  1. Yeah i've very similar fun with Smith Lawson and now CapQuest... I CCA'd them on the 11th last month and they put my accounts on hold while they 'looked into my request'. They're now well over the 28 day limit set out in the CCA request. All my loans are from 95/96 and given CapQuests lack of reply its starting to look like they don't have any copies of my paperwork.

Sorry I did mean bank, but realised after posting that I'm on hold till the test case... so instead of my bank i've CCA & SAR'd both MBNA and the Student Loans company as they'v stung me with charges galore lately. I've also wrote to MBNA asking for them to stop calling me, and to clarify where I stand with them in terms of the payment schedule. Its the amount of differing views i've had from MBNA thats confused me, plus i've never had anything in writing from them.
  3. And it seems my local courts are still processing claims so i'll get my £2500 claim for my charges back from my bank in motion
  4. Cheers Guys, I realised afterwards that I should have asked for it all to be backed up in writing but it all seemed to be in place so I wasn't overly worried... I seem to get a different response everytime they call me, but its good to know I can tell them to stop harrassing me at 9pm at night I'll write it all down and send it off and see if I get a response, no doubt by phone again!
  5. I recently defaulted on my MBNA credit card due to a combination of my bank [Edit] bank charges and my wife only working part-time for a period. I explained this to MBNA who set me up a short term payment plan. But a couple of months into this I was contacted again and told that this wasn't enough to which I first sent in a budget statement explaining the situation again and why I could only afford what I was offering. Subsequently I got a phonecall from someone nice who agreed with my budget, took an initial payment and setup a direct debit. But my DD wasn't setup in time to catch the next months payment so I had to contact them to pay only to be told via email they wanted £95 not £60 before they'd even look at my case which I thought was all sorted. They've taken my direct debit for this month but due to the postal strike i've not had letters from them about the previous month. I have a reference number and a name for the agreement I setup but nothing in writing from them. Has anyone any tips ? They've been hassling me with texts and messages ever since I agreed a payment plan with them. In fact twice they've rang after i'd setup the direct debit and my wife has answered and said its sorted, 5 mins later they call back and say 'oh yeah he's no need to ring' but no apology for chasing me endlessly.
