Just wondering if this has happened to anyone else Following my LBA letter Crap1 credited me with £40 & gave me the standard letter so I filed my moneyclaim on 1/6 & it was acknowledged on 5/6 (defending) it is for £140 plus £30 costs . On 6th June I had a letter stating they would credit me with a further £56 & rabbited on about the OFT report £12 charge fair, they disagree but...& all the usual crap1 jargon. I havent done anymore as they still owe me £114. Do I need to notify the court that the claim value has now reduced to £114 or should I just leave it? their 28 days will be up 3/7/06.
  6. Smiling like the wide mouthed frog. I'm promoting the site to friends as much as poss & lunchtimes at work have become a time lfor ogging on to the site. Did anyone see GMTV this morning, a representative of another site penaltycharges.co.uk was discussing bank charges & their success (30k returned between Feb06 to dat) Whilst I'm sure they are doing a great job too their site doesnt' compare to this site.
  7. Already done & have receipt ! Hope Halifax notice that Transaction! Tee hee.... Will be starting a moneyclaim with Capital One on 1st June, sadly only £140 but still better in my pocket than theirs!!
  8. mailto:bankfodder I completed the Money claim on 18/5 & it was acknowleged 23/5 stating they were defending. I received a letter from the Halifax on Saturday advising they are paying £1691 claim plus £355 interest & £120 court costs as it would cost too much to defend! I'm chuffed to bits & am donating now compliments of Halifax!! A very big thank you too all of you who have both set up the site, templates, offered support & advise along the way. Without which Halifax would still have MY money. Good luck to all those still persuing their money & don't give up. I only started 28/4/06!
  9. O 'eck! I contacted the court who said I could pay £35 to amend but not sure how this will affect the timescales & also after paying out £120 another £35 at mo is bit of a struggle. Hence call to Halifax lawyer who told me they would look at the full value of the claim & that it had been passed to Customer Relations. I received a letter last night from the court, stating they were defending which seems to follow their usual process!

Thanks Alan I called contact below at Halifax,(found on the site thanks to "Dave"- she has said it is with their customer relations-they told me 2 days ago it was with legal - anyway I explained to Rachel the claim is correct value wise but I'd omitted the statement referring to the interest. She said they went by the value & it was this they based their decision on. I'm hoping she's being honest-she is a lawyer-& was also very pleasant. I have to admit all the people I have spoken to at the Halifax have been pleasant, helpful & polite. So whilst I can fault them on their bank charges, the Halifax staff I have dealt with are doing a good job as far as customer service. I'm sure there's even a few of um rooting for us!   11. mailto: BankFodder[ [i filed my moneyclaim on line 18/5 & it was acknowledged yesterday but I missed details of interest as below - I have called the Halifax & asked if they will accept an amendment but they wont, so have to pay £35 to amend via moneyclaim online. Today is payday so I can now go ahead but am unsure of the wording as I have completed the excel spreadsheet provided to work out 8% interest which is on 2 accounts over various dates may 2000 todate. Please can someone advise & also does anyone know how this will affect my claim. I have included the value of interest (£366) in the claim just not the description The claimant claims interest under section 69 of the county court act 1984 at the rate of 8% a year from (date when the money became owed to you) to (the date you are issuing the claim) of £ (put the amount) and also interst at the same rate up to the date of judgment or earlier payment at a daily rate of (enter the daily rate of interest)
  12. I have just compiled a letter of complaint for my friend to MFI as it has taken them 6 months to complete her kitchen! Its taken 3 pages to list all the dates when MFI fitters turned up, didnt turn up, phone calls to chase MFI (they never called back) & MFI fitters excuses, eg blade too blunt. Tool bag stolen. Then on next visit the excuse for not fitting cornice was again blade too blunt, so it seems the toolbag thief noticed the blunt blade & left that behind! I printed off her last 2 phone bills to highlight the numerous calls she had made to the fitters & the store. When she went through them she found that days she had left the fitter in the house alone, he had been using her phone to call his brother (another MFI fitter!) If you're thinking of having MFI to fit your kitchen, think twice before paying up in full beforehand! Infact think twice about using MFI to fit your kitchen!!
  13. O blimmey, not the reply I wanted but still appreciated! Thank you! As the interest is £360 :o then it's worth it. As the interest is earned at different dates over 6 years, would I be best to alter the interest paragrah to say the "Amount of interest incurred at various dates, please refer to appendix 1" l'll then have to find out if I can attach on line or email/fax/post to court. Do you think this is acceptable? :?
  14. I called Halifax on 16th as the 14 days since I issued the LBA,where up. I explained I wanted to check which was the best address to use as was completing my moneyclaim form on-line. The girl I spoke to asked that I give them chance to take a look at my claim & call me back within an hour. They did & she up'd the original offer of £221 to £640. I asked for this in writing but said I would carry on with my claim £1691 - (plus interest £366 & court costs £120) I filed my claim lunchtime yesterday & it has been issued....o 'eck...what shall I wear to court! 24/4 Preliminary letter sent-recorded --£1691 claim 28/4 Verbal Offer of £221 rec'd 29/4 Written offer rec'd of £221 2/5 LBA sent declining offer - recorded 16/5 Verbal offer of £640 rec'd 17/5 Completed moneyclaim online 18/5 Status - Claim issued
  15. I filed my moneyclaim on line yesterday but think I've missed a bit off! Can anyone offer advice please. I pasted below into Particulars of claim I have a contract with the defendant bank which is conducted on their standard terms and conditions. I am claiming the return of money taken by the defendant in the way of charges over the last 6 years plus the interest they have levied on those charges. The bank's charges are a disproportionate penalty and therefore unenforceable as they are contrary to common law. Further, as a disproportionate penalty they are invalid under the Unfair (Contracts) Terms Act 1977 s.4 and under the Unfair Terms in Consumer Contracts Regulations 1999. Para.8 and sch.2(1)(e). In the event that the charges are not a penalty then they are unreasonable within the meaning of the Supply of Goods and Services Act 1982 s.15. I have asked the bank to justify their charges but they have declined to do so. After I completed it, paid my money a relised a pop up box had come up, details below. I have not included this message in my clain, although the £2177 claim inc court fee & 8% interest. Will it matter? do I need to do anything?   17. Can anyone tell me which address I should use for on the moneyclaim form for claimants address. ie Halifax's registered address (West Yorkshire) or the address I have been dealing with. (customer services, Leeds) Thank you

  20. I went into the information desk at my local branch. The woman there ordered them online whilst I was in there & said they would be 7-10 days. They arrived in about 5 days. All 30 plus envelopes!

  22. Thanks Lou:D I closed the 1 account with halifax Feb time (in shear temper) when they added £119 of charges for 3 failed DD. I went in to see the Branch Manager as I had transfered the money to cover them from another account with the Halifax same day. I'll translate what he said to me in one word as a lot of bank jargon & waffle was used..."Tough" ! The account I still have with them is within the overdraft limit, just, but as Ive now arranged for my salary to go into another bank & don't use it any longer I wouldn't be surprised if they ask me to pay it off. Any idea where I would stand if this came about. We'll know more than most of the bank staff by the time we get to court!!

I have already a claim underway with the halifax, LBA to be posted Tues & have just prepared a preliminary letter to Capital One also to be posted tues(recorded) I have read somewhere (& now can't find it again) that this action can or could affect your credit rating. I am just in the process of changing my mortgage & do not want to do anything to jepardise this. Can anyone tell me if/at what stage, taking action against a bank can have on you credit rating. I am expecting to have to go all the way with the Halifax. Any advice much appreciated. It won't stop me carrying on but I may delay until I've completed my mortgage.
