  5. Well Barclay's acknowledged the claim on the last day then didn't submit a defense in the following 14 days so I applied for a judgment. That was almost 2 weeks ago and still no money. What's my next step on this one? All my others have settled much faster Barclay's are dragging their feet.
  6. So that date issued already takes into account the extra dates as the 21st wasn't the date I filed which was a few days prior. I have done a search on the forums and it seems that there is a few people who have not been able to do this using moneyclaim online. I will give the court a ring on Monday something doesn't seem right. My claim was for £3800 so can not see Barclay's not acknowledging the claim.
  7. Is it 14 working days or 14 days? It was issued on Thurs 21st Sept would Friday 6th be the date I could do this?
  8. They haven't acknowledged I thought they had 14 days in which to do that if they did then they got an extra 28 days? Because they didn't acknowledge in the 14 days I thought I could file a a default?
  9. I have subbmitted the claim and it was issued on the 21st Sept. No defence has been submitted by Barclays and the 14 days are up so I tried to submit for a default judgement but a screen comes up saying it hasn't been 14 days. Any idea whats going on? It is 14 days and not 14 bussiness days isn't it? "You cannot request a Judgment by Default at this time. The Defendant is allowed 14 days from the date they were served with the claim to defend or admit your claim before you can request a Judgment by Default. If the Defendant files an Acknowledgement of Service within 14 days of receiving the claim form, they will be entitled to 28 days from the date they were served with the claim form to file a defence or admission of your claim. If the Defendent does not file a defence or admission within the 28 days you can request a Judgment by Default. If you have not requested judgment, the defendant may still file a defence to your claim after the 14 days or 28 days have elapsed. The claim will then be transferred to your local court for a hearing to be arranged."
  10. Got my money back on 27th and a letter in the post today expaining it would cost too much to defend and they would not get costs if they won. £430 including intrest and court fees!
  11. The court have sent me a letter saying they intend to defend. Bit worried now.
  12. I used this for MBNA and it worked so I am using the same for Halifax. I have a contract with the defendant bank dated July 96 which is conducted on their standard terms and conditions.I am claiming the return of money taken by the defendant in charges over the last 6 years plus the interest they have levied on those charges. The bank's charges are a disproportionate penalty and therefore unenforceable as they are contrary to common law. Further, as a disproportionate penalty they are invalid under the Unfair (Contracts) Terms Act 1977 s.4 and under the Unfair Terms in Consumer Contracts Regulations 1999. Para.8 and sch.2 (1)(e). In the event that the charges are not a penalty then they are unreasonable within the meaning of the Supply of Goods and Services Act 1982 s.15. I have asked the bank to justify their charges which they haven't. The claimant claims interest under section 69 of the County Courts Act 1984 at the rate of 8% a year from 31 Aug 00 to 4 July 06 of £94.90 and also interest at the same rate up to the date of judgment or earlier payment at a daily rate of £0.07.
  13. Filed online today for £315 plus intrest of almost £100. Hopefully should get a fast settlement but who knows.
  14. Survey and Donations done I am on the ball today. The refund has paid my holiday to Florida in Nov so the drinks will have to wait until I have won the Halifax not long now and they will be paying for a good night out!
  15. The intrest and court fees are in my account today so just need to contact the court on monday. Next the Halifax bring it on!!!
  16. Thanks. I also settled my MBNA today they paid up the intrest and court fees so thats 2 in one day!
  17. I checked and they said that the statements show everything the other months I wasn't using the card. Anyway they have settled in full and sent me a cheque for the £40 so thats one more finished with.
  18. I am already registered at Moneyclaim as I have just claimed gainst MBNA. I have already done my claim and saved it but I will wait until the 14 days are up I don't want to give them anything to use against me.
  19. Spoke to Halifax today they said max offer is £113 and that is final they will not pay and allow a court claim as they make you sign a form for the money. I said I want all my money back and they said well you will have file in the small claims court. Now in my letter I said I would give them 14 days which will be the 3rd July, since I have spoke to them and they said they will not pay up do I still wait or do I file now?
  20. Got a letter today offering £90 so going to write back saying they can pay this in but I want the full amount and will move to filing in court next week.
  21. All the money except the court fee and intrest has been paid. When they called me today they sid that will be in my account in the morning and they asked that I inform the court once it's in my account.
  22. Will call them in the morning. The money was credited to my account which is fine by me as I will be paying off the rest and closing it this month.
  23. MBNA have settled today now what do I do about the courts? Do I ring them or can it be done online? If so does any the number for Nottingham court if I have to call. Can one of the Mod's settle my court thread entilted wilson v MBNA in the litigation thread Thanks
  24. I just spoke to Gareth Tunicliffe as I had a letter signed by Steve Bailey with his number on it, and explained that they had not paid by my deadline so interest and charges are due to be paid. He said they will ring me back tomorrow once they have decided what they are going to do.
