  1. Right, I have finally got my court date for the 2nd October, so what should I do now, is it time for some nudge letters?
  2. Thanks for that. The thred I used to help me fill my AQ had a line to add in section G that said, I have also sent a copy to Abbey on xx/xx/xx, so I did.
  3. Right, just given my AQ into the court and have made a copy to send to the Abbey, I have 2 address,which is the best one to send it to, or does anyone know a better one.   7. Thanks livelylad for your help, great information helped a lot. After reading through the Abbeys defence they say: The claiments contention that the said fees are unenforceable and/or are "penalty charges" is denied. But in their last letter they say: "Having carried out a full investigation, I can assure you the charges do not contravene those regulations and therefore I cannot agree to refund them" Have they changed their minds and are now calling the charges "fees" to get around paying them. Does this mean anything?
  8. The post came this morning with a letter off Abbey, it says "Yourself V Abbey National PLC "(scary)."We enclose by way of service a copy of the defence that we have filed with the court." Then the rest of the letter about how they are going to defend the claim. If anybody could give us any advise about what to do next, this would be great. If you need anymore information or want to know exactly what the rest of the letter says just let us know. Thanks in advance for any help
  9. Hi My brother has just put me on to your site and if makes wonderful reading. I started my claim against Abbey on the 1st of Feb 2007 for 2,015 (no interest) by sending the letter requesting them to repay my default charges and that they have 2 weeks to respond. Got a letter on the 5th Feb saying that it would take 40 days to investigate it properly. Received the second letter (the usual 1) saying no way (or words to that effect). We sent the second letter on the 15th March saying they had 14 days to refund charges or court action would follow and interest would be added. After hearing no response we started court action on the money claims website for 2,015 plus 158.11 and court costs of £120 on the 18th April (being served on the 23rd April). On the 2nd of May they acknowledged the claim giving them a further 14 days from the 23th of April. We are now just a few days away from the 21st of May, and are getting very nervous. I will post again over the next few days and let you know what is going on (maybe ask some advise), if there is anything we should be doing please let us know.
