  1. Hi , i am trying to print off LSTB business account T & C's from OCT 03. I have been to the archive wayback machine and clicked on the relevant date and come up with the LTSB welcome page. Which bit do i need to print off to obtain the T & C's ? Is it the rates and charges section? There is so much on there i am not sure what is relevant? Thanks Bentley
  2. Thank you so much. Accrington court have dispensed of the aq and just gave me a court date of 17th August. I have informed them i will be on holiday and sent them docs to prove it but the Judge has decided to continue on that day stating" It is a long time off yet and anything could happen". The court has not asked me to produce anything yet but i think i am going to send off the court bundle anyway seeing as i will not be able to attend the court date. I am intending to send it to SC & M as well. Do you think this is a good idea?. Any further advice welcome. Bentley

  5. Thanks for your replies. I have looked at the links and the wording is slightly different. SC & M have not mentioned the error in their defence. They only mention the services provided for personal customers which are free ( both my husband and i both hold personal accounts too ) The only legislation they quote is at point 7 of 9 " The charges are terms which relate to the price payable by the customer for a service provided by the bank, and pursuant to Regulation 6 of the Unfair Terms in Consumer Contracts Regs 1999, are not subject to the assessment of fairness.They also deny that the charges are unlawful or contravene any statute or regulation. Do you think i should amend the claim or justr hope they don't notice? How would i go about amending the claim if i need to. Thanks again.

Hi , i have just read somewhere that you should quote different legislation when dealing with a business account.I am trying to claim for our business account which is a very small rental business with only myself and husband involved. I followed all the template letters found on Martin Lewis website and when i took my claim to moneyclaim online i again followed his template which quotes the Unfair Terms in Consumer Contracts Regulations 1999, the Law of penalties and the County Courts Act. I am now worried that i have quoted the wrong legislation and that this will impact on my claim when it goes to Court. ie: will it get thrown out? Any advice to rectify this situation or does both business and personal accounts come under the same legislation?

  8. Hi there everyone, Thank goodness this site is here to help as i am beginning to get butterflies and wish i had gone through a solicitors which take 25% of your claim. I have been attempting to recliam over £3000 worth of charges and so far ltsb have defended my claim. i went through moneyclaim on line and the proceedings have transfered to Accrington county court. They have dispensed with the Aq and i have got a Notice of Hearing for Directions on 17th August time estimated 15 minutes. I am away on my family holiday on that date and have written to the Court requesting another date enclosing proof of my holiday arrangements. The Courts have not yet asked me to produce anything and I wondered if anyone could give me some advice as to what a Hearing for Directions is and how can i prepare for it. I am getting worried that this will all fall to pieces in a court room with me giving my own evidence against a huge organisation. Thanks :o
  9. Hi , Accrington County Court has also dispensed of the AQ and sent me a notice of Hearing for Directions on 17th August. They have not asked for any paperwork to be sent. What is a hearing for directions and how can i prepare for it.? Thanks any advice very welcome. Ruth
  10. Thanks for the reply. I have just been finding my way around the site and found the Lloyds forum. At this stage i have not been asked to submit anything but when they do i want to be prepared and seems i need to get together a bundle to send. I will need some help with knowing what this bundle consists of. Should i go through the Lloyds forum to get advice. Thanks again:?
  11. Hello everyone, I have followed all the steps to reclaim my £3000 plus from Lloyds TSB. I went through moneyclaim and LTSB have used the standard defence. I was then sent a court date of 17th August for directions hearing without ever receiving the allocation questionnaire . Unfortunately i am away on my family holiday, which has been booked for over 6mths, on this date so i have requested another date giving proof of my holiday booking. When i spoke to the court over the phone re the questionnaire the lady said it was not applicable in my case? Now i am really worried that the procedure has gone so far that i am going to end up in Court against professionals and not really knowing all there is to know and end up loosing. Any advice anyone can give me would be most welcome.
