  1. Hello. Wonder if someone could give me some advice please.It is rather complicated,and i have very little to go on,but having used this forum for my PPI claims.I thought there are some clever and inteligent people on this Forum. Bit of a long story,but in 1984,my mother bought a property,with her then partner.She had an endowment policy,which she was sold on the basis that there would be a nice bit of money left over,at the completion of her mortgage.However,things didn't work out with her partner,and in 1992 they separated. At the time,my mother could not afford to buy the property herself,i had just moved out of my flat,so agreed to buy his share of the property.We had to remortgage,and between me and mum,we got a £32,000 mortgage.We had a guy come and sell us an endowment policy,again it promised us after 25 years,mortgage paid up plus a nice bit of money left over.We have 5 years left on the mortgage,but have recieved a warning letter saying at present we have a £7,500 shortfall. Mum never pursues anything,she can't remember the name of the broker. all i know is the policy came with Standard Life headed paper.She tells me i'm not affected,as the property was remortgaged.Don't know what this means.What i do know is my mum is now 75.I have been made redundant recently,and i'm worried where i will find the shortfall from.
  2. Mine were paid altogether.Although they did give me a breakdown of what was PPI and and what was credit card charges. My wife had PPI and CC charges with Lloyds TSB .She recieved 2 seperate cheques £7000 in PPI on 3 loans and £5335 in CC charges going back over some years.In ten months between us we,ve recieved £20,097 in total. My wife,like many others didn,t think she would get anything.I had to do her paperwork for her. On Mothers Day she opened her cards from my kids,along with an envelope telling her she was getting the £5335.The other i rang her in her work,told her to sit down,and she burst into tears.   3. M2AE I signed up to an MBNA credit card in 1998.They closed my account in 2008,when i paid up my outstanding balance and told them i no longer wanted the card. You have more information to go on than i did.I had no account number,no dates,times etc. What i did,was download the standard claim form,giving little information PLUS i sent in a SAR as i found it would give me my account number,and showed all tranactions going back over the time i had used my card.You already have statements,account number etc,.In my opinion they should be able to locate policy and ref numbers if you send them the Account Number. Once i recieved all 14 double sided pages of info MBNA were holding on me,I simply sent them a letter i put together saying thankyou for sending me the info,I would now like to reclaim ALL Payment Protection payments they had taken off me ALONG WITH all charges against me on the account,inc LATE FEES,OVER THE LIMIT FEES. A couple of weeks later i got a letter to say that they were not obliged to nor feel it is appropriate to refund any fees which were more than six years old. Four days later i recieved a letter stating they were paying me £3590.69. You have nothing to lose by sending in copies of your details that you have.It may reap you the rewards you deserve.
  4. £3509.91 successfully claimed back from MBNA for Credit Card charges and misold PPI. Credit card dating back from 1998 till its closure in 2008.
  5. Thankyou once again IMS.I guess it is the PPI and the late fees and overdraft fees that i worked out via this excellent site.MBNA stated they weren,t going to pay any late fees,but have now decided to give up. Donation to the site will be given as soon as payment recieved.
  6. Good Morning.This morning i have had an offer on the PPI part of my claim.This is a piece taken from my letter. Total amount of Payment Protection Ins Premiums charged since sale date £1,306.72. Total amount of associated interest £866.99. Applicable 8% interest -Note any 8% interest payment has been paid gross and is potentialy taxable.Therefore you need to inform HMRC of this amount £1,415.20. TOTAL AMOUNT PAYABLE £3,590.91. So could you please tell me how much i will recieve.Is it £1,415.20 or £3,590.91. Thankyou

  8. Thanks for your reply IMS. I am unemployed and in no financial situation to be able to take banks to court.It is tough enough affording postage prices,photocopying etc.but thankyou anyway
  9. Hello.Can someone give me advice please. I have put one claim in for PPI and a seperate claim for Unfair Credit Card Charges. I provided all information to MBNA of every charge on my credit card from 1998 till 2008. I have recieved a letter this morning basically telling me their charges were clear and fair,and they are not obliged to refund any fees charged more than 6 years ago.Their fees are fair,legal and transparent,and are consistent with the OFT,s guidelines. What shall i do next,please

    After sending a SAR request on the 4th Jan.Today i recieved all the information MBNA were holding on me. They sent me details of transactions with my credit card going back to 1998,and up to its closure in 2008. I have totalled up as follows £1287.45 in PPI not inc interest. £536.00 in Late Fees and £610.00 in Over Limit Fees. My questions are. Can i now reply to them with a claim ? Can i claim back all these charges ? Do i send my claim for all these to one place,or is PPI claims done seperately,so have to go to a different address ? The total amount comes to £2433.45 without interest. Do i look to reclaim 8% on this figure ? Thankyou for any help or advice you can give me.

Here is an update on my case.Today i rang the claims dept of the Halifax.Despite me having record of posting their cheque back to them on the 27th Nov,and record of them recieving it on the 28th Nov.They are saying my letter and the cheque didn,t hit their system until the 13th Dec.So it is up to 30 days from the 13th Dec,according to them.The cheque has been in their hands now 24 days tomorrow .To me absolutely shocking.Given that i,m a halifax customer,the cheque is a Halifax cheque,being paid into a Halifax account,in one of their branches,it still takes a further 5 days to clear.What is their problem,are they afraid it will bounce.. Thanks for your reply Gemspan.Yes unemployed 2 years in March. In the space of 4 days i went from being nominated for a national award with my company,for outstanding customer service,to being told i was being made redundant.Life as they say,You never know what is just around the corner.
  13. Hello. Just wanted to air my frustration at this so called bank of mine. I have my mortgage with them, along with my house insurance, I used to have a credit card with them, so i,d like to think i have been a good customer over the years. I agreed to their offer, as being unemployed, any money i could get for xmas would be a god send. I recieved a cheque, however not made out correctly. I contacted Halifax ,who told me ,as it wasn,t made out correctly ,i would be unable to pay it into my account, hence i returned it, paying £5.85 to guarantee next day delivery to them on 28th Nov. They confirm that they recieved the cheque back, but i have been given two different replies as to when i can expect another cheque correctly made out to me. Four weeks and 16 weeks are their replies, as my claim has gone back into a process, what process i don,t know. I contacted Halifax and explained i was unemployed and with 2 young kids and could do with the payment before xmas, Sorry you are in a process now was their reply. I contacted the Financial Ombudsman to see if they could help, they couldn,t, as there is a process, was their reply .So here 25 days after returning my cheque ,i have not recieved another as of today.

  15. Hi All If you look at my earlier posts on this thread,you will see i was given an offer from the Halifax, Via the financial ombudsman. Just to update you,before accepting the offer of £1,417,i wrote back to the F/O just to enquire as to how the Halifax had come to their figure and that i,d never recieved any statements from them. The F/O informed me that they had checked all the documentation and advised me to accept the offer,which i did.. Today i recieved a letter from the F/O to say that the bank will make payment to me within the next 6 weeks. can someone please explain as to why it takes so long to put money in my account when it seems these financial operations are so quick to take money off me.

This is my blow by blow account of the story.i sent a standard letter to my registered Halifax branch,asking for my statements going back 6 years,which i sent via registered post.This was sent 14th April.I gave them six weeks to reply,nothing,no letters/phone calls etc.I sent them another letter telling them they had gone against my request of not responding.I gave them another 14 days to reply,they never did,and to this day i don,t know if they ever recieved that letter.Even though it was recorded delivery,i went on royal mail,s site to trackno sign of it. I then called the Financial Ombudsman,basically telling them i didn,t know what to do or how to go about tackling the Halifax.I filled a brief form and returned it to them.I then had a letter from the FO to say they had written to the Halifax,asking them to explain how they come about charging me my charges.In the meantime i had a letter from the Halifax saying tough basically and their charges were fair.I passed this back to the FO.Who then wrote back to me saying they had written to the Halifax again and would be in touch within 6 weeks to let me know how things were progressing.Then this offer today.That is EXACTLY how this has progressed.No statements my friend,didn,t cash my £10 cheque.

Well, as Cilla would say Surprise Surprise to me today,i got home from work to find a letter from the Financial Ombudsman via the Halifax,who have offered me £1.147 to settle the dispute.I now have ten days to consider their offer and must get back to them with a signed acceptance form.If i accept their offer. Sure its great,that would be my holiday spending money,However.......The Halifax have never sent me copies of my statements,i don,t have them either.I didn,t have a figure in my head of how much they owed me.So how do i know if they are offering me the correct figure,or they are just in a hurry to pay up thinking i will accept because of the OFT test case,ie i get my money quicker
  19. Yes it was,so if the banks are not refunding bank charges,what is there to stop them continuing with their so- called goodwill payments.A different thing isn,t it;)

I wrote requesting statements at the begining of April.Did everything as per instructions on this excellent site.Sent all letters via recorded delivery,and got nothing until i got the standard letter arrive one day telling me that the charges were fair,that came in June.I then got the Financial Ombudsman involved who i sent all documentation i had to them.again the FO have been great,they sent me a letter 2 weeks ago telling me they had written to the Halifax to explain how they had come about their decision,and that i wanted a full refund of my charges plus interest.So now i just have to wait and see what happens,while the Halifax quite merrily carry on putting charges on my account.

Apologies if this sounds a bit daft,but if the banks win their case,how can they justify paying out to some and not to others .Don,t get me wrong,good luck to those who have recieved payouts.My case now on hold.But if the decision comes back that the banks have acted fairly,and won,t pay out any more.Are they discriminating against some of their customers
  23. Hmm . This is interesting I sent a letter to my local branch via recorded delivery.Only 29 miles from where i live.Took 5 days to get there.I had no response from the Halifax.The 40 days were up so i gave them 7 days to respond.They still didn,t reply.I checked the tracker,there is no trace of them signing. I then contacted the Financial Ombudsman on Tuesday of this week to complain.They picked up my complaint and have contacted the Halifax via letter which they would have got on Thurs of this week at the earliest. Today i recieved a standard letter.How do i know,its the photocopied edition that must be the one most people have got.Basically they have investigated my complaint going back 6 years in less than 24 hours.Then moving on to tell me i agreed to their Ts and Cs and it was down to me to keep my account in order.if i need greater flexibility then extending my overdraft facility. They then tell me if i wish to pursue this,watch out for unauthorised 3 rd party fims. Will go back to the Financial Ombudsman now on monday. Any advice on next steps please,and is this the standard letter? seems like it to me

Please advise me.My 40 days were up last week,nothing from the Halifax.Sent my letter along with payment regiistered post.They signed to recieve it,got confirmation.Haven,t cashed the cheque.Last week i sent them a further letter registered,to remind them that under the Data Protection act,that they had broken the agreement of supplying me with my info in the 40 day period.i gave them a further 7 days to respond to me otherwise i would be taking the matter further,no reply,nothing. What do i do next
