  1. Thank you for that link. I think I may wait a few more days to see if I get any more responses from them and if they haven't done anything within 30 days I'll cobble together something using the references to try and get them to remove it. Afterall they put the default on and they have absolutely nothing but three statements to go on I might also point out that they have the default date wrong so the data is infact incorrect. I would doubt that they still have the contract at Barclays as it was opened in 1995 if there was indeed one. Kaz x

They didn't really send an email confirmation it was just a pop up box that you couldn't print out that said something along the lines of "Thank you for your payment your account will be updated shortly" ish. If I send Littlewoods a SAR will that mess up the six years thing as the last correspondence was Dec 2003 so it's only just over a year and a half until it drops off my credit report. I'd hate to mess it up and end up having to wait a further 6 years.
  3. Unfortunately I paid cash instore and all my old records are boxed up as I've decluttered and I have numerous boxes stored in my parents in laws loft as my house is on the market. If I knew which box and they were in and they were accessible it is a long shot that I may have kept the receipt but I wouldn't put money on it.
  4. I went through the process of paying online twice and go a confirmation message but no money was taken out of my account and the bank confirmed at the time that no money had been requested. I eventually went in and paid at the store for the goods but not the interest and charges as I was agrieved that their rubbish online payment system was at fault. Kaz x
  5. Do you have to ask for them to be removed or do they automatically just drop off when they reach the magic 6 years ?
  6. Thank you for your reply. From what I understand only the person who updated the credit file can alter or remove the record. As this is HFO then I thought Barclaycard can't do anything about the entry. Can this just be passed from one company to another or once they have failed to comply under the CCA then that is it. Does anyone have a template letter for dealing with asking them to clean up my credit file as they have failed to comply with my SAR and they have all but admitted they don't have any paperwork.   7. Thank you for that reply. I'm not sure as it is such a small amount and from 5 years ago whether to just wait for the six years and then hopefully it will expire off my credit record. If I resurrect correspondence with them then it might make things worse and take another six years to expire. I'm not sure that I have the proof as that would be a receipt and although I'm quite good at keeping records I might not be able to put my hands on it. It's so annoying as you ring these people to try and sort out small problems and they manage to turn them into whopping great traumas. Kaz x
  8. Hi A few weeks ago we received a letter from Westcot Services saying that I owed them £76.92. My partner rang them on my behalf to query what the debt was for. It aparently was for a debt owed to Littlewoods Index. This was from 2003 when I purchased some items from Index and paid them off on line. The computer confirmed that I had paid and advised me that it would take a few days to update their systems. I thought nothing more of it and assumed that it was paid. I then got a letter saying that I had a balance outstanding and when I rang to query it they told me that it may just be that the system hadn't updated properly and the charges would be taken off the account. I asked to pay it as it had been a couple of weeks so should be on the system. I was told NO a double payment would cause more problems. The next month I got another letter so I again attempted to pay it online and got the same message. The next month a further letter threatening me for none payment. I rang again and was told not to make a payment as it could be the system and to wait a few more days. This then escalated the charges to the money outstanding. Getting fed up of trying to pay online and on the phone I went into the store and paid for the goods but not the charges and interest. I sent many letters and talked to many people to try and resolve it and eventually it went away. That was until a few weeks ago. My partner told them this and they sent me a letter saying they were investigating. They then sent me this letter : "CLIENT : Phoenix Recoverices (UK) Limited BALANCE : £76.92 Dear Thank you for your patience whilst we investigated the enquirey that you raised with regard to the above account. WHAT WAS THE OUTCOME? We can confirm that as a consequesnce of teh query you raised, the above account has been returned to our client. WHAT DOES THAT MEAN? * We have closed the debt on our computer system and returned the account to our client * No further action will be taken by Wescot Credit Services to recover the above account. Yours sincerely," I have checked my credit file and there is no mention of either Wescot or Phoenix Recoveries. The default was registered by Littlewoods. Can I write back to them and ask them to remove the data from my credit file which incidently says I owe £77 and not £76.92 (not really sure if that makes any difference). TIA Kaz x
  9. Hi All Thank you so much for your replies so far they have been very helpful. I have now received a response off HFO Services which reads : "In response to your letter dated 07 April 2008 please let me advise you that you need to contact Barclaycard directly in order to request for the statements since the start date (31-05-95) to the default date (01-05-07) of this account as your require. Barclaycard can only provide us with the statements that we have forwarded to you. Please call Barclaycard Customer Services department on 0870-154-0193." Not only is it extremely bad English it is also incorrect as the deafault date is incorrect. To me this would suggest that they can't possibly take me to court or pursue the debt any further as they cannot obtain correct documentation except for three lousy statements. I have checked my Experian credit report as I want to clean it up so I can apply for a new mortgage and the default is registered as HFO. Does this mean that they will need to remove this data as per my letter ? Do I really have to go back and ask Barclaycard for statements and a credit agreement as they now don't own the debt or do they ? Does it mean that this debt is now unenforceable just by HFO or is it by anyone ? Any help is very much appreciated. I'm not trying to avoid paying my debts I just object to paying all the charges and interest expecially as they were caused in the main part by their system failures etc. TIA Kaz x

  14. Hi Lula Thanks for that I've found it now doh ! This is almost identical to the letter I sent which they took their time replying to it. Should I report them to trading standards for failing to meet the 12 days plus 1 month ? Is there somewhere else I can complain to ? Kaz x
  15. Hi Lula They only sent 3 statements which were worse than useless and no agreement. Can't they argue that by using the card I accept their terms and conditions ? It's so confusing and these companies really play on that fact. They make me sooooo angry. Kaz x
