Had the same over the last week. They all have American accents. Are very rude and patronising. And ignore Data Protection. They picked the wrong person out of the pile! lol

Expedia pre authorisation
hisholinessthepope replied to billyqureshi's topic in Holiday & Airline companies
You have had exactly the same issue as I had Billy - the flights! In my case I got "lucky" in that after half a dozen calls to the customer service people we got a decent chap who did all he could to assist. It helped that my wife spent ages on the phone to him and got chatting and built a good dialogue with him. Full details here; http://www.consumeractiongroup.co.uk/forum/holiday-companies/111195-expedia-have-swallowed-my.html For all that and the free holiday, I have never and will never ever use Expedia again. The more people realise how they operate and the risks involved the better. The problem for your bank is they have authorised that money and they can not then unauthorise it. If the bank could what's the point to anyone of them authorising in the first place? My beef is with Expedia who can get authorisation in an instant from the bank but then the Expedia systems have no means to unauthorise the money when it goes wrong. All that happens is they don't take the money and the auth codes expire after 3 days. Only suggestion I have for you and anyone is make a pain in the ass of yourself by telephone. Write down detailed notes on times of calls, length of call and who you spoke to - maybe mention that your writing to Caroline Cartellieri and considering BBC Watchdog or the Sunday Times Money matters. Then if all else fails write to the head women :- Caroline Cartellieri who is the CEO of expedia UK. The address is Expedia.com Limited 7 Soho Square London W1D 3QB Hope your able to enjoy your holiday -
un1boy - N1 issued for breach of CCA request

Well done uniboy, another battle won by the sounds of it. Lets hope you win the war soon. -
Anthuk, Write out what you want to say in court and then read from a prepared statement. In fact start it with ... this is my first time in court and I am rather nervous, if you don't mind sir / madam I have a prepared statement I would like to read to address the court. Then just tell them when you requested the Credit Agreement in accordance with the Consumer Credit Act. And also explain you have not received any paperwork from the Claimant. In the circumstances you do not believe that the case should continue. If you think a question might arise, write a reply and have these on another sheet ready to read. Anything your not expecting just be honest with the judge. If you don't understand ask the judge to explain or just say what does that mean please? Take a friend with you, if you can and ask them to write notes for you of what is said. I have only been into the judges chambers once and it was scary but be prepared and it will go much better.

Hmm just logged and am surprised at not finding recent threads on Npower overcharging ALL customers. Big article in the weekends Sunday Times, they are suppose to charge the first 4572 units in a year at a higher rate. However Npower have a billing flaw and are trying to defend it by saying it is 4572 units in a tariff year. However last year they charged tariffs twice, in April 07 and November 07, resulting in a 7 month tariff year! I have checked my bills and it shows an over charge of nearly £70. Letter typed and in the post requesting credit and compensation for my time. Lets see what happens. Ofgem have had over 400 complaints already and have triggered a formal investigation.

pt Sent you an email for a copy of the case. Thanks.

Quote: “In effect, the creditor--by failing to ensure that he obtained a document signed by the debtor which contained all the prescribed terms--must (in the light of the provisions in ss 65(1) and 127(3) of the 1974 Act) be taken to have made a voluntary disposition, or gift,of the loan moneys to the debtor. The creditor had chosen to part with the moneys in circumstances in which it was never entitled to have them repaid;” pt2537 Most interesting. Do you have the Sir Andrew Morrits Judgment in the Court of Appeal in the Wilson & FCT case? I would like to read it.

Hmm most interesting! There is only one reason they are offering £1,000 and have closed the account. They want you to go away. Only you can decide if this is tempting to you. The "rewards" could be much greater if you go after them but that is new ground and has risks and I would guess will take a long time. If you decide that the £1,000 now is for you - have they made the offer in writing? Is there a timetable for them to pay? Have you requested that any defaults and credit reference records are removed?

Now the first IF Visa I got with my IF current account and IF mortgage in 2002. However in 2005 IF wrote and advised that they were withdrawing the VISA account from the IF plan account (with the off-set interest) and offering a new Halifax Visa outside the IF plan. I duly transfered the balance to the Halifax Visa but I am unsure if I ever signed and returned the paperwork. Back in Feb07 I wrote to Intelligent Finance and requested a copy of the credit agreement for the VISA account. Now some 11 months and a dozen letters later they have sent me the credit agreement for the first account. Now the two accounts have different numbers. So I have written back thanks for the credit agreement, statements by creditors are binding (section 172 of Consumer Credit Act). I asked for credit agreement for Visa account ABC you have sent me the agreement for Visa account 123! I do not acknowledge any debt against Visa account ABC. I have not made any payments to the account since March 2007. Has anyone else had the same? There must be lots of people out there that also transfered their balances from IF Visa to a Halifax Visa with a new account number.

I now routinely track and trace all my recorded delivery letters, then claim for all those that are "lost / missing / etc." From my experience they can not account for around 1 in 4 of Recorded letters. When you submit a claim form they eventually tell you they can not find the letter or confirm delivery and sent you a book of 12 first class stamps in compensation. I have had around 20 so far. Maybe if all users of recorded delivery did this they might sort themselves out!

action007, Sorry to hear of your problem. Obviously expedia are no further forward than they were 5 months ago! I would detail all that has occured and write to Caroline Cartellieri who is the CEO of expedia UK. The address is Expedia.com Limited 7 Soho Square London W1D 3QB According to the customer service people she always replies to all letters. And in my case that was true, I got an email form her to say she had contacted customer services and told them to sort it out and to get back in touch with her if not happy.

Whoever is on the N1 form as claimant. In your defence request a copy of the credit agreement in accordance with clause 78 of the Consumer Credit Act. If the claimant is anyone but Next ask for proof of ownership of the debt as well. I have had many dealings with Next and they are a terrible bunch. But luckily for many (you as well I hope) their paperwork is rubbish. They seem to have conducted themselves with total disregard for the Consumer Credit Act (like almost all storecards) for many years. Time for another chicken to come home to roost, hopefully.

un1boy - N1 issued for breach of CCA request
hisholinessthepope replied to un1boy's topic in Historic Bank Claims
Uniboy, I went to court with NEXT and arrived for a hearing to learn that NEXT were by telephone. I was mad as hell that I had gone to the court and they "were off the hook" on the telephone. However I was at a huge advantage. You get to see the judges face and read their body language. If you mess up you see it on their faces and can stop talking! The guy on the telephone has none of this. If you can attend, I would advise you do! -
First Direct changes to overdraft service

As FD have stopped paying interest on the current account balance, I will be moth balling the account in the new year. FD will then, like Barclays, have a cuurent account with 1p in it! -
Am glad it all worked out for you ecobabe. But I have to echo Mike and say NEXT are truely a terrible company to deal with! In my experience.
