well I also have lost my photocard licence during a house move. Here is my question if this is found by another and returned to the dvla do they contact you to let you know that some kind sole has returned it or do they just wait for you to realise it has been lost and take your money from you?

I received full amount of my claim in to my closed account yesterday,(1271.76 - 318 overdraft=£1589.76) one day before the return date of my summary cause. I went into the bank today to tell them I would like to withdraw the full amount and after a few telephone calls I was told that I wouldn't be seeing any of the money!! I was in a bit of shock but it turns out that the loan and credit card I had few years back and which are part of a protected trust deed, is stopping me from receiving my cash. They told me the only way I would get any money from them is if I show a council tax or rent letter saying I am in arrears and need the money:? . I now feel as if the BOS is now bending me over a barrel big time. Surely this is not allowed as ultimately the bank have arrested my money and will not give it to me! I have not contacted the court yet to state that I have received the money. I was thinking would it be possible to have the case ruled in my favour and then get the sherriff officers to collect my money from the bank? any advice would be most grateful I have went from cloud nine today to back down in the dumps!!!

I've got a feeling that they will do the excact thing to me also. When you call the court to see if they are defending/responding to the claim do you have to attend court yourself on the calling date even if they have not responded? This is the one thing that I'm not sure about?

Thanks!! - Just another quicky what if a defence is entered by BOS do I have to attend court on the calling date, & What if my account is closed will they hopefully still settle:idea:

Hi all, need some advice regarding the summary cause procedure! I have received my summons back from the court and i now need to have them served by sheriff officers. the return date is 27th june with the calling date on the 4th july. Am I right in saying that the BOS has until this date to enter a defence? What if they do? Do I have to attend court on that date to state my case or is it all done by mail? I've been looking through all the threads and I've not yet found one who has actually been required to go to court. Please help this all seemed so easy until now??!! Thanxs:confused:

Hey Guys need some advice, I am currently preparing court papers for a summary cause against HBOS. If anyone has got this far then on the summary cause it ask you to put down the defendants name and address. Would this be the branch manager and local branch or just the name of the bank and their HQ, The Mound etc??? :???:

I've been looking through the different forums and I'm very impressed with all the helpfull folk who are out there. Wish I had found this site 3 months ago when I started this process but the information I have just found will stand me in good stead I hope. I'm preparing my court papers as we speak. HBOS have sent me the standard letter stating that they are looking into my complaint so they have ignored all my deadlines. I feel a bit frightened about going to court so I hope it is all resolved before the given date.!!!
