  1. I am very grateful for your response. Do you know if it is possilbe to submit an Application Notice (N244) lather than the last filing date for the Allocation Questionaire or must N244 be submited at the same time as the N150 ? ie. if I don't lower the amount in the Allocation Questionaire now, will I be too late to do so at a later date? I will telephone the court in the morning as you suggest to seek clarification but being a lastiminute.com-type-of-person, I am planning to hand the form in tomorrow morning and still scrape it in to work by 10 am! I've got everything else ready. AQ and supporting paperwork done. best, drive
  2. Hi Hedgey (or anyone else who has the answer). Is it absolutely necessary to complete an N22 (Application Notice) if the only change I am making is to the total claim amount? The thread you sent was very useful but from reading so far it seems to pertain to amending an inadequate particulars of claims. Do you know if it would be acceptable for me to just enter the new lowered claim amount on the N150 (Allocation Questionnaire) and attach an amended reduced schedule of charges showing Abbey’s partial fee refund? I have no problem completing the N44 along with the N150 but just wanted to check whether it is essential or not in my case. Thanks again.
  3. I have REALLY left it late but can anyone help me with some last minute advice please??? My Allocation Questionnaire is due on Monday 10th September. ie. almost tomorrow already… How does the OFT test case affect me? I originally started this process in April and submitted my N1 in July for £6k including 8% interest and a £250 court fee. Where do I find a template for filling out the AQ form? Is it too late now to amend the total claim amount now using the AQ form? Abbey deposited a payment of £1000 in to my account just before I submitted my N1. I want to subtract this payment from my total claim, which would reduce my claim amount from roughly £6k to £5k. Any help that can be offered from anyone one is most appreciated.   4. Hi All, I would like some guidance and I hope that someone will be able to help please. N1 submitted at local court at the beginning of July. I have since received Abbey's standard letter regarding the OFT case. I received a copy of Abbey's defence last week. On Friday 25th August, the court sent me a copy of the AQ which I must return by 10th September. I spoke to the court who said I should fill it out. They have received details of the OFT case but the local court is assessing each claim individually. Should I follow the guidance given in the templates section on this site to complete the AQ form? http://www.consumeractiongroup.co.uk/forum/bank-templates-library/11644-allocation-questionnaires-guide-completion.html Or are more updated guidance notes available now that the OFT have launched their case? Also I am claiming back just under £5k of bank charges. I made an error in the total amount of the claim in the N1. Abbey credited £955 as a miscellaneous credit to my account on 16/06/07, which I only accepted as part payment. The problem is that I did not deduct the part payment from my total claim amount. The total amount submitted in my N1 including statutory interest and court fee is £6k. If I deduct the part payment, the total claim would be £4900 (charges and interest). I paid a court fee of £250 in addition to this. Can I / should I amend the amount and deduct the part payment in the AQ form? Should I be using the small track? Thanks in advance for any guidance you can offer.

I am not sure if Abbey Credit Card is included in this test case but I received a letter today from Abbey (Customer Advocate Office) to inform me that they had credited the full amount to my account (charges+court fee+8% interest) on a 'goodwill basis'. I submitted my N1 at my local court on 16/07/07. The Notice of Issue date was 17/07/07 so I was very surprised at such a fast turnaround and full settlement.
  6. 17/04/07 - I had copies of all my Credit Card statements so started the process and requested my charges back of apx. £700 incurred on my Nat West Visa Card over the last few years. I received an immediate response from Nat West, informing me they would reply in 10 days. 25/04/07 - Nat West letter: Partial Offer of £280 in full and final settlement, which was calculated as the difference between the original £20 late payment charge amount and their new £12 late payment charge. 11/05/07 -I rejected their offer using the letter in the Templates section on this site, giving them 10 days to pay in full before court action. Nat West promptly wrote back within a few days, stating they were not going to increase their offer and would not accept the terms in my letter. Ooops! I really didn't want to go to court and was hoping the claim could be settled amicably. 01.07.07 - I finally (yes, two months later!) got it together and submitted an N1 at my local court. 10.07.07 - Solicitor’s response. Nat West would defend my claim in full! 18.07.07 - Received full settlement by cheque including all charges, 8% interest and court fee. Whoopee! £960 Now how hard was that! No AQ. No Court date. If it wasn't for this site, I would have given up a long time ago and very possibly would have accepted their initial partial offer. To be fair, Nat West's speed of response to my three letters (and N1) was nothing short of excellent. I need to let the court know that I've received settlement as soon as the cheque clears. Now for the big boys. Abbey x2 (apx £8000 - N1's submitted!). Don't give up! Keep following the advice on this site. Use the templates. It works!!
  7. I am not an expert but from my research so far, the 5k limit refers to the claim amount without interest added so your 4.5k claim plus interest will be fine for MCOL. Perhaps an expert would like to verify this or correct me if I am wrong please.
  8. Abbey withdrew my overdraft in 'error' yesterday due to a fault in the system without any prior warning. I managed to get it reinstated by the end of the day. Following this exeprerience, I am starting to agree with your theory of an internal 'blacklist'. Two customer service reps said to me yesterday that, even though my overdraft wasn't due to expire for another 6 months, it was withdrawn due to 'the way my account had been run over the last twelve months' . One representative also stated that they were in their rights to take my 2k overdraft away without warning because of the charges I have incurred over the last year. I am in the process of opening another bank account as I don't think I can trust Abbey with my salary anymore.
  9. My overdraft has not been updated. Their systems have gone down now. My payment for grocery shopping which was due to be delivered this afternoon has been cancelled as the payment was declined. The service you get from Abbey really depends on which call centre you get routed to. I have just been advised that the call operative I spoke to earlier this morning could have manually reinstated my overdraft. Now I have to wait for their systems to come back online (hopefully today but no promises) It is frustrating. I look forward to taking my business elsewhere. After 20 years with them I have had enough!
  10. Abbey Credit Card done the same thing to me. I requested £1,500 back and they have credited my account with £600. I am not happy about this so I have sent them a refusal letter and informed them that I will only accept the £600 as partial offer. I also have a £4,500 claim with Abbey. I am still waiting for them to review my case. They have requested 8 weeks to do this.   11. You are right. Abbey are experiencing technical difficulties and they expect the overdraft system to update this afternoon. I have been told that my overdraft should be reinstated in a few hours time. I didn't bother with the debt management department. Let's hope I don't get charged for any transactions made whilst the overdraft was removed. This is a lesson and a warning for me! I will be setting up a parachute account, today.

  13. Thanks to all for the encouragement and feedback. It is very reassuring to know that others are out there with similar experiences, who are either at the same stage or have succeeded further. I am most annoyed at the fact that they didn't even bother to inform me that they were taking the overdraft away first.
