  4. Thanks! My action is on the grounds that:- I the claimant have a contract with the defendant HSBC dated 1995 and which is conducted on their standard terms and conditions. I am claiming the return of money taken by the defendant from two accounts in the way of charges over the last 6 years plus the interest they have levied on those charges under section 69 of the County Courts Act 1984 at the rate of 8% a year from 4/12/2000 to 12/05/2006 of £**** and also interest at the same rate up to the date of judgment or earlier payment. The bank's charges are a disproportionate penalty and therefore unenforceable as they are contrary to common law. Further, as a disproportionate penalty they are invalid under the Unfair (Contracts) Terms Act 1977 s.4 and under the Unfair Terms in Consumer Contracts Regulations 1999. Para.8 and sch.2(1)(e). In the event that the charges are not a penalty then they are unreasonable within the meaning of the Supply of Goods and Services Act 1982 s.15. I have repeatedly asked the bank to justify their charges but they have declined to do so. I had to delete a bit to get characters down! I'm not all that great with this law jargon, what do you think? Also how long do they make you wait before going to court or settling?
  5. I have started to fill out my claim on moneyclaim online. Probably a really stupid question, but, it asks if my claim involves the human rights act 1998??? Do I tick yes or no? Also, is it ok to post my 'particulars of claim' on here to check if i've worded it correctly or is it better to pm a mod with it?
  6. I have 2 accounts with HSBC I have just stumbled across this site tonight, read all the FAQ's and already printed out my letters to post first thing!! As I was checking all my statements online I found that in August 2004 I was charged 292 pounds and in September 2004 was charged 394 pounds I was obviously goin through a bad patch!! Talk about kicking you while your down though I will let you know how I get on Andrea x
