  2. Hiya everyone Well i sent a letter to Lloyds solicitors accepting their offer of £2088.45, and the money is now in my bank!!! Excellent! What i want to know is how do i end the claim online? Or do i need to telephone the court? Any help greatly appreciated. Also this claim is now SETTLED, how do i get it moved into the 'WON' claims section? Thanks in advance
  3. thanks for all your advice, ill give you a few more facts. My claim is for £1849.00 purely unpaid d/d charges, nothing else apart from the 8% interest when i made the claim through moneyclaim. Charges £1849.00 Interest £220.00 approx Court fees £220.00 Total = £2289 Offer is for £2088.45, so £201 less. Im inclined to accept this, but im worried about the conditions. They are requesting that i attend a banking review within 14 days, which is fine because once this money is in im going to close that account (don't need it anymore, havent used it for a while because of the charges) Another condition is confidentiality, if i disagree with this will they withdraw my offer? And another if that this is a full and final settlement of this claim and any future claims against Lloyds. I can't see me needed to claim against Lloyds again so im not sure why this is a condition. Also the letter says: Please let us know whether you are prepared to settle the matter on these terms. If i write to them saying i accept their offer but not the conditions, is it likely theyll still pay up? Sorry for all the questions, i'd like to have this settled asap but i want to make sure i get everything correct. Thanks for all the excellent advice i've been given already
  4. Any advice? please help! Thanks
  5. Hello everyone, i need a bit of advice please. deadline for AQ's is Monday and in the post today i rec'd a letter from Lloyds solicitors saying that they are prepared to offer me £2088 (claim is for 2225) Also there are conditions: confidentiality, accepting this offer in final settlement of this claim and any future claims, and keeping the account in order in future. Should i accept this offer? I don;t want to and would like to go for the full amount but would rather not go to court (would do if it went that far though!) Also they are asking me to contact my local branch within 14 days for a banking review! Do i have to do this? i will be closing the account once the claim is settled. What is my next step, is there a template to refuse the offer and conditions? Or should i accept as a partial settlement? What are the implications of this? Do i need to pay more to amend the amount on the court claim??? Any advice greatly appreciated. Im popping offline for a bit but will be back on at about 6ish. Thanks in advance!
  6. Thanks so much ill post it tommorrow. Is there a covering letter template on here, to ask for a copy of theirs? Thanks so much again, was panicking again then!
  7. Just bouncing this post up because i think i've made a huge mistake. I ec'd the AQ and posted it back to them straight away, on 11th January, anyway the deadline to get it back was 27th January, i sent i recorded so it must be there now. BUT, i forgot to send a copy to Lloyds solicitors... ARgh! Now, i did take a copy for myself before i posted it, so is it okay to post it tommorrow or will that be too late? Also if i post the copy to Lloyds solicitors tommorrow, what happens on the 27th, is that when i will receive a court date? Will this mess up make my case more likely to end up in court? I feel so silly now i've made a stupid mistake, and ive read the FAQ's a million times, so i knew i had to send them a copy, i just forgot! So angry with myself! Thanks
  8. Yes it is the 9 point one. Thank god its the standard one, im paranoid theyre gonna make an example of me in court, and my banking history has been pretty dire! Thanks for all your help.
  9. Ive received the AQ and a copy of Lloyds defence. How do i know that the defence filed against this case, is the standard one everyone else has had? Im just trying to work out whether its likely mine will go to court. Thing is the defence is really long and will take me ages to type out. Basically in a roundabout way it states states that the charges are not penalty charges and we can avoid them by keeping the account in credit, then it refers to he terms and conditions we agreed to and right at the bottom it says that the claim is denied in its entirity and further denied that the claimant is entitled to the sum claimed or to any sum from the bank. Is the the norm? I keep thinking im gonna end up in court (which im prepared to do) but still not receive the money back. Please help
  10. Just read this on my moneyclaim. Ill sit tight then. The Defendant disputes the whole amount you have claimed. Your claim cannot proceed online and will be transferred to the appropriate court for continuation. You will receive confirmation to where the claim has been transferred to shortly.
  11. Hiya everyone, Lloyds 28 days deadline is now up, should i just sit tight and wait a few days for the AQ to arrive or do i need to do anything else? Thanks in advance.
  12. Just bouncing this up again, not sure where to go next with this.
  13. Also should i send the prelim to our local branch, where we sent the SAR? Or should we reply to the address on the bottom of the covering letter shich was with the bank statements, this is: HSBC Bank Plc Harry Weston Road Binley Coventry CV3 2QT Thanks in advance.
  14. Hiya im posting here with regards to my husbands claims with HSBC. We sent the SAR request on 14th December and on 30th December we received their reply. We asked for documents relating to his current account and also his credit card account. The bank account statements arrived in full, and we have worked out the charges to be around £520. However with regards to his credit card account, we have received a seperate letter which says: I am in receipt of your recent letter requesting all statements in respect of your credit card account. Unfortunately, on checking our files, we do not appear to have any credit card accounts listed in your name. To enable the bank to proceed further with your request, I shall be grateful if you will provide me with either a copy of an old statement or your credit card number. This is where our problem is, we did not have either of the account numbers and they managed to provide us with bank statements but not credit card statements, which i think is odd. Now on one of the bank statements there is a partial account number from when my husband paid his credit card using his debit card, but 6 digits are starred out. We know it was a mastercard and was held around the same time his bank account was open. How should we deal with this? I was thinking i could send them a letter quoting the partial account number but im not sure this would be enough. The only other option is to abandon the idea of claimimg the credit card charges back (we know there was quite a few, probably another £500 or so). Any help is greatly appreciated. In the meantime i will send the prelim for the bank account charges. Thanks
