  1. Hi, I will try and make this simple. I purchased a van from a car dealer. I had a 3 month warranty with a third party warranty company the car dealer uses. The van broke down within 7 days. The car dealer told me to take it to my local garage and inform the warranty company. The garage found a problem with the head gasket. The garage said it would cost over £1000 to fix. The warranty company said it was'nt covered in their policy but offered to pay £435. I decided the van was a liability and asked the car dealer for a refund. A refund was given. However, before the garage would let me recover the van back to the car dealer, the garage billed me £179 for the work they had to carry out to ascertain the problem. I now want to claim this money back. But who do I claim it back from? The warranty company? or the car dealer? Both the warranty company and car dealer are not prepared to pay anything. So, I am wanting to pursue this through the small claims court. Who do I make the claim against? Thanks for any help
  2. I recieved a letter and an Order for Recovery of unpaid penalty charge. I have been given the option to file a statement to the court which I intend to do. After looking at the form (TE9) http://www.hmcourts-service.gov.uk/courtfinder/forms/te9_e.pdf it gives me four options. I believe the option that I did make a representation, but have had no response to my appeal, is true in my case. My question is, what can the court decide based on that fact? It's just seems their word against mine. They say I never made a representation, I say I did. Should I add anything to the statement?
  3. I recieved an invoice for about £100 for repairs on a van I borrowed from a garage. I borrowed the van whilst my van was being looked at. The invoice states Paint and materials; £49 Repair door and repaint as necessary; £40 I am just wondering if I am personally liable for any damage caused?
  4. The council have written back saying they had not recieved my letter of representation. However, they have asked me to forward the letter within 7 days. At this point the penalty charge has doubled. I am not sure if it will still be double, if they reject my letter.
  5. That's what I was thinking today. However, I would rather have my money back and look for a new van. I have a feeling this van will cause me more trouble in the future.

  7. Thanks for the advice. I will call the dealer and send a letter as you suggested. Hopefully the refund will be prompt as I need a working van to do my job.
  8. Hi, I bought a second hand van for £3000 and within 7 days it broke down. The head gasket has a crack in it and the garage I took it to, has said it will cost around £1500 to fix. The delaer I bought the van from gave me a 3 month warranty (He buys the warranty from a warranty company.) However, the warranty company says the problem I have with the van, is not covered and they will not pay for the van to be fixed. Would it be reasonable to assume I am entitled to my money back from the delaer? What are my options? Thanks for any advice.
  9. Thanks everyone for your advice. I have written back to the council basically saying I have yet to hear anything on my representation or appeal, hoping they will give me another chance to make a representation. Thanks Bigdeptor for the link.
  10. This is what I don't understand. I have already told them why I dispute the parking ticket so I am unsure why they would want me to repeat myself.

The parking ticket was issued on 12th June 2010 I sent a letter to contest the parking ticket, detailing my evidence (sent on 20th June 2010) I recieved a NTO on 19th July 2010 I then recieved a Charge Certificate on 27th August 2010 My original thread about my parking ticket is here; http://www.consumeractiongroup.co.uk/forum/showthread.php?263556
  12. I recently contested my parking ticket, and have just recieved a letter with the heading "Charge Certificate". Does this mean my appeal was unsuccessful? I had a letter saying something about representation whcih I did'nt understand as I had already written to them outlining why I thought the parking ticket should not have been issued, so I ignored it as I did'nt even understand it. Can someone tell me what I should do now? Thanks for any help.
  13. Hi, I am a bit confused. I wrote to the council to challenge the parking ticket. I wrote all my points down and some pictures. Now I have recieved the NTO which has a page on it with some tick boxes on one page and on the other side half is blank and at the bottom asks for name and address of individual, signiture and date My question is, what do I write in the space provided, the same points I wrote when I challenged the ticket? Thanks for any clarifications.
  14. I made 3 points in my letter. The first was the information you provided. The other points were the fact that there are no bay markings and the sign near to where I was parked, was obscured by a tree. My argument is that if there were bay markings it would have immediately brought to my attention that there are some kind of restrictions and I would have been more aware of the signs. Adding to the fact that the only sign nearby was obscured by a tree, it seems the signage was inadequate. I would have no problem paying a fine if there were bay markings on the road because I would have been well aware of the restrictions. I don't belive the signage was adequate.
  15. I just got a letter from the Parking Services and it basically says that the PCNs fully comply with current legislation. I have scanned the letter I recieved. Maybe someone can give me their opinon on whether I should stand my ground, or pay up. Thanks for any further advice.
