Hey Freebird - you are entitled to rant and there is no bette place than on here as we all know how it feels and how bl**dy frustrating it is Try and think of the extra 8% that you will be getting - at least an extra day's worth of ice creams for the kids in October!!   4. Hi again - quick question - do I have to include anything with my Allocation Questionnaire? I haven't sent the bank, the solicitors or the Courts my spreadsheet of charges yet and not sure when is the time to do it? Many thanks FeralKat

  7. Hi there, can anyone tell me where I can find details of the defence that others have recieved from Lloyds? I've done a search as I thought it was in the Bank Templates Library but I couldn't see anything in there. It would be useful to see if the defence that I have received is broadly similar to others. Mine is full of errors - IE question marks where ever there should be an apostrophe!! Many thanks Feralkat

  10. Just an update - I have received confirmation that Lloyds intend to defend the claim and an Allocation Questionaire that I have to return by 9th September. Am considering telephoning the solicitors to discuss the case with them as I have read on here that sometimes this 'prompts' them to offer a settlement before I have to return the Allocation Questionaire and the extra £100. Does anyone have any advice regarding this? Is it worth contacting them - has anyone else had any success with this? Any advice gratefully recieved!! Feralkat
  11. Hi Mario and WELL DONE!! Can you tell me at what point you were in the proceedings when they offered you settlement? It's just that I've just received their defence and now have to fill in the Allocation Questionnaire and am hoping that I won't have to send off the extra £100!! Many thanks Feralkat

  13. Just to let you know that I recieved my Acknowledgment of Service - Lloyds have until the 21st August to file a defence. I'm sure they will as this seems standard practice ............... isn't the waiting the hardest bit!! Oh hum! Feralkat

  17. I'm sorry - I have another question!! As I have previously stated my claim was deemed served to lloyds on the 19th July and they have until the 2nd August to respond. I am going into hospital on the 26th July for an operation, and will not be home until the 7th August. Does anyone know the earliest that I may be sent the Allocation questionaire? I'm concerned that it might arrive and I might run out of time before I am able to respond. Would I be able to request more time? Many thanks
  18. Hi all, I filed my claim on Moneyclaim online and have now rec'd paperwork from Northampton court - but I am in Sussex??! Does anyone know why this is? Also, am I right in thinking that Lloyds now have 14 days to respond with a defence and if they do I then get sent an Allocation Questionnaire? Many thanks for any assistance. Feralkat
  19. Well, I've finally done it - I've filed a claim and paid my due with MoneyClaim online - now comes the scariest bit!! I hope its not me that they choose to take to court!!!!!!!! Fingers (& toes) crossed Feralkat

  21. Also, Can anyone tell me when I return the schedule of bank charges as mentioned by BankFodder? "Mistakes include:- not claiming interest, claiming too many years back, claiming for charges which are not penalties, issuing a court claim without trying to enter into a dialogue first, failing to let the bank have the schedule of bank charges for which you are reclaiming."   25. Hi all, I've spent hours serching through all the threads and the FAQ's and I can't find the answer to my question!! I filled out Vampress's spreadsheet and on the second tab "Charges & Interest" I now have 4 figures. 1. Penalty Charged = £2,443.00 2. 8% on Penalties = £443.21 3. Interest on Penalties = £232.27 4. 8% Interest on Penalties = £25.79 When I add in the information on Moneyclaim online and add the wording regarding interest I need to fill in the following: The claimant claims interest under section 69 of the County Courts Act 1984 at the rate of 8% a year from {date when the money became owed to you} which date do i use for this as obviously I have been charged interest on many differant dates - do I just use the first time they charged me?to {the date you are issuing the claim} of £ {put the amount} Which of the amounts detailed above do I use? Am thinking should be 2 but not sure.and also interest at the same rate up to the date of judgment or earlier payment at a daily rate of {enter the daily rate of interest}. Which amount do i calculate the daily interest rate on? I've also seen mention that I should attach details (ie spreadsheet) of my claim when submit it? As I'm doing it online, I'm not sure if this is possible. Any assistance would be gratefully received - I've been so nervous about taking this step!! Many thanks FeralKat
