dont have the documentation and don't recall seeing it) and as I understand if they cannot provide it, there have been cases where the defaults have to wiped off credit files. Also as I have sent off my SARs to both companies already should I also send these letters requesting this specific information regarding the defaults or should I wait? Any help here would be very much appreciated. Love PatsyTheCat x
