  1. Red Debt Collection Services (representing Lowell Portfolio 1 LTD) recently sent me a letter stating they will be presenting a bankruptcy petition against me. This is for an old credit card I had with Barclaycard years ago. I haven’t heard from them for nearly 6 years now, so thought the debt has been written o this company (who bought the debt in 2005) now want to take me to court. Also included with the letter is form 6.1 Statutory Demand (which I’m thinking is to scare me). They want me to offer a lump sum or enter into a monthly plan. I was thinking of sending them the CCA. Can I do this, considering they’re thinking of bankruptcy? Grateful for any advice………apparently, I have 14 days to reply! Thanks
  2. Battleaxe, many thanks for your advice, I'll look into this. Presumably, I will have to go direct to a county court rather than via money claim, if I want to take the hardship route?
  3. I have found a company that offers this service, with 100% refund. the only money they keep is the interest and the court fees they have to pay. Is this a wise thing to do? Or is anyone not allowed to give advice on a subject like this?
  4. Does anyone know the contact details of those solicitors that can help you claim back your charges from the banks? Since I sent off my LBA, I haven't been able to move on to the next stage due to fiancial difficulties. Also, would I still be able to make a claim in the county court, because my LBA expired in Oct?   5. I simply followed the advice of this site, but sending the DPA and the second letter after that. However, I was asking for statements since 2003 when the account opened.
  6. Hi all, Abbey has paid into my account the sum of £400 called miscellaneous refund fee. My prelim letter ended yesterday and I still haven't had the time to send off the LBA. What do I do now? subtract this £400 from my original claim, which was for just over £1600?? WHat are they plaing at, I noticed a few people have had these?
  7. I am in the process of buying a car but apparently the dealer said the car was a cat C in 2003 please can someone explain to me please what this means and if it's safe to buy? The car is a T reg polo. Grateful for any help or advise. Thanks
  8. Yes, but for people like me who have bad credit, you get a basic account automatically. So it would help a great deal if we have some kind of a survey to show how many people have had their accounts closed/open, just for reassurance. However, I know this is the risk you take when claiming your charges back.

  10. I've got a copy of the spreadsheet and in there it calculates the interest at 8% APR per overdraft charge. I'm getting really confused now.

In the step by step instructions it states that the interest should not be included in the schedule list when sending out the prelim letter, but the interest is included in the prelim letter (see below). Do I simply delete this? I think I saw this in a previous post, but just want to be sure. What I require I calculate that you have taken £XXXX plus £XXXX which you have charged me in overdraft interest for the sum which you have taken. Total £XXXX. I enclose a schedule of the charges which I am claiming with this letter. Thanks

  16. I have been lurking around here for a few months reading a lot of posts and all the information available. Two weeks ago, I plucked up the courage and send off my DPA letter (11/07/06). A few days later, I received their standard fob off letter and 1 year's supply of statements. On the 20th of July, I sent the microfiche letter and surprisingly, I recieved all of my statements this saturday. So really it took me within a month to receive all the information that I had requested...... I must be one of the lucky few, right?? Now, I know what to do next, but I'm really nervous to proceed to the next level. My question is, does your account definately gets closed if you ask for your money back? Is there anyone here who has asked for their money and got it back without Abbey closing their account? I have already opened a parachute account as suggested in the FAQ, but I am only allowed a standard bank card without a check book, visa card etc because of some bad credit problems in the past. I really do not want to live without a visa card to pay bills. Any advice anyone?? I am even prepared to just settle at the 50% offer stage. Also, I have my mortgage with abbey, do you think this would be in my favour for leaving my account open? Or should I just forget about it? I calculated that they owe me roughly about £2000.   17. Please can you advice me. I renewed my car insurance with the same company this month and unfortunately the direct debit came out a week before pay day (21st June). I called the company to have it changed to the 1st of each month. My monthly direct debit is £40.07. The 21st of June £40.07 came out of my account and the next payment will be on the 1st of July for £40.07. My question is should this payment be lower or the same, bearing in mind I paid £40.07 on the 21st of June? If this was carried over to the 1st of August I would expect to pay a bit more than I usually do. Any advice please, I’m expecting the supervisor to call me soon.
