  2. Thank you MARTIN3030......I appreciate what you say....I'll get in touch with court tomorrow. Obviously I'll state my own case...Quote numbers, etc....Letter from Abbey as to why they settled with me....And also my willingness to appear at court!! Seems crazy that the court....having seen that Abbey have settled so many cases in the past....with exactly the same set of circumstances... Are now denying other people the right to do so....Even though they're prepared to cough up the £65 or so that THE COURT say will enable TO proceed.....What the hell is going on?? Thanks Scott, but at the time, the court were saying that if I wanted to proceed I could..... provided that I was prepared to pay a further fee....In the region of £30 if Abbey agreed or £65 if they didn't. This was a further means by Abbey to complicate matters, but, should I have been prepared to challenge this....the concensus at the time... was positive...in favour of the challenger. Does any of this ring a bell at all? Cheers mate... Steve

  5. Ok....sorry not to have got back until now Scott.. I pursued the claim (as normal), all the way, having paid the £80 I was waiting on a date for the hearing, obviously full of confidence, and prepared to turn up myself to fight her corner. The thing that flumoxxed me was the unexpected response from the court stating that Abbey had put a stay on proceedings and that a charge would be necessary for me to carry on. Cheers Steve....
  6. Thank you for your prompt reply, Not having pursued the case for so many months, I'm not sure how to proceed. If my memory is correct, they (Abbey) put a stay on proceedings last september. How would I begin to overturn this and carry on as normal? I remember at the time that there was a fee to pay....In the region of sixty-five quid....Is this still applicable? Cheers....Steve
  7. Good evening! Having had success with my own claim for bank charges, I took on a claim for the daughter of my girlfriend. This has been on hold since September of last year (2007), when Abbey said that they were "waiting for the test case to be heard" Not sure how to proceed....Should I just push forward, citing my own case and submitting all of the evidence, letters, etc from them, as proof that they have paid out on this type of case before? Or have things so changed in the past year, or so, that this approach would not be workable? Any help would be most appreciated.... Steve....
  8. Good evening to all....I've already claimed...and won my bank charges..and am now in the middle of claiming them for my girlfriend's daughter. Her's differ from mine as they include interest for going overdrawn. I know that interest can be added for the penalty charge i.e £32 or £35, but can you add interest on the interest charge for going overdrawn? Many thanks....Steve
  9. Good evening to one and all.....Abbey have settled ....£1,083. It's taken over 10 months, but it was definitely worth it. However, I've agreed to take on the reclaiming of charges for my girlfriend's daughter. My bank charges were fairly strightforward, just unpaid direct debits and standing orders. Having gone through her statements I have found that she has some of those too, but also 1.charges for when the Abbey have paid the direct debit, meaning that she has gone overdrawn. 2. Charges for going over overdraft limit 3. Interest charges while overdrawn. 4. Charges for Visa payments paid when not enough in accou 5. Charges for clearing cheques when not enough money in account Could anybody advise me as to which of these she can claim back? I'm fairly certain about the first four, but not about the fifth Many thanks Steve
  10. I have just received my N149 (Allocation questionnaire), but am not sure how to fill in section E (Experts), especially where it says.. "The court may order the appointment of a single expert who can be instructed by both parties. If you think this would not be appropriate, please say why" Could anyone offer some advice please?   11. Thanks to both of you....I wasn't concerned about the £3, just that they might try something because the amount I'm claiming doesn't tally with the actual amount.... Thanks again...I'll just send the paperwork off and wait for a Court date.. Steve....
  12. I have just photo-copied statements to send to the court and to Abbey, but on adding them up I have found that I am £3 out. When Abbey made their GOGW payments they refunded 3 lots @ £35 and one @ £32 totalling £137 Not realising when Abbey put up their charges I have calculated it as two @ £35, two @ £32, and £3 off my fifth last charge totalling the same £137. This means that they owe me £3 more. As the sums now don't add up excactly what should I do? They have already made an offer, so I'm almost at the point of full settlement, and don't want to give them the opportunity to delay matters any longer. Any help would be most appreciated... Steve....

Good evening.....Re: your first question, I would say that is sufficient, although I would recommend that you send it Special Delivery....They're are so much easier to track...recorded deliveries go astray more often too! As for the 2nd question...They hold the right to close it at any time I think, but it's highly unlikely even in these circumstances. Steve....

OK....many thanks....I'll go down that road....As I found out about the charges in April of 2006 and sent my first request for statements off on 23/5/2006 and have proof of this (Special Delivery receipt), then the claim for charges going back to 30/6/2000 seem valid. Abbey have already refunded all my charges for last year (One each in May, June, and July)...and one from 2/11/2005, as they stated in their correspondence that the GOGW covered the most recent charges. This leaves the period 30/6/2000 --2/10/2005 as the period in which all my other charges were incurred. Thanks again.... Steve....
