  1. Can anyone help, i have sign a personal note for a builders merchant to the some of £26k for my business, we have now lost the house and car already and iam going to be made bankrupt early next month, can the builders merchant force me to sell our house hold jointy owner with my items to repay the debt or once bankrupt they can not take action. any feedback would be great cheers
  2. Hi thanks for the advice, can anyone confirm the following: i have got 3 CCJ which iam paying very amount to clear the balance but what happens the the CCJ if iam mabe bankrupt ? also once we have moved into a rented house can any remove items such as microwave,TV, etc etc

At present all our creditors are being managed by the debt management company who have been great, but since june and unable to work and now been told its going to be 6 months before work can get to normal. Currently i have got around 42k in debt and now losing the house and going into rent before bankruptcy seems to be the way forward to clear debt as paying monthy has had no impact at all. if the house is sold this will pay back the lender and 1 secured loan, but not the secord can they chase once the bankruptcy has been completed We have got a joint bank account for household bills no overdraft will this be closed ? also any feedback in the action and timescales would be great . I have also signed a personal note for a business debt which now totals £26k from my business which is now insolvent, the company have stated they can chase the debt and take personal belonging which can be sold to cover the business debt we have no car and live in rented house can they take action if iam bankrupt cheers

We are looking to let a house and the letting agency are now checking out our credit history, and its very poor we have never rented before and unsure how the bad credit history will affect when renting. We have paid the holding fee of £200.00 and once they have checked the credit history out they will confirm the terms. we are happy to pay the deposit and 3 months rent up front but not sure if this is the correct way, we are worried that having bad credit will stop us from renting a house any feedback would be great cheers

Hi the possession order was granted and put on hold because we paid the arrears, now we are behind again and no way able to pay GE Money stated they will file to take possession. any feedback would be great, Also we are willing to move out and rent the house so the morgage can be paid direct to the lender but we need consent and they are not playing ball.

  7. Hi yes the Dss takes weeks, we have sent a letter by recorded mail to GE Money asking for consent to rent the house out but as yet they have not even replied, every time they call its demending money money money which we clearly do not have thus looking at leaving and going into rented. cheers
  8. HARDSHIP, we are losing our home, unable to work due to broken ankle and leg, how do we state to the court that we are classsed and hardship, but iam sure everyone is being hit hard. We are filing in the morning lets hope it seen soon.

Hi sadly iam unable to work until early next year after a few more operations, GE Money already have a possession order over the house and unless we repay the arrears they will go to court to take possession, we have even asked GE Money to given consent so we can rent it out to cover the mortgage but they have refused so letting companys will not rent it out. The rent would cover the mortgage an dpart of the loans. GE Money are not helping at all every way we turn they stop us straight away, we hope GE Money are HIT HARD by tis credit crunch

Hi We have now had the details regarding the bank charges from the Halifax and the amount is just over £7,000.00 including interest, i have put together the details for the court, but have been told that the case would not be heard due to the cases which are on hold. So is it worth waiting or should we file the papers today at the local county court. Cheers

In june this year i broke my ankle and leg in 3 places and being self empolyed meant that we have no funds coming in we called GE Money within days and explained this but all they said was sorry but payments must be kept up or they will take action. Yes they took action and now have a possession order over the house, iam still unable to work or even walk as yet thus no work still no money, we get benefit of 94.50 week, the mortgage is over £1000 month and now in arrears on £4k. Details 1, House load £136k, 2nd load £23k, 3nd loan £13k total of £172k, they is also a company noted an interest on the house regarding an outstanding CCJ and the house is only worth £165k at present due to the housing markets We are thinking of renting a house for £750 per month now before they coming asking for the keys and giving up the house, by moving out now are we breaking the law by moving ? also because their are secured loans on the house what happens about the shortfall. Any feedback would be great as we are unsure which way to go, we think by moving out now in our time and not being moved by a bank is better. Cheers
  12. Great news we got a cheque from MBNA for the charges and a letter asking to stop action £684.60
  13. we tried to pay our mortgage arrears on Friday at 4.45pm but the department dealing with our file were not their ? we are paying the arrears today at 9am the amount on the statement is £3898.12 and its the same as on the court papers. but GE Money are now asking for another £1,049.00 its not costs or interest can they demend the extra or should i pay what on the court arrears papers. and once i pay today can they still take our house. As their is still a sum outstanding can they use this still take the house or should i just pay the full amount GE Money are demending. any help would be great we have re mortgaged with Beacn mortgages and with all papers complete this should be completed early nexk week, we informed GE Money that we have remortgaged and was told they will try to take the house before its completed and the lady just laughed. Hi we have been issued with a possession notice and have been informed by the court that we have leave our home on 17th Sept, iam paying the all the outstanding arrears on Tuesday will this stop the possession ? we are re mortgage within 28 days but the possesion date is sooner so we are clearing the mortgage arrears trying to avoid the possession any help would be great cheers

Why if the Halifax are stopping all payments claiming that due to the case which is now being confirmed they are still charging, if the courts are stopping claims until the the test case has ended the courts should stop the banks from charging or is the a case of the banks telling the courts how to act.
