  1. Also, why did they wait 40+ days from their last letter, when they gave me 7 days to reply before they will 'commence action without further reference or notice' ???
  2. OMG! How dare they ? Have just received notification from HL that they have been instucted to issue proceedins against me thru County Court. Once this proceeds they will claim statutory interest on the sum of 20,876 increasing my overall liabilty to 41,905. Without a meaningful repayment proposal the action described above will commence without further reference or notice.
  3. HERE WE GO AGAIN !? Since my last post : 17th April - letter from Halifax stating that HL Solicitors are now dealing with this matter. 28th May - letter from HL stating we are instucted by halifax 'Blah Blah'... pay a lump sum or monthly payments ... our client is sympathetic to your situation and any reasonable offer will be given serious consideration ... hear from you in 14 days. 12th June - letter from HL .. disappointed you have not replied to our letter .. 'Blah Blah as before' ..response in writing within 7 days. 19th June - letter from HL ..in the absence of contact we are left with little alternative to revert back to our clients for further instuctions which are likely to include the issuing of proceedings .. 'same old Blah' ... give this matter your immediate attention. 27th June - letter from HL .. you have no intention of attempting to resolve this matter ... due to you lack of co-operation our client is now giving serios thought to recovery of monies due by way of court action .. on obtaining judgement we are instucted to commence ENFORCEMENT ACTION...action will commence in 7 days without further reference. What is my next step --PLEASE HELP!!
  4. My OH has an account with Westminster Collection Ltd. They send out coins etc. on a regular basis for sale or return. He has purchased many items over the past couple of years and always paid promptly. He has even asked that they STOP sending items he has not specifically asked for but they say they can't do this as its part of the T & C's. The last shipment was in November which my husband duely returned. Unfortunatey, my husband can't find the slip from the post office. Does this mean he'll have to pay for the goods. It's over £100 to which they have now added another £30 to be paid within 7 days before the account is passed to a debt collection agency. He has previously only spoken to them on the phone disputing the debt so can they still send it to a DCA. What should he do now?

  6. I am self-employed working P/T as an agent for a company earning commission only. Will they want an attachment of earnings before they offer F & F or can I just throw a figure at them? DCA aske for £5000 about 5 years ago but I was in dire straits at the time.

  8. This was a re-mortgage on the property in oct 1990. The last payment was made June 1993. I moved into rented council accomodation in august 1993 and handed back the keys. Why was a possession order enforced in oct 1994???? What happened in those 14 months????

  11. Yes, but it seems their response is via CIS. They say they have had a full response from Halifax and have confirmed authority to act on their behalf: If you require a copy of the Mortgage Deed you must contact the Land Registry. I enclose a copy of the Mortgage Conditions in place at the time you obtained the mortgage. Dsar documents were sent to you on 11th Jan. 2008. Amongst these were Account Reports showing payments and debits made during the life of the mortgage. Also a list of payments made since the date of sale to the final payment Apr. 2007. EOS closed their file and referred back to Halifax as your payments ceased. Halifax has not disclosed any personal data to a third party. Civil Procedure Reforms state legal action should only be used as a last resort, placing emphasis on disputing parties to reach an amicable settlement by way of negotiation. This has been the aim of the halifax since the outset. As the Halifax's internal complaints procedure has not been exhausted, could you advise them of your actual complaint so that an attempt to resolve it internally can be made. I enclose a copy of Halifax's complaint leaflet. Last payment made prior to possesson was June 1993. Final payment towards shortfall was April 2007. Possession Order enforced Oct. 1994. Property sold Dec. 1995. Valuation obtained on possession £35,000. The completion statement shows cost incurred in maintaining property during possession and sale. (£4216.91) Property marketed at £36,500 by estate agent in line with normal procedures. Due to lack of interest there were several reductions made and an offer of £24,500 was accepted in Oct. 1995. According to Halifax's records a claim was not made against the mortgage indemnity but this is being investigated further. Interest is calculated on the outstanding balance up to the date the proprty is sold, and after this date, as a gesture of goodwill, interset is frozen to allow negotiations. Interest will not be charged on the shortfall unless court action is commenced, then statutory interest of 8% per annum is charged. I trust this answers your queries and look forward to receiving your proposals for the settlement of your lialbility.

  13. Can I demand a copy of the original mortgage agreement before I proceed any further/ Also, what puzzles me is how, when and why it changed from Leeds Bld. Soc. to Halifax?? HELP!!!!!!!!!!!!!
