  1. Sorry I have not posted for a while, Ive been quite busy and unable to have moment to get online. I have had the full amount back (including charges and court fee which followed a few days later.) Again thankyou to all who helped and the best of luck to those with claims still outstanding. P.S what happens next? do I inform the court? I have not recieved a letter from Nwide yet confirming they have paid up. I have recieved Notice of Transfer of Proceedings, but nothing from the court it has been transfered to.
  2. Congratulations, I believe you will see the interest and court fees within a few days (if not tommorrow) I too have been paid and it is taking me for ever to type (mr smith and mr foster again Im afaraid)
  3. Hold on this may take a while. (Ive been drinking with mr john smith and mr foster again!) Today a total of £3707.00 was credited to my account. A massive thankyou to all who have posted so far and good luck to all those who are yet to be paid out. I will be sticking around and will complete all the 'admin' on saturday. In the meantime please would a mod update and move my thread accordingly.

  5. Still no money for me, after reading other posts that have been paid I suspect another tranche of people will get paid Monday. If you look back to the past they seem to pay a lot at the beggining and end of the week.
  6. There are several threads advising you allow them a further 7 days before entering a judgement.

I am mindful that the vast majority of claims with which you are currently dealing and in order to more speedily resolve this matter, I am willing to accept the sum of £XXXX. I hope to hear from you very soon so that a reasonable conclusion to this claim might be achieved. I am sure that the courts would approve of our settling this matter in a timely manner and without their further intervention.

OK so if they dont acknowledge by 15th June (which is very rare!) send them a letter giving them another 7 days to acknowledge (unfortunately NWIDE can have the action stayed if you hit the judgement button and it delays the process for even longer!) There are templates somewhere, have a look at MTM posts!
  11. Ok here is a draft of my email, any thoughts anyone? Dear Sir/Madam I refer to my current claim currently awaiting court allocation after you submitted a defence on the 6th June 2007 (two days after the 28 day deadline imposed by the court.) My claim is for £4430.94 plus court costs of £120.00. Total £4550.94. Currently if you do not pay this and I file the Court Allocation Questionnaire with the £100 fee, it will cost you a further £100. It is well documented that your organization pays up before the court hearing stage, however any further delay may be seen as a waste of the courts time and you could face a wasted costs order.
  12. can you start again, im finding it hard to follow. When was the claim deemed served? did they acknowledge? (if they did they have 28 days from the deemed served date). It is not advisable to hit the judgement button straight away but give them a further 7 days
  13. its 50/50 init! Im mindful its a friday and that this will just keep dragging on and on. To be honest I like the idea of it costing them another £100, their behaviour is so appaling that it humours me. Ill start drafting the email, but im still in two minds.
  14. Legal team were not very interested. Im wondering now whether to send an email out to c bacon and eversheds advising them of the mounting cost to nationwide. Anyone any ideas?
  15. Spoke to customer expierience team, it would appear that its up to the legal department, anyone got a good number. Im using the argument that if they settle now it will save them at least another £100.

  17. I would say it is unwise to go off the beaten track so to speak, the last thing you need is to have the claim struck out!
  18. Day 32. Post has just been - nothing from nationwide or mcol. Checked my account - nothing. Come on nationwide wheres my money! Girlybiker. Im in two minds about whether to give the customer expierience team a call or not. I read in one thread about how it worked for them, however the defence that time was that they had settled. What do ya think?

  20. You can complain to the ombudsman and they may award compensation, Im sure Ive seen some threads about it on here somewhere
