  1. they are my goods, i paid for them ? but i dont have reciepts to prove this, i do have the tennacy aggreement to prove it is me that pays the rent and not my wife, the doubt is in my wifes maiden name, and she does not work. it is my property they have entered and taken good from ? i am so upset by what has happened and affraid to go to work as i do not want them to turn up when i am not there to protect my family.

  4. Hi everyone. Yesterday morning at 6.45 am i woke up to what sounded like someone trying to break my door down, my wife and two small children wear all alsleep upstairs. i went down stairs and saw to large males standing at my door, they were balliffs from the magistrates courts. One man, who i have to say is the most nasty bully i think i have ever come accross in all my life advised me he was here to collect a outstanding court fine for my wife and he has the right to walk into my property now and take my goods if we do not pay him. i am in so so much debt as it is and i honestly do not have anyone i can borrow the money off. My wife lloks after my boys and does not work. I ask the balliff if he could give me time to pay which was quickly refussed. He walked passed me and said wake up your wife and kids now ! anyway to cut a long and very upsetting experiance short, he took my two tvs, computer and other small bits away with him, i called the police twice for help as he was in my property i pay the rent and the tennacy is in my name, as it was not my debt i tried to get him out that way however the police were not intrested at all, however when he swore in front of my two children and spoke to my wife in such a disgracfull mannor i fliped and told my wife to get the hammer ? dont know what i thought i was going to do but it scared him witless, he called the police and suddenly they were there in a few minuetes ??? i said to him, it is a fine i couldn't origannly afford to pay, so how can i pay it now when they have added almost double the price. he laughed at me and said not my problem. So i now have 6 days to pay if i want my stuff back which i can't pay. or they will auction my stuff (and may return) as the balliff said what he has taken will not cover the debt of £400. I was just wondering if anyone knows if i can pay the debt dierct to the courts as it is half the price without the fees they have added. and then ask for my belongings back as the debt is no longer outstanding ?? urgent help if possible. many thanks if you were kind enough to read my post.

Hi there i took out a personal loan with Welcome Finance, back in november 2007, my personal circumenstances have changed and i am now unable to afford the monthly payments, i have missed this months payment and already had someone come over my house with a letter saying i need to contact them about the missed payment. i have heard horror storyies about how they treat people who are in arrears. the payment is £214 per month, however i could now only realisticly pay them back £50 max a month untill my circumstances change. does anyone know what i should say or send to welcome, regarding my situation ? many thanks in advance.
  6. Ok i will be completly honest, i have been in alot of debt at present, I have just paid off my council tax arrears for 2006-2007, still paying off 2007-2008. Also i have had to pay for rent arrears that went to court. All of this has involved people knocking at my door chasing me. I am on a very low wage can just scrape by each month. I have ignored and ignored letters from british gas / electric for unpaid bills, i am not proud of this but i have just been burying myself in the sand, deep down knowing the letters are not going to stop coming. I Today recieved another letter for my gas bill. I am in no way able to pay the amount they are asking for firstly and secoundly the amount they are asking for is so hugh i do not think it can be 100% right. i only live in a small 2 bed property and from what i know other people pay on an average per month, this bill would suggest i am paying double over. Is there any letters i could send to first ask to pay the debt of monthly or be put on a pre paid meter, and also anything i could send to dispute the amount they are asking for ? Looks like it will be another year of fighting to get by each month ! Many Thanks in Advance.

Thank you fot that table, I have jut had a call from barclays missed it so they left a message on my voicemail - very brief 'We are unable to open you an account' thats it? i really dont know why i no my history is poor i have obtained my credit search and can see i have two ccj's and d/fs. but i can not seen anything else on there ??? all i want to do is cash my cheque - guess i am going to have to be stung for the 8% charge to do it - i feel like i am a criminal and i am not. my only sin is that i missed payments and then dug myself in a hole hoping the debt will go away ! then i woke up and just wish i could turn back time! i feel so down at the thought i cant even get a basic bank account !.

  9. hi vortex, i did do that, it shows ccj,s and defaults, my current loan that is upto date and that is it really ? i do know why old bank account would have been closed with an amount owing, could it be this ?

Yes i tried Natwast was very unusual as they gave it to me i even put cash into the account, then about twoo weeks later, i had a leter from them stating that after reviewing my account i would no longer be allowed the service, and that i had 10 days to withdraw my funds before the account was shut down ?? no reason was giving ? i then yesterday tried to open a basic with barclays and they told me it had to b passed to the review center ? with no explination at all ? so i am guessing i will not get that account either? like i say i only need some sort of an account to cash my cheque. a easy access savings account would do, but i do not if they will turn me down also ?

Hi i was hoping for some advice please, i took out a loan yesterday and was giving a cheque in my name, however i do not have a bank account and for some reason can not be acepted for a basic account, i know my credit history is awfull, but i am not bankrupt ?? i use my wifes bank account for wages, bills etc. so i am not that bothered to have a bank account, however i need to cash my cheque. does anyone know if i am able to open a savings account - without going through the sames checks that seemed to be used when i try and open a basic account ? Kind Regards

  13. Thanks for that just did it online - they said i will get a response in 7 days ? is that normal ? do you think as i did have a bank account and iit was closed with a negative balance, this is way i am not getting a basic ?
  14. Hi all, i did open a natwest basic account in dec 2007 and paid £300 pounds cash in to the new account on the same day it was opened ? i then waited two week for my card to arrive. When i letter from natwest did arrive, it basically stated that after carefull consderation they would no longer allow me the use of there account, and i had 10 ten days to withdraw my money before it was shut down. I do have CCJ's and Defaults and also my old bank account may have been closed with a negative balance. Trying to get my life back on track from my silly ways when i was younger. Anyway yesterday i took out some finance and was given a cheque in my name as it is a single application, however i canno't seem to open a basic bank account, barclays wouldn't allow them to do it on there system and they said it needed to be reviewed ? (which i can only assume means i will not get it) I only need the account so i can access the money on the cheque , as we use my wifes account for my wages and pay bills etc.. Does anyone know if i would be able to open just a easy access savings account, without all the credit checks being made ? Kind Regards
  15. Yeah i have as a last resort, but as the amount is £2500 i am sure i would get hit alot in there charges ? The lender will not write out in another name ? i know abbey do a savings account, with a cash card to access whenever ? as it is not a current account, and you are unable to have direct debits/ standing orders etc. why would they need to carry out a credit score ?

I tried to open a basic account myself yesterday with NatWest and was refused ? i know my credit rating is very poor, but i havn't done anything fraudulant EVER ????. all i wont to be able to do is cash my cheque ? does anyone know of any basic accounts i should try for or if i can just open a savings account that i can draw on ? so i can access my money ?? Also do savings accounts do credit scores ? Many thanks in advance - this site is the best site i have ever found !

  19. letter at its first stage. Dear (rosendales) I am writing in regards to the practice you company seem to be undertaking, on two occasions you have tried to charge me unlawful fees, which as a company your employed bailiffs must be aware cannot be applied without certain procedures taking place. On the first visit from your bailiff, I was asked to pay £130 in the fees, only when I questioned this to your bailiff were the actual fees that by law you can charge applied. I did pay for these via credit card and immediately sent out a payment plan to you with maximum I could afford to pay the debt off, without falling into further financial difficulties. However I can only assume the letter had no human involvement as the reply I received stated you are only willing to accept monthly payments that are more then double what I originally offered to settle the debt, to add to this the letter asked me to pay the 1st instalment on the 17th December, however I did not receive your letter until the 22nd December. I also stated in my letter, I am fully aware of my rights and fees that are legally allowed to be applied and when these fees can be applied. However the letter I have now received once again states without full payment your next action will be to send a van to my property to remove goods, and that fees will be added. As you have not gained entry into my property which your records will show and I have never signed a Walking Possession Order. I would like to ask how you can legally send a van to my property to remove goods you have not levied on. I believe this letter to be either a scare tactic used by your company, to try and obtain money out of people which they may not have, or a complete negligence on your company’s behalf. Either is not acceptable, the council has an obligation to ensure that the correct legal procedures are used when re-claiming tax arrears, clearly your company is not abiding by these laws. I am sending a copy of this letter, like all previous letters to the council and asking that the account is put back in there management. I am also filling an official complaint and sending a Form 4 to HMCS regarding this matter as I believe the actions used by your company could be overlooked by others who as a result pay unlawful fees that should in the first instance never have been applied or put people in further debt as they feel intimidated into finding money anyway they possible can to avoid the thought of vans turning up at there property and bailiffs walking into there homes, to remove there household goods. My wife who is at home with my two small sons has been diagnosed with OCD, and the letters you have sent have caused her real concern and worry that is amplified by her Obsessive Compulsive Disorder. I am writing this letter to advice that I will no longer deal with a company who does not abide by the law, especially as there is money involved in this matter. I will now be making my payments direct to the council. I have not refused to pay back the money that is owed but simply asked for time to pay the debt to ensure I do not fall behind with my rent payments etc. However as you are unable to agree to my offer I will ensure this debt is paid off directly. YOU WILL NEVER GAIN ACCESS INTO MY HOME as I am fully aware it is my legal right to refuse you entry. Also for the second time of asking please send an itemised statement of account that clearly shows what charges have been added and what for, you are required in statute to supply this information which you have as of yet failed to do.
  20. Is this form just to be used against the ballif or can it be used against the company as a whole ? (ie rosendales)
  21. well i was desperete for the loan, and they were really pushing the ppi so in the end i aggreed to take it out. but i dont really need it and the payments are higher then i was orginally hoping for. do you know if they reduce the payments as soon as i cancel or will it take a while ?
