I am most disappointed that you have not even acknowledged my previous correspondence. I have been notified that this case has been listed for an allocation hearing on 7/9/07 at Ipswich County Court. I have written to you in the past, asking for you to consider my claim and reply to me. I have heard nothing. Were this to come before a judge, it is obvious who is making any and all attempts at resolution. It is my feeling that you seem to have no intention of defending this claim in court and are simply procrastinating. I am mindful of the vast number of claims with which you are currently dealing. In order to more speedily resolve this matter, I am willing to accept the sum of £2576 as full and final settlement of this particular claim. I do not agree to waive my rights in respect of any other actions, nor do I agree to a clause of confidentiality. Please find enclosed another copy of my schedule of charges relating to this claim.   2. It's a AQ hearing apparently to determine which track to assign it to. Should take 5 minutes. Do I have to attend these or can it be done in my absence?

  4. Oh I see, you worried me there. I'll get on that LBA this lunch time, I also confused the LBA re access request with the other LBA re give me my money back. I put it down to being before 9 am, far too early for the brain to be functioning normally. thanks a lot.
  5. That's good to hear, a day isn't so bad. MCOL said the AQ should be dispensed with but the Ipswich court still required it. I've popped in my AQ draft order in there too so hopefully the judge will take this route and I'll get my money back sooner. I have access to so rather nice printers here (£5k worth of photo copier come network printer), printing speed will not be a problem.
  6. it's information straight from here. I sent the original SAR specifically requesting info prior to the six year cut off and they didn't supply it. I then took the template letter for incomplete data supplied including the info I was after from the first letter. Does anyone else think that was confusing? I want to start my claim with all my charges as some of it falls within the six year cut off so it doesn't get thrown out by an over zealous judge before I get anywhere.

Baclays received this letter from me on 2nd July: 28th June 2007 Barclays Bank plc Data Protection Office 1 Churchill Place London E14 5HP Data Protection Act 1998 Dear Sir/Madam ACCOUNT NUMBER: ******** **-**-** (closed 7th Nov 2001) I am in receipt of the documents that you have supplied in response to my Data Protection Act information request dated 27th April 2007. The disclosure of personal data is incomplete in that at least the following documents are missing. 1) You have failed to provide a complete list of transactions and charges. For the period prior to 28th Dec 2000. Where any previous information or records held have been deleted or disposed of, the methods used to do so, including dates, certificates or references confirming details of destruction. Where you are unable to provide such certificates, please provide a declaration, signed by an authorised officer of your company, confirming the dates and methods of destruction of this data 2) You have provided no notes, or documents relating to instances of manual intervention. If you are unable to supply this data because there has been no such manual intervention, then please be so kind as to confirm this in your response. This is not an exhaustive list by any means, it is just an example of some of the information I am missing. Accordingly, I have to tell you that you have not yet complied with your obligations under the Data Protection Act 1998. You have a further 7 days to comply. Yours faithfully, I have received no response since then, I'll give it another few days but should I move straight to court action following that or write another letter?

  9. did you have to do an AQ dr? if so how long between submission to court bundle required date?
  10. right, I've just been to the court and handed in my AQ plus the £100 fee. I sent a copy of this to DG which they would have received today recorded delivery with my schedule and updated claim amount. here's hoping they'll just offer now. I'd rather not have to create a court bundle.

  12. it's finding them again that's the problem, I had a quick look for you but couldn't find an accdeptance letter with the bit where you do not except the confidential bit. latty will know where to find it.
  13. if I put a charge in for £20 and not date, I get interest at £172.74 so the spreadsheet is ignoring your dates. Assuming you are using Excel, if you select one of the dates you've entered, right click it and select 'Format cells...', on the number tab you can select what kind of data you want in the cell. If you select 'Date' does it fix your problem? if not try re-entering a date, for 21st March 2007 enter 21/3/7 with the slashes going in that direction. hope that helps
  14. is the advance one for contractual interest? what was the date of the sample you gave above? also, a long shot but you pc is set to todays date isn't it? it's not set to the year 2100 or anything daft? my spreadsheets are on a memory stick at work, I'll have a fiddle tomorrow and see if I can recreate your figures.
  15. the schedule is from the spreadsheet on here so clearly shows charges + interest. my nudge was obviously for the full amount too. but then we both know this is never going to make it to court don't we.
  16. is it the standard spreadsheet from here or have you created your own? you say the total is £17k, what does the interest look like for each charge? are they all way to high too? if not does 1 stand out? have you added too many zeros to one of your charges? what's the total for them on the spreadsheet? now there's a lot of questions.
  17. I checked the 'Do you want to reserve the right to claim interest?' radio button on the mcol site but I can't see anything on the claim form I printed off stating this. The 'particulars of claim' are taken from the templates here so clearly states the amounts debited + interest @ 8% + the daily rate. my schedules showed the interest too.

I've gotten confused and put in the amount before interest. what a duffus!! I take it I can simply contact the courts and get this changed and there will be a charge for this?

  20. I'm having a slight moment of panic. The 'amount claimed' on my claim form should this include the 8% interest or should it simply be the total charges?? I can't find anything in the guides and can't remember where I read what it should be.

I haven't had a single response to any of my letters to hsbc or dg, I'm assuming they'll want to talk once I do my court bundle. they must recognise the same letters coming in day after day and realise who are the ones who are not going to bow down and give in. it would save them money surely? our files must be pretty similiar. congratulations by the way, it's very heartening reading peoples successes against HSBC.

  24. I've recieved an AQ today, I thought these were being dispensed with.
