Thanks for that input Lateralus and I do take on board your points........if the Mods do feel that particular post is inappropriate for this forum and may lead to ramifications then I am more than comfortable with it being deleted....... the last thing I would want is to cause this site any problems, give how helpful it is. I am comfortable with the words used in my email to my local paper........ jsut thought maybe if others in this situation did the same, it was one very quick way of spreading the message to the judicary........ My aim was that whilst each individual court will be aware of the mounting caes of this nature, they might not be aware that other judges responses and this was one way of making them so they could now taking affirmative action with this Yesterday my copy of their defence arrived and i will scan it in and post it also the very kind District Judge Murdoch at Northampton Odered that: The filling of an allocation questionaire be dispensed with in this case unless the District Judge at the court of transfer orders otherwise:) here's hoping he/she share this view also, am going to phone the court in the morning to see if they have a rough idea of a court date......... Did email DG last week and phoned them............. no repsonse to either.......... Did send as suggested copies ot the bank about the progress since writing to them in January. so keeping everything crossed that DG actually contact me asap with a full offer ( yeha i know unlikely at this stage) ........ good luck to all............. will post this defence as soon as i can scan it in...........auburn:) :)

sorry oyu have totally lost me..... I did not call anyone a liar nor did I imply it.............. why would I use those or similar derogatory terms? no need for it..... basically at the end of the day, we made errors by going into the red..............the banks how ever over charged and made profit....... what do oyu mean by watch this get edited?

Oh just another thought has anyone posted a copy of the defence subbmited by a bank?

Thanks all for your help, Lateralus on Tuesday I sent them an email copied from this site, the I know you are very busy with claims, kind of thing. I also gave them a dead line of the 15th of this month in it to seetle otherwise do not bother making an offer "we will see you infront of the judge". So far no acknowledgement, I did however send a refusal as soon as that offer came in, HSBC have not acknowledged that letter so far, we also sent one 14 days later giving them a date when court action would be subbmiteed, they also have not responded to this either but that is a good suggestion and I will do so today........ What I have also done is email the local paper drawing attention to the fact the banks are using the judicial system for prevaricating............and have drawn reference to the article by the Judge in Bristol.....My hope is that some of the judges might just read it, not be aware of that and it might just make them look at the actions in their courts a little differently....... Well it cant od any harm can it? Tried phoning Northampton County Court yesterday afternoon but alas from 3.45 till 5pm continually engaged( think thye have had enopugh by that time of day). Have just phoned them whilst typing htis:) :) it has been transfered to my local court yesterday, and we are being sent a copy of their defence. I asked the very nice lady who I spoke ot " oh so I shoudl have it tomorrow or Monday at the latest then", that might be a bit quick but certainly next week.... Oh Oh Oh (its like getting near xmas).........So the next step is they court will either send the AQ thingy or jsut issue the court date yes?....... Arghhhhhhhhhhhhhhhhhhhhhh I think I have made a huge error, was jsut checking the POC and have noticed right at the very end I have entered THE CLAIMANT ASK THE COURT TO ENTER A JUDGEMENT IN THEIR FAVOUR FOR £3999.83 PLUS INTEREST TOTALING £818.33........ hAVE JSUT REALISED THAT THE 3999.83 WAS THE TOTAL INCLUDING INTEREST !!!!!!!!!11 DO i NOW HAVE TO CHANGE THE PARTICULARS OF THE CLAIM? AND HWO DO i DO THIS...........

hi phugh, this might help if it is DG then it may well be kate eaves who is dealing with it, she is dealing with mine. here email is kateeaves@hsbc.com..... you could send any future mail via this as well as snail mail...........from Northampton court today they are running a min of 6 days behind........... due to the volume of claims.....

Hi all, I am new on this site, and gotmy initial info from mse...... used their template and charge calculator, wrote to the bank , got a response ot the first letter...usual response, we are not admiting liability or anything but offer you xxxxxx which was !,500 short of the amount clained... then filed via money claim. Just having found htis site I think perhaps I have made ahuge error, we did nto include the list of charges......... Having read this site for th epast 3 days solid, if I hand a letter into the court in the morning asking for this to be added ot my poc will that be ok? midnight tonight was the end of the 28 days but they subbmited a defence on tuesday........... so is being transfered to my local court... any and all advice would be grately appreciated............ thanks auburn:confused:

Yes it does make a difference,mine was served on the 3rd April and the 28 days is up today, but as it is a sunday they get carried forward to the monday. as monday is a bank holiday they were being given till tuesday at midnight............ but submitted thier defence on tuesday.......am still waiting ot see it!!!!... hope this helps those who have not quite reached this stage.............. Auburn...... :) :)

They waited till 6 days before the end of the 28 days..... gutted was so looking forward to pressing that little start button.......... noticed it was missing so phoned court to be told ....Defence submitted. so if oyu check like me andnotice it gone.. you now know why......not sure how long it will take for the court papers to arrive.....dont knwo if this is any help to you but ont he 28th April a judge awarded costs because the bank had waisted the courts time.................the same judge commented that the defendant acted unreasonably in defending the claim without any intention of allowing the matter to trial............ some ppl have advised giving DG a nudge letter , I have today and enclosed both those articles. nto sure it will make much difference but it might.............. that mightbe of help to you . good luck auburn
