  1. Caza, To further expand on my comments above, you have attempted to settle out of court which was your prime objective. They obviously don't want to or don't have A&L's authority to do so. To avoid getting into protracted discussion with them, In my opinion, I would simply reject the offer and remind Wragge of the apology made via the BBC by A&L for quoting this case in this manner. Feel free to let A&L know what's happened and leave the rest to the courts. Hopefully you will end up with the same judge (Mr Dreamboat). NJC
  2. Hi Caza, I don't think there is a precedent set with the Berwick case. After all said and done, banks are still either losing or settling out of court. I wonder if A&L know that this has been quoted to you by Wragge. As stated in the BBC report, A&L have apologised for this kind of intimidation. So long as you are fully prepared for your court hearing, my gut feel is that you will be OK. If I were you, I think I would be inclined to remind Wragge of the apology made via the BBC by A&L for quoting this case in this manner. I would also copy A&L and possibly the BBC. NJC

  4. Thanks MimiJane, I knew it was almost £10 but couldn't remember the amount (£9.25). If Wragge / A&L take it as far as court hearing, maybe their approach would be different if they knew they are likely to be hit with the extra costs. This could sway an early settlement, maybe?? I know that others have been successful in claiming these costs, therefore precedent has already been set. NJC
  5. Hi Caza, I'm great thanks. Relieved my claim is now settled. I am watching your claim as promised and hoping you get a result soon. I would definitely chase this to keep the momentum going. WRT claiming more than 8%. I personally think circa 20% is pushing things a bit too far. I think 8% is a realistic figure, after all, it is still highter than you would get from a savings account. If your's does get to hearing, I would then consider filing for your additional expenses. Paper, ink, postage, time etc. I think some people have claimed almost £10 per hour. As you already know, this is certainly a time consuming exercise in preparation. NJC

    Hi Caza, I nearly did go to Bedford today. I spoke with the court this morning to see if they had received my letter confirming that I was withdrawing the claim. It was posted 1st class on Friday when I received the funds in the account but they still haven't received it. Whoever I spoke with said it wouldn't be a problem if I didn't attend and they noted my case. Although the court is only 25 minutes away, I got tied up with work this afternoon. I have put a reply on your thread. Interested to know if you were on your own or if there were other cases being heard as well. Speak to you soon. NJC
  9. Hi Caza, That was quick. Been wondering how things were going. I can't believe haggle, wraggle whoever they are couldn't be bothered to show but to send a letter instead . If I was the judge, I would have thrown A&L's defence out there and then. How many others cases were being heard? Were you on your own? Oh well, have a drink.     Hi Cookie Monster, Our letter was dated 21st June as well. Have you called the phone number on the top right of the letter. This appears to be the number for the infamous Inga Kirkman. She is actuallt quite leasant on the phone. I chased a couple of times last week as our court date is tomorrow, Monday 2nd July. The money eventuallt got credited in our account on Friday. Talk about leaving things to the 11th hour. Good luck, hope your is with you soon. NJC
  11. Hi Fran, Had a court date set for tomorrow, 2nd July. Out of the blue last week, received a letter from shAbbey saying they would settle in full. Origianl claim, 8% interest and court costs.     Hi Caza, I asked Abbey to confirm to me when the funds are in my account. It's me that's chasing updates and doing daily checks. They really don't seem too bothered. If I have to attend on Monday, it means I will have to take time off work, I know they have no intention of sending someone. How long does it take to credit me my money. They can take it quickly enough from my account when it suits them. Doh!!! Steam coming out my ears in frustration. NJC

    Well, I am still awaiting the funds from Abbey. Chased Abbey and spoke to the court for advise on what to do about the hearing on Monday. I guess if the funds aren't there by mid day Monday, I should attend the hearing. Not sure what would happen if I stop proceedings and then Abbey fail to pay up. NJC
