  1. i recieved a court date after confirming the exact ammount that i was asking for. i contacted the bank solicitor and gave them a detailed run down of the ammount that i was asking for and the reasons for the charges ie returned direct debit, overdraft excess fee etc. the solicitor contacted me back within 2 hours and confirmed payment in full, which was in my bank account immediately £4.500.00. grrrrrreat:) :) :)
  2. the court hearing was in CARDIFF and due to the large amount of people attending the judge had everybody in the court room. it was not intimidating at all. the atmosphere was very relaxed and i found it amazing that the solicitors, who i thought would argue the banks case of it being lawful didn't. they would just stand up if the name was on their list and ask for claim particulars. so word of advice MAKE SURE THEY HAVE A COPY WITH EVERY LETTER YOU SEND THEM. this will prevent them from misplacing the original copy you send with the initial request for the funds to be returned. the judge gave the claimant 28 days to provide claim particulars (the amount you are asking for and a break down of interest). if the bank had any objection to the amount requested then they had a further 14 days after to 28 to enter a new defence. the judge advised that this very rarely happens as the matter is resolved within the 28 day period.
  3. Went to civil court yesterday. There were meant to be 160 people there. Only 60 turned up because the rest had been paid out. NOBODY LOST!!!, there were solicitors from the banks, but they were only there for a handful of cases and were only asking for confirmation of claim particulars. they were then given an extra 28 days to receive them from the claimant. There were no arguments from them regarding the banks being entitled to the money. everybody was stood in the court room and the judge would just call out a name. the solicitor for the particular bank would say whether he had the name on the list. if not the judge would then authorise the funds requested and court costs. if they were on the list from the bank then they they were given 28 days to provide particulars.
  4. i used martins templates and included interest using the calculator provided. i am now hearing of persons losing in court on technicalities. what could they be??
  5. I AM GOING THROUGH THE PROCESS OF TAKING LLOYDS TSB TO COURT. THEY HAVE TAKEN £5250.00 IN CHARGES FROM ME OVER THE LAST 6 YEARS. THEY HAVE SENT ME A GOOD WILL GESTURE OF £750.00 DURING THE INITIAL CONTACT. THIS HAS BEEN HANDY IN PAYING MY COURT COSTS. I HAVE DEDUCTED THE AMMOUNT FROM THE OUTSTANDING. THIS HAS NOW TAKEN ME BELOW THE £5000.00 SMALL CLAIMS CUT OFF. I AM IN COURT THE END OF THIS MONTH AND WOULD BE GRATEFUL FOR SOME ADVICE ON WHAT TO TAKE AND IF ANYONE HAS BEEN IN THIS POSITION ALREADY, PLEASE TELL ME WHAT HAPPENED:confused: :confused:
