  1. Had to take Zurich to financial ombudsman for a cash settlement to redo shoddy work done by their contractors after a underground water leak. They paid up eventually but ombudsman also said they should pay 500 compensation which they agreed to. They have not paid compensation. Started small claims proceedings got a default judgement because they had not replied. How long after default can I request warrant? thanks
  2. Hi Hope someone can advice. Underground pipe leak led to damage. Used insurers contractors. Solid wood flooring started to fail within a few weeks. Complained to ombudsman found in my favour eventually. Am going for cash settlement as I would not allow insurers contractors back in my house. Advice on form sent by ombudsman please attached. Ombudsman decision only mentions one room when infact 4 rooms need flooring replaced. I don't believe that Zurich will accept ombudsman decision and I don't want to jeopardise future court proceedings by signing this. Thanks
  3. This is an unusual question .Very briefly am in dispute with home insurers following a water leak. Replacement flooring has failed and they say it is because I have no damp proof membrane. Am I entitled to request copy of reports from surveyor and drying company? from my insurers using GDPR and SAR request? Thanks
  4. Hi all, need some advice. February 2013 wheel bearings went on Honda fireblade chewing up wheel rim. Cost nearly £1000 to repair. August 2013 wheel bearings went again to their credit garage replaced FOC after Honda refused warranty claim (more than six months) September 2013 thought wheel bearings had gone again even worse told need another new wheel. Of course Honda refused warranty claim because of six month rule. Have written to garage using Sale of Goods Act giving them 7 days to repair/replace. However garage keep saying they are fighting my case with Honda even though I pointed out my contract was with them. Any advice or is court action my only option? thanks
  5. Hi hope someone can give advice. Basically daughter and partner had a six month shorthold tenancy agreement managed through a letting agent. Six weeks ago found out that landlord had not been paying mortgage contacted building society and he does not have a buy to let mortgage. Mortgage company say "we would advise you that your occupation constitutes a breach of the mortgage, which prohibits letting and leasing without our prior written consent.... we do not recognise your right to occupy the property." Letting agent has said that landlord is overseas and cannot be contacted agent has also said his family have not heard from him since before christmas. Tenancy has now run out. Agent verbally told us to stay as long as we need to find another home she also said that under the circumstances she did not expect rent to be paid. Now she is demanding rent to be paid. How do they stand legally? it looks as if they have no legal right to a tenancy as it is in breach of the mortgage. Can rent be demanded under these circumstances. Letting agent is unhelpful and evasive and does not belong to any professional body. Any advice welcome
  6. Hi Can any one advise. Got a A140 53 plate 50,000 miles. Regularly serviced by local independent garage. Up to now been happy with garage. Car started to have intermittant starting problems. Made noise similar to noise that if engine has already started and you try and start it again (hope that makes sense.) progressed to shrill noise. Spoke at length to garage and they said probably starter motor but the fly wheel may have been damaged. Garage replaced starter motor. £580.00 later the noise returned after 3 days. Don't know whether to believe garage or not. I asked wouldn't damage to flywheel have been evident when they took off starter motor. They said no. The starter motor shows clear wear on the teeth which I would have thought indicated fly wheel damage. Been chasing garage for a solution. They now say I have to take car to main dealer to see if it is a faulty starter motor. I am really concerned I will end up with huge bill if main dealer says starter motor OK Has my garage been negligent in misgiagnosing fault? or is this an honest mistake? Thanks
  7. Hi Some advice please. My husband has had a letter sent to him standard stuff about "Agent Visit" looks like a car phone warehouse debt of £888.08. It quotes account number and our "service address" ie our home address Problem is debt is not ours but probably our daughter who does not live with us.     Hi Bit of advice please. Been fighting for my daugther got herself in right mess. trying to claim on hardship grounds. HSBC are saying that a review with the FGT has to be done on the telephone. This is the problem I have been dealing with this for her she has some special needs and is way out of her depth. Tried phoning FGT Friday spoke to someone together daughter gave her permission for me to talk on her behalf. Cut a long story short waited 15 minutes then said they would phone back which they didn't. What is the legal position if my daughter writes and gives permission for me to take on her case? can HSBC insist review is done on phone. Bit of a joke they have all information requested now charges are just under £1000 started off at £780 Regards Zaffie
  10. Hi Lesley Who applied for the statement? if it was parents you have the right of appeal as long as it is within the time schedule. IPSEA are great used them myself. A statement is a legal document a lot of education authorities are not issuing them because it will cost them money. IMHO it has nothing to do with needs but costs. regards Zaffie
  11. Hi Cidergirl a statement is a legal document until the age of 19 if in education. Connexions should have specialist advisors for people with learning difficulties. They are involved to age 25 for people with learning difficulties. Have they done a S140 on him? What about CAMHS? need to move fast only to age of 18. Does he have a social worker? There should have been transition planning for adult hood. Advice you seem to need professional imput to get the help and advice your son needs. Start with social services. Has he a community care plan? have you been assessed for carers needs? Regards Zaffie
  12. Lesley Having independant reports done can cost a fortune. It is essential you get the right reports done. We had to have many done for the statementing of our son. The educational psychology report alone cost £800 10years ago. It was the most comprehensive report I have ever seen. Involved her coming home to assess and going to school to assess. What SEN does your child have? Some organisations will do fee reduced reports eg Scope Regards Zaffie
  13. Hi some very good advice from others for you. I have a son with special needs. Originally diagnosed with ADHD then Tourettes and now Asperger syndrome. Reading your posts you could have been talking about my son. He was always "different" not seeming to fit in one way or the other. Go with your instincts as a mum if you think something is not right get a multi disciplinary assessment done ASAP. Referal via GP or health visitor. Bookworm is right you can have a child with difficulties even when they are extremely bright. My son is 18 now done extremely well academically still has problems but we accept him for who he is. Getting a diagnosis helpt my OH accept that there were problems. It changed his attitute to our son and the way he dealt with him. Good luck Regards Zaffie

    Hi Tuttsi any advice/strategies/hints most welcome. Been reading other threads including yours well done and there does not seem to be a consensus by the banks as to what is "hardship". even when someone seems to have a good case for removal of stay re hardship it does not happen.
