Hi Nicsussex thanks for you help, It is very reassuring when someone adds to you thread it can give you a real boost paricularily when you may be flagging a bit. Hi All, sent acceptance letter to SC & M, as instructed,no conditions 6.06.07. Missus checked her acount this morning 16.07.07 Amount Paid in Full to her account :D Bad News won`t even give me the price of a pint for all me hard work. Sent Notice of discontinuance letter to Court and copy to SC & M.16.07.07 Thanks to Nicsussex and Barty who contributed to thread and all those who answered my questions on other threads and CAG Top site! Will try to lever out a donation for CAG Not leaving just yet two Sis in laws are on me case for assistance. Five other threads on the go. I might even be able to help somebody else on the way My advice, read the FAQs and stick to the letter templates and read a little bit more. Patience my friends Patience and read a little bit more. Bookworm U got it wrong, could U please sort it out I have two SIS in Laws (L) & (T) Both have threads under Barclaycard differnt accounts at different stages One has thread under ABBEY also(About to issue N1 Notice) One has a thread with Halifax(preliminary Letter) Oh and by the way did one for missus with Lloyds TSB (N1 AQ ETC just recieved an offfer) Oh nearly forgot the one I forgot about for my self. MBNA reminded me with an offer. So you see they only rick I made was quoting a cleared transaction,originally from Abbey statement in a Barclaycard Thread. I then went to my Sis in Laws Abbey thread and posted the question there. So to clarify my Sis in Laws thread(L) & (T) are entirely DIFFERENT THREADS:mad: Please look at the titles of the threads Any chance of putting it right Biff the Bro in Law of many different threads:) phew! ps TRUCKER no does that clarify it. -
Hi All, my Sis in law has numerous "cleared Tranactions" £10.00 on her statements. Can anybody tell me "what they are" and "can she reclaim them?" Just about to send N1 Notice and don`t wish to cock it up! tia Biff

Hi All, starting this for Sis in Law(L). Just a quickie, is it OK to claim for Cleared transactions @ £10.00. She has got plenty of these. In addition, she has got a lots of CASH ADV/CHQ HANDLING FEE £2.50. on her statements. Can we claim for these and or does this support the argument that any figures above this are disguised penalties? Have Barclaycard shot themselves in the foot by stating handling fee £2.50 on thier statements? Welcome your views Biff the Bro in law:)

Cheers Dusary & Moneyhelp, thanks for the support. I have had a bit of experiance with Loyds TSB for the Missus. N1 ,AQ etc. recieved an offer for full amount just waiting for the wedge. Case still proceeding though untill we do! Sis in Laws seemed to get a lot more friendly after that? :o As a result 1 x Halifax Card service 1 x Shabbey 2 x BarclayCard Oh and 1 with MBNA for me which I forgot all about till the sent me an offer:-D I`ll have to improve my filing though:) CU soon Biff -

Thanks Barty, will send the acceptance letter as suggested. I`am not going to count my chickens just yet or thank everyone as I might still need them. I rang the Court 4.06.07 just for an update. The Court manager said that my/her case was going before the Judge for a hearing date. Hopefully, we will have been paid out by then. Is it worth while notifing the Court asap or should I continue with the claim untill I receive my "returned charges?" In addition, my Misses is starting to take an interst now, wonder why? Biff -

Hi All, Quick update, just received a letter from SC&M dated 28.06.07 Strictly Without Prejudice Confidential. Lots of pontificating but the interesting part page 2 goes something like this "Accordingly the Bank is, without prejudice, to the position set out above, willing to pay you £xxxx.xx you are claiming by way of Bank charges and interest of £xx.xx plus court fees of £220.00 in a full and final settlement of your claim." (total comes to everything) It then goes on to list 7 points that we must agree to and the final paragraph says "Please let us know whether you are prepared to settle the matter on these terms. If so, the Bank will arrange to credit the above amount to your account. If you are willing to settle on this basis, please sign a copy of this letter as confirmation that you are bound by its terms, and return it to us as soon as possible. We look forward to hearing from you at the earliest convenience but no later than the 12 July" Does this mean what I think it means:-D !!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!? -
Hi Scouser Abroad, I think this is the thread for the Frequently Asked Questions. Have good read of it. Then use the templates library for you letters and remember its you who will dictate the pace not the Banks. Received a reply from SC&M dated 28.06.07 in response to my AQ sent 20.06.08 --------------------------------------------------------------- We act for Lloyds TSB Bank plc (the Bank) We have been passed a copy of proceedings that you have issued against our clients in St Helens County Court. The Bank will be defending these proceedings on the following grounds. 1. The fees that you seek are properly incorporated into your contract with the Bank: and 2. By making payments (weather by cheque, debit card or any other means) from your account where you have insufficient funds to cover them, you are making a request to the bank for an increased overdraft, which the Bank may meet or decline. If it meets your request, you must pay the necessary charges. The issue of penalties only arises as a matter of law, where there has been a breach of contract, and there is no breach of contract here. Looking ahead, a situation which gives rise to a dispute is not one the Bank wishes to continue. In view of this, you are requested, please, to make contact within the next 14 days with your local Lloyds TSB Branch Manager, on 0845 3000 000, to review your account. A review may be useful to consider whether your current banking arrangements are the most appropriate for you needs. We wait confirmation from the Bank that this action has been taken. Yours etc etc SC&M -------------------------------------------------------------------- It would appear that the 9 point defense, that they used to use, that dropped to 3, has no down to 2 key issue. Thanks Nicsussex, still a little worried about My LlOYDS TSB 3 point defence? Is this a first or have Lloyds or the Court forgot to include something, like points 4-9, or can they just change thier defece when we go to court? Would wecome a response? Biff
