  4. Welcome did this with me .. I defaulted several years ago and they went to court, got a CCJ and then had my wages arrested - next thing I know I get a statement for a new "loan" to which they have applied the arrested payments this shows as a loan on my credit file. So far they have refused even to speak to me regarding this.
  5. Actually - they live in a scruffy office block above a bank next to a multi-story car park in the middle of Kilmarnock. Kilmarnock is as upmarket as say - Basra
  6. Save the postage and the hassle. E-mail these guys at MERITFORCE and tell them exactly how the situation stands. Point out they have no enforceable CCA and that the alleged debt will be statute barred. They will soon get the picture. FV michael.kirkpatrick@meritforce.co.uk bryan.gillies@meritforce.co.uk
  7. Wescot's dubious telephone tactics getting a bashing here > 08453010229 - who calls me?
  8. You'll actually find it is very cleverly worded to deceive you into thinking it's a home visit. It actually will say .... P Brown will be calling your home. Your eye will read it as P Brown will be calling at your home.
  9. I just dialled it for fun, they must be busy - on hold for 10 minutes!! Yes it's Lowell.
  10. Nice one - well done, this is what everyone should do. This is a mega lowlife tactic - not only harasses the alleged debtor but also the poor neighbour.
  11. Hi Hellonearth. I work in frontline NHS - although not in anyway to do with pregnancy/obstetrics. I have to defend all my colleagues who - like myself - do our utmost to care for our patients regardless of any politics, money issues etc. Your comments re money rather than care might well be true of our political fathers but from the point of view of the folks that day in and day out do our jobs as well as we can - I have to say your comments are disparaging - sometimes it seems that we just can't win. I accept there might be folks in our job that sometimes appear to be a bit "passive" - that's what the job does. But I guarantee that everyone in the job gives the best they can and still has a cry every now and again over the less successful outcomes that are inevitable in our line of work. Having said that - I hope that little Hellonearth works out ok for you, and I'm sure in a few weeks time you'll be able to put your concerns behind you. Hopefully you will have time to say "thanks" to the staff that help you deliver your little one. (P.S. It's normally a Sonographer that does the late scan - not a Midwife). Best wishes FV
  12. There is a spate of this going on at present according to various debt forums. DCA's are allegedly using databases like 192.com to search for and then telephone neighbours of "clients" to ask them to stick a note through the debtors door to tell them to contact the DCA. In my personal experience a sub-prime car finance company were guilty of this tactic - which goes against OFT guidelines. Their agents telephoned a neighbour of mine who in turn gave them my father-in-law's phone number and then they phoned him and told them they were a finance company pursuing me. I've since had a written apology from them, but this is an often used tactic. The point is the neighbours are often elderly persons who get intimidated by these types of telephone calls - especially if the DCA puts an amount of "pressure" on them to answer their questions and to contact the debtor. I personally think this tactic is a major breach of privacy laws and would like to see a campaign on here to stop this tactic from happening. I'm not condoning people in debt avoiding their creditors - I am condEMING the low-life tactics that these - so called - professionals are using.
  13. Is it just me? Or is there a hint of irony in the above!! Well done Mariana - and well done NatwestStaffMember - for being a good sport!!
  14. Pieter, If it's any help (I have already won against HALIFAX - who were a pushover compared to Natwest). You have already started the ball rolling and have had correspondence from Natwest acknowledging - and refusing - you refund request. If you know the amount you are owed then go straight to the Letter Before Action - then after 14 days do the claim at Court (or MCOL). Keep posting - go get 'em.
  15. The Panorama prg tonight highlighted the stories of RBS/NatWest customers who were offered £30k plus in credit card limits - despite their apparent lack of means to pay it back. They then defaulted (some commited suicide). Some of those £30k debts were then "written off". Meanwhile those of us deemed to be unfit for £30k of credit are penalised by unlawful penalties - because we went over limit by £1 - to subsidise the Bank's erronious decision making. Any thoughts?
  16. I can assure you that they can't change your rights. I've just reminded them that the £38 charge due from my account today was unlawful and that it would put me into O/D. Guess what? No charge. Keep at them.
  17. Hi there - stick to your timetable to give them the opportunity to refund. After the 14 days go straight to court (or Moneyclaim). Just follow the plan and be patient. I know it's difficult to hold back but you will reap the benefit of sticking to the plan. FV
  18. This is interesting - NWB are starting to behave the same way as HBOS - money into account before the letter arrives - as a little teaser. They know they won't win and they are trying to entice the vulnerable into accepting less than they are owed. Stick to the plan, keep sending the letters, you have got them on "the back foot" and they will eventually pay out.
  19. Not every SOLO transaction is authorised in the way that you think. Some retailers - particularly mobile phone companies and "Pay at Pump" petrol stations - pre-authorise to a set amount i.e. £60 at the pumps. The retailer takes the risk on the transaction and you can still become overdrawn. As long as the card is not flagged as "blocked" and has £1 on - then it will authorise up to the retailers limit. Try paying for petrol at the pump with only £1 in your Electron or Solo at TESCO - you will be able to draw £60 of fuel, your card will debit 2 days later and you will be O/D unless you replaced the funds. I'ts a very dubious situation regarding the charges and proves that even SOLO and ELECTRON are not infallible.
  20. Finally received Statements today (2 weeks). Bloomin' eck! I thought it would be about £300 - the greedy so and so's have had £985 from me since 2003. I must pay more attention to my accounts from now on! Prelim sent today.
  21. I agree, don't accept any offers unless it's the full amount. Ignore all the stuff they send offering Complaints Procedures and Financial Ombudsman, they are just stalling the inevitable. Trust those of us that have won so far - you will get your money, and when you do it feels soooo good! Just stick to your planned timetable and with a little patience the pennies will magically reappear in your account before long. Good Luck
  22. Just follow the plan and stop worrying. The Court will keep you updated (if it ever gets that far!). Now go and do it! It's YOUR money, go get it back!
  23. Just close the account. The charges are unlawful (as you already know) and therefore they cannot pursue you for them.
  24. Money in account this afternoon. Donation to CAG now made with Electron Card. Thanks guys, keep it up.
