  1. on the phone the agreed to a review, but I haven't heard anything and as they only ask the questions they know to ask I need to talk to the person handling this. I really hope they logged my call, I did ask for some kind of receipt for my report but they refused. I am going to ring them next week and try and get a name, I have lots of info to send off to the person handling the review, such as company accounts If I get nowhere I will put in a complaint and I will need to request all my information is this under the freedom of information act or something else for the CSA? thanks
  2. sending an SAR as I can longer access my old email account and have no proof I sent preliminary and LBA to Sky, Sky account still in dispute. glad to see this thread is still active:D
  3. thanks will keep an eye on that statutory demand received from Red/Lowell as this debt has been sold to them, cca sent they are asking original creditor for credit agreement, would have thought they should have it if in fact it exists. obviously not acknowledging a SD sent by 2nd class post and not worried about being made bankrupt

I got a letter acknowledging my cca request straight away, where did you send yours?, funny thing is they haven't got it although they are supposed to own the debt now and are requesting it from the original company. Now if I was in the market to buy debt I would expect the CCA with the paperwork, simple really.
  5. I have thought the same as well, there is likely to be a backlash from the courts if they continue sending out sd's like confetti. Personally I am ignoring mine as I have nothing to lose with bankruptcy having no assets and being a single parent. I have requested a credit agreement though.

I have a student overdraft of £2400 which I can't pay off, credit agreement wouldn't apply hardly any of my creditors have supplied credit agreements, but they keep passing them on to other companies and I'm sick and tired of it all, really fed up with all the letters, I think the statutory demand would do me a favour, they wouldn't get a penny if it goes to bankruptcy, I just want it all to go away and have a fresh start. I don't want to fight the demand or even acknowledge it, I am sending a cca on monday but the 12 days will not be up before it runs out anyway. I have quite a few defaults on my credit file now and they will be there for another 5 years, I can't really see a reason not to go bankrupt, apart from the job I wanted to do as a conveyancer, I might have to change career plans now.
  8. is there a specific facts thread on bankruptcy on here FAQ etc I need to know what personal possessions can be taken from the home and as I am home schooling my daughter whether they will take my car (L reg jeep) as I use this to take her to tutors. I also need to keep a computer for lessons too. I am only on child support csa/child benefit/child tax credits,housing benefit so assume this income will be classed as benefit for my daughter, I have no other income/assets so am considering bankruptcy, for about £7,000 unsecured debt.including 1,500 thames water.   10. glad you got this sorted:) btw I got one of these stat demands for £2,100 sent on the 22/02 by 2nd class post, when is my 18 days up? I will be sending them a cca on monday (have asked before (for this debt)for cca for another debt collection company rockwell but it wasn't supplied and was sent back to creditor), but not sure whether to get it set aside as bankruptcy is appealing as I have no assets/job/single parent. I do wonder why they go straight for bankruptcy and ignore CCJ.

Is there any chance of a new thread (or first post Update) about these issues now, as this is so long, maybe starting with the advice about rights http://www.devon-cornwall.police.uk/v3/pdfstore/CJU_D222.pdf what the new act allows, what to do, maybe some bullet points. sorry but it has got so long I have lost the context a bit.
  12. Is there a csa section on here? I need to get my csa amount reviewed, I am the parent with care, I need to force the issue as I know the csa often try to brush you off if they are receiving money from the absent parent they have not told me on what business they are getting money off my ex, it might well be he has only declared his massage business, so it is hard to know if I have new information or not he runs a shop, which I have the company accounts for, works as a physio and one other business I read somewhere on here that someone managed to force the issue through and the courts got access to their accounts he is a self employed businessman and my kid is his only child I really need some more money to send my daughter to an independent school as she is being home educated because of bullying and I cannot get her in a school around here at all

Well done, I would hope they are training all of Essex Police in Bailiff law, I have seen training guides for police officers in other areas on the internet so no reason Essex Police should not be upto date I'm in Essex too and thank you for progressing this, it must have been very stressful with your fraility at the moment x
  14. Glad you won I had a look at the brighthouse website when they first launched, noticed the bad quality of their products noticed that they were overpriced and kept away.
  15. I have had car insurance with first quote and noticed that even though I paid for Breakdown insurance it was not set up (processed) properly until I actually needed a call out. This happened over about 3 years, now I keep my car insurance with them and get my breakdown cover with the RAC. I have paid extra for legal cover on my car but can't remember ever getting any proof of this. I do wonder if they calculate that a certain percentage of people will not have a breakdown call out ro need legal cover and so save money by not setting them up until they need them, although this is pure speculation on my part.

As they are aware of the fact you are becoming more knowledgeable of your rights they may want this loan paid off because they know they have no credit agreement. Remember that before court any offer received will not include interest but once a claim has started any settlement should with negotiation include the interest.
  19. I'm surprised someone hasn't given you more advice, I haven't been on here lately. If you want to claim for charges that are unlawful you have to raise a point of law, are you sure extra care payments come under unlawful penalties, I think this is unlikely. You cannot go to court saying this and that is unfair and not have the facts to state why. Don't rush into this as you will just have your claim thrown out
