  1. Hi everyone, Nationwide had untill Friday to enter their defence, but I just checked my account to find they have now paid me my money. They paid all charges with interest plus court costs, however, they did not pay me back my SAR fee. Nevermind, i'll let them off with that because i still got a victory!!! Rich
  2. Well this is new to me. I just phoned Nationwide and they said they still intend to defend the claim. I asked why they sent me a letter telling me my charges are to be refunded and they told me they can't give an answer but that they are going to defend. I informed them that I will simply include this letter as evidence against them and they told me by all means do that. Whats that all about then?
  3. Hi, I had exactly the same problem with NTL and Nationwide. I reminded Nationwide of their obligation under the direct debit gaurantee but they just were not interested! Thats why i started court action against them. The Direct Debit Guarantee If the amounts to be paid or the payment dates change, the organisation collecting the payment will notify you normally 10 working days in advance of your account being debited or as otherwise agreed If an error is made by the organisation or your bank or building society, you are guaranteed a full and immediate refund from your branch of the amount paid You can cancel a Direct Debit at any time by contacting your bank or building society. We also recommend you notify the organisation concerned.
  4. I sent the LBA to my branch in April and actually filed the claim on 2 May which was served on 4 May. Claim was acknowledged on 16 May saying Nationwide intend to defend claim in full and solicitors are Eversheds Llp. I then recieved a letter from Nationwide Member Service today saying "Thank you for your recent letter about the charges to you account....I am pleased to inform you that on this occasion only, the charges you questioned are now in the process of being refunded." I don't know what recent letter Member Service are refering to as I sent all my letters to my branch. The only letter I wrote to Member service was in November 2006 and they were supposed to reply within 56 days, which of course, they never did. I hope this letter recieved today is regarding my actual claim and not a reply to that letter from 6 months ago. There have been a load more charges since then which I want refunded and are included in my claim.
  5. This letter was sent to me from Nationwide Member Service, not their solicitors. Is that normal?
  6. Hi all I filed my claim on 4 May 2007 and I recieved the notice that acknowledgement of service has been filed on 16 May 2007 stating that Nationwide intend to defend the claim in full. I have recieved a letter today, dated 18 May 2007, from Nationwide, saying the charges I questioned are now in the process of being refunded, although they do not say anything about court costs and interest. I have checked my account online and as of yet they have not been refunded. Hopefully this will happen soon! Anyway, this is still good news and so don't be put of by the latest Lloyds 'victory'.
  7. Hey there, what defence are they using? Are they saying they provide a service etc.. or anything about breach of contract?
  8. On the Acknowledgement of Service it says that they intend to defend the claim. So if the claim was filed on 2 may do they have to send me their defence within 28 days?

  10. Just to let you know I recieved another rejection letter from Nationwide refusing to pay back £356.11 in charges and costs. As I have written four letters asking for them to refund those charges, I have decided its time to take action. I've filled in my claim form (downloaded form N1 as not enough space on money claim) and will be filing my claim tomorrow (30 April 2007) at the county courts in Winchester. I've claimed for £356.11 plus £11.15 interest. This site has been invaluable! I couldn't have done it without getting information from here! I've used my branch address in the claim form, is that ok or should I change it? I will keep you all informed.
