  1. I just read a big piece in the Mail about all that went on, so between you and the paper it makes more sense - so thanks for explaining it . Just one thing tho, if they are told no they cant appeal to HOL, mine still stands eventhough its stayed etc. Sha

Hiya all, Havnt been on for a while, needed a new comp.... been trying to follow wots been goin on with the banks and the appeal etc and after reading about it yesterday, I am now wondering if i should be doin something or still just sit back and wait??? Mine is one of the many stayed claims. Many Thanks Sha
  4. Have just rung the courts again!, asked why I wasnt granted a hearing when I know others have been given have. Explained (again) the situation and she said I should have had a hearing if I asked. So she took my number, going to get my file out to "check" my ammended form was given to the judge and going to ring me back later today. Sha
  5. Hi MB, Nope, not heard anything since I rang explaining I asked for oral hearing re the stay. Is this the first you have had or did you have a letter saying your application wouldnt be heard and then appealed against it?? Sha
  6. I just rang the courts Pete, explained what i had done originally and then went to the court to get it altered. I was told that both would have been put in front of the judge, when i asked why both would have been given to him, he could offer no real explanation other than they would have been submitted as one. Now i am wondering if the ammended one was looked at, or if it was - wondering if i will get another letter saying i will get my hearing!!??!! Sha
  7. I originally sent in the form ticking the "without a hearing", then went in to the court (after reading some of the other posts) and changed to with a hearing and an additional note.

  9. It says:- 1. The submissions be treated as an application to remove the stay in the order of 3/8/07 2. The application be refused. 3. As this application has been refused without a hearing, either party may apply for the application to be reconsidered at an oral hearing. Any such application shall be on notice, and is reserved to judge hendicott or hickinbottom unless expressly released by either. So not sure what i do or what to do re the last paragraph, another knockback grrr
  10. Hi all, Have just managed to get up to date with everything (phew....didnt realize how much i'd missed!). Well, today I received a letter from the court informing me that my application for removal of stay has been refused. So, do i now just sit and wait for the outcome of the test case? Thanks Sha

  13. Hi Old, I rang the court this morn and he said not to bother changing it as the judge would decide the listing. Its on my thread welshbaba 'v' hsbc. Havnt decided what to do tomorrow yet, need the head to stop spinning so the brain can calm down...lol Sha
  14. Well, have just rung the court to get n244 changed to have a hearing. Friendly enough chap (Lee) on the phone said that it couldnt be changed as when the judge looks through the applications he will then decide listing. Asked how long before we should expect some sort of reply and he said 2 - 3 weeks.

  16. Freaky, q3 - is this agreed by all parties? y or n - assuming this is no q4 - give dates of any trial or fixed trial date - think i leave this blank but want to check apologies if i have answered my own question, but want to check with someone a bit more clued up. Thanks FL

  19. After reading through all the threads about turning up tomorrow, Im still unsure what to do. My head is just in a constant spin!I'm going to ring court to ask them to change to hearing as i did the same as alot of others and ticked "c", also my letter to go with it was quite basic - nothing like the template now, can i just send in a new one (afterall there is no charge)? Sha

  21. Mostyn, i'm not really sure what you mean about attending the hearing still, i thought they were stayed. I sent off my removal of stay etc yesterday (6/8/07), told no £35 fee. Whats the £30 you are talking about. Sorry if i'm being dim, just want to understand fully. Have I now done something wrong then? Thanks Sha
  22. Thanks Jo, just seems really quick....if they can write to the courts that quickly how come they couldnt send us the letter at the same time. Ah well now its sit and wait time again Sha
  23. Do DG have to contact the court to request the stays or do the courts just decide? It just seems that after the case everything was suddenly "stayed". Am i suppossed to hear this from dg aswell as the court Sha
  24. havnt received written notification of stay, but verbally on the phone, sent in the removal of stay thingy and evidence etc. Now this is where I get a little confused:confused: , so bear with me....... how does the next bit work? like i said no letter as yet, so how long would it take to grant (fingers crossed) my application? sure i read somewhere that you would still end up going on your original date if this was the case - date which is only 8 days???? Apologies if this sounds a bit backward Thanks :-? Sha
  25. Yep, you are right Andy. I rang the court to check about the £35 and was told in all the bank charge cases the fee is being waived. One bit of good news at least!! Sha
