  1. So i should just continue ignoring their letters and maintaining my repayments?

UPDATE I received a letter today saying 'Your account has been passed to the Intrum Legal Department' etc etc and i have 10 days to respond to their letter etc etc. I now think i know why they are suddenly chasing me, sending me loads of letters. Having looked through recent letters they sent me i discovered a letter headed 'Broken Repayment Plan': stating that i had missed a payment towards my repayment plan, resulting in its cancellation, and that i need to get in touch with them within 10 days to reach a solution. I normally pay them on the 25th of each month, and its true i overlooked the payment that was due on 25th April 2018. Once i realised this i made the payment - it went through on 3rd May. Their letter to me was dated 4th May. I have maintained my monthly payments since that one oversight. I know they are receiving my payments as its reflected in the balance in the letters they keep sending me. So here are my queries: Can they take me to court despite me maintaining my payments? will they argue that i have broken my repayment plan with that one late payment? Will the next step be a Letter Before Action from Intrum if they are going to take me to court? Many thanks in advance...
  3. I can assure you i havent blindly paid anyone at all. All the documentation i requested was provided, and this is a debt i fully acknowledge and intend to pay back - simply on my terms though, not theirs.
  4. Yes I get an annual statement showing my payments - or at least i used to from 1st Credit.

  6. Original debt was with Barclaycard - a credit card debt. I fully acknowledge the debt and i was repaying on an agreed payment plan, since 2008.
  7. Hello everyone I have a very old debt that i have been paying back (for nearly 10 years) to 1st Credit until recently. Few months ago i got a letter saying 1st Credit has now been taken over and is now known as Intrum. No problem there - continued paying as normal. Now i am getting the usual series of letters from Intrum asking me to get in contact with them - all of which i have ignored as i havent stopped paying them monthly. The latest letters are now at the stage where they are 'going to pass my account to their Internal Legal Dept.' etc etc. Am i correct in thinking they dont have a leg to stand on if i havent missed my payments? Is this their usual threating rubbish in an attempt for me to get in touch with them? I personally think that they want me to up my monthly payments (i am curently paying back £25 per month on a £1800 debt). Any advice would be greatly appreciated. Thanks in advance.

  11. Hello everyone Quick overview of my situation: I entered into a debt repayment plan with my Capital One Credit Card in May 2007 - at the time i owed them just under £900. Since then i have duly paid them an agreed sum every month as well as a few extra lump sumps whenever i had a bit spare. At this moment in time i now owe them £300. £280 of this is made up of late payment fees and overlimit fees. The advice i would like is .. ...'is it worth me claiming these back to reduce my debt to them?? ' Bear in mind this is a credit card - no overdraft fees or anything like that. Any advice on my chances of success would be much appreciated. Many Thanks
  12. Hello again all and thanks for your replies. To answer a few of your queries: Ever since i stopped using the overdraft on my Abbey account, i have not paid them a penny. My thinking was, well if they cant be bothered to even reply to my repayment proposal why should i bother paying them? Maybe not the best course of action to take, with hindsight. I was sent a letter on 29th Oct 07 serving as a notice of Abbey's intention to register a default on my account within 30 days, etc etc.. The next letter i got after that was from their in-house collectors Debt Management & Recovery Services, headed 'Default of Payment'. These were the ususal bog standard unsigned computer generated letters that are churned out. The last two letter were from Debt Managers Ltd and they started arriving at the beginning of February. In the meantime i am drafting a letter to Abbey reminding them of their responsibilities to reply to my correspondence regarding my repayment proposal, as per the banking code etc etc. I am also asking them for confirmation if the debt has been sold on to Debt Managers Ltd or if they are merely collecting on behalf of Abbey. I am also going to start paying my monthly repayment proposal to them starting at the end of this month, regardless of whether or not they reply. Best course of action for the time being methinks.
  13. Thanks for your reply Elizabeth1. Yes Debt Managers Ltd are a DCA. Hopefully someone who has a similar experience to mine will be able to give me further insight.
