  1. Long time gone......nice to see familiar names still around on this site. I have just typed up a letter to the court and DG solicitors to let them know I have moved house since the court stayed my case and should they need to contact me in the near future. No coincidence that it is dated the same day as the announcement re the case. Ha ha! Good to let them know I haven't given up. Also, nice to check my spreadsheet after such a long time and see that with the interest my chares are nudging 2k - I assume that interest continues to accumulate throughout the stay? Keeping the faith.......
  2. On 10th August, my case was stayed at Tunbridge Wells County Court. I am really not sure whether there is any pointing submitting an application for removal of stay. From what I can see, the only stays that are being lifted are for people who can prove extreme hardship. I am unable to do so as I have this year finally got my finances in order and have some savings for the first time in my life. I am so gutted as I received an offer in July for about 1,100 pounds which I rejected, although in hindsight 1,100 pounds now would be nicer than potentially waiting two or three years for this to be resolved. Any advice greatly received to perk up my spirits. :?
  3. Tunbridge Wells County Court Stayed my claim against HSBC on 10th August 'pending the final decision in the test case between OFT v Abbey National and others, or further order of the court'. I am debating whether or not to apply for the stay to be lifted. I am unable to prove any hardship, although the claim is for 1,900 and rising.
  4. Received letter from Tunbridge Wells County Court this morning saying the DJ has ordered that my action is stayed pending the final decision in OFT case. Sooooooooo peed orf

  6. Tunbridge Wells County Court - I was awaiting directions and when I called yesterday, I was told that the DJ will 'probably order a stay given the recent announcement of a test case'. Bummer!
  7. I am confused - I had understood that if we submitted the claim by N1 and included 3 copies of the POC & Schedule, then one of those copies would be sent by the court to HSBC (and thus on to DG)? I never sent one to them?? Yikes.
  8. You are one month behind me. I also submitted by N1 and after 10 days, I received HSBCs acknowledgement of service and then about three days before the 28 days (from the original date the claim was served to HSBC) were due to be up, I received a copy of HSBCs defence and a letter telling me the case was going before the district judge for directions (i.e. they will decide what will happen next). I am just about to send my first nudge letter to DG. In the meantime there is not much else for you to do but wait until your 28 days are up. Good luck
  9. Many thanks PD. One other question - when I submitted my claim, I used the descriptions from my internet banking statements. Amazingly, I have now located my original bank statements (going right back to when I opened the account in 1991!!!) which show more detailed descriptions (i.e. 'Charge Recall S/O-D/D' instead of just 'charge'). Do you think I should update my schedule of charges and submit it to the court and DG?

So I have received a copy of HSBCs defence from the court and a letter stating the file has been referred to the District Judge for directions and may possibly be listed for a Preliminary Hearing. They then ask for dates that I would be unable to attend court. Things have been really hectic for me lately and I haven't got around to doing any nudge letters or staying abreast of what I should do next. Can someone help? Thanks
  11. Received my Acknoweledgement of Service. Dated 11th June. So now I send a copy of my N1 form (including particulars of claim) and spreadsheet to the loverly DG. Counting the days.....
  12. hi there You are correct - you add the 8% at the MCOL stage. I wouldn't worry about the slight delay. It will not effect your case. Good luck!
  13. Hi Jimmy You haven't blown anything. All totally normal. You would not have been able to request a Judgment until the deadline had passed anyway. It seems they always file the defence at the very last minute, just to taunt you into thinking you will have a chance of getting a judgment. You just have to sit tight and wait for the next letter from the court. Once you get that, if anything is not clear as to what happens next, just ask on here.   14. Received the notice of issue from my local court last week. Date of service is 7th June, so HSBC have until June 21st to reply. I submitted by N1, which means I cannot see when/if HSBC defend in real time, but I assume I just sit tight and await the next letter from the court? That will probably be HSBCs Acknowledgement of Service right? Let me know if I should be doing anything else at this point? It is worth starting to nudge already? Rushing to the front door every morning only to find nothing more interesting than a leaflet for pizza delivery on the mat

Hey CatLover I can't promise to make it stress free for you, but I submitted my claim on Friday, so we are on a similar timeline and can definitely support each other when it comes to doing the bundle. From what I understand, that step is quite a way off yet (at least a few months), so I am doing my best to stay stress free about it for now. Jo

  19. Indeed I did expect that submitting by N1 would speed things up, as Nothampton CC will not need to first consider it before transfering to my local court, as it is already there. Whatever, its in now (receievd at the CC today). An extra two weeks if I get my money is not to lose sleep over. Here's hoping I have a sympathetic judge down here.

  22. Hi there I gave up on MCOL yesterday and sent in the N1 to my local court (I wanted to get my claim off yesterday so as to keep a couple of large charges in within the statute of limitations). I called the MCOl helpdesk and it seems that their system was overloaded. Am sure its got something to do with it being the end of the month. If MCOL still doesn't work today and you are desperate to get your claim in, I would suggest you go the N1 route. I found it really straightforward. Good luck
  23. OK - I think I was going wrong because I was doing charges + interest x 0.00022. Otherwise the interest will not increase from the day of the claim? Should I not be claiming interest on the interest. Maybe I am overthinking and thus complicating this.
  24. I am submitting my court claim today (by N1) and I am not sure my daily interest rate is computing right. I inserted a formula that adds together the charges and 8% interest and then multiplies those by 0.000219, this gives me one amount (0.38p). But the spread sheet automatically adds a different amount as each day passes (0.30; 0.31). I want to be sure I quote the correct daily interest amount. Can anyone help? I really want to submit my claim today.
