  1. sorry to be thick, but can you help with particulars of claim as well, I have copied this - 1. Between [insert date of first charge eg 15/3/04] and [insert date of last charge eg 9/2/06] the Defendant debited numerous charges from the Claimant’s [This means you because you are the person claiming the money] account. 2. The charges are an unfair penalty under the Unfair Terms in Consumer Contracts Regulations 1999, because they are a disproportionately high sum in compensation compared to the cost of the purported breach. 3. Under the law of penalties, the charges are an unlawful ‘extravagant’ penalty. 4. Under the County Courts Act, the claimant is entitled to interest of 8% per annum from the date they were deprived of the money. This totals [insert amount of interest as calculated with the bank charges calculator], accruing at the daily rate of 0.021% until judgment or payment. 5. The Claimant asks the court to enter judgment in their favour for [insert total charges] plus interest, totaling [insert total charges plus interest]. is the interest figure at 0.021% the figure the spread sheet worked out? as per my original letters to YB? already getting a headache, lol

Hi, I am about to start the mcol claim on line, but not sure what address to put for Yorkshire Bank, my letters have come from Wade lane Leeds, but H/Office on bottom of letters is Glasgow, which do I use? I'm struggling a bit, well alot really, just want to make sure I'm doing everything right, any help greatfully received many thanks helen
  4. hi, I am a bit confused, well alot really. I Have had a mortgage with Northern Rock for about 15yrs and changed it 3 times (still with Northern Rock) I was charged a fee each time I changed product i.e last one was fixed for 3 years when that ended we had to stay as we were for another year or be charged, we did change to another fixed rate deal within that time so were charged the penalty fee. I sent the template letter to them asking for a refund and received a reply saying that fees charged for changing a policy over were not being discussed by the Financial Ombudsman and therefore I have no claim, is this right, or is there anything else I can send many thanks Helen
  5. cheers, I've done the spread sheet, and printed out a template letter saying as per previous letter will start court action if no reply within 7 days. So hopefully all systems go now!!!! although when i used the calculator the total was actually higher than the 2 other letters I sent, I re worded new letter saying I had made an initial error with calculations, do you think that will be ok? YB seem to be the hardest to get money back from. I feel a bit out of my depth but i'll keep going, I'm a woman after all and its my job, lol thanks Helen
  6. cheers for reply, but as luck would have it Local Branch rang this morning to say they still had my statements and did I want to pick them up, yipee there is a god after all, ha ha. But my next question is - I sent 14 day notice letter of court action and that was up yesterday, today I got a letter from the claims dept saying they needed further info re charges (which I can now do as I have the original statements) what letter do I send back with this and how long do I give them to reply? thanks again Helen

HI, After making a mistake (monumental) and sending my actual statements back to the bank with interest charges written against each one, didn't fill in the spread sheet, yes I know i'm stupid!!! I have had the usual fobbing off letter, then I sent next letter and copy of original letter requesting x amount (including interest) threatening court action after 14 days, (I reworded the letter explaining I had returned statements but would re request b4 court date) I have had no reply from the bank and their 14 days are up, I have re sent S.A.R - (Subject Access Request) and £10, can I go to the next step and start an online court claim while I wait for new statements to produce said spread sheet??? or do I start from scratch once statements arrive? please help many thanks Helen

  10. Thanks for replying, yes I know I was really dense!!!! I sent back the original statements and when i was using the interest calculator didn't realise it continued to a report!!! when you say S.A.R. do you mean the original template letter requesting info within 40 days, or is there a way of getting them quicker as its the 2nd time? thanks again Helen

I sent letter No.1 and £10 for bank statements etc, received 6yrs of actual statements(Huge pile) went through these highlighting charges, then used interest calculator and added these against each charge, I then handed these statements and letter 2 into Bank Manager (I some-how completely missed the online calculations form) I had usual fobbing off letter and then sent letter 3 about taking them to court (I altered the standard letter slightly saying I had returned statments previously and would request these again once a court date was given) do you think I have messed up big time or should my claim still stand? should I send another £10 asking for them again in the meantime? please help xx Helen
