  8. Kapital did this with me , removed the account from the CRA's and then a few weeks later sneaked it back on again.
  9. So far they have been unable to provide me with an Agreement or anything else for that matter. I have asked them on more than one occasion to confirm who owns the debt as I need to establish who I should direct my claim to for refund of charges as the entire debt is made up of charges. To date they have chosen to ignore the 5 letters I have written and I now have a letter saying that they are taking legal action against me but they will first carry out a credit search on me so they can determine the best course of legal action to take. They have made it clear that they wish to establish whether I own my own house and the amount credit that is available to me.
  10. Can a DCA or the solicitor of a DCA carry out a credit search with the CRA's without my permission. I have a DCA's solicitor saying that they are going to carry out a search on me. I am trying to build my credit score up at the moment so the last thing I need are searches carried out that I have no wish to be on my file.

  14. Letter gone off to Natwest for refund of PPI charges on credit card, just have to wait now and see what happens. Is there a calculator anywhere where I can work out what is due. I have asked for the monthly payments, the interest that would have been charged on those payments and as the money is rightly mine interest for the duration that they have held this money. If they agree then from what I can tell they will make an offer or 2 first, but not knowing what the real figure is it's difficult to gauge any offers they make. The monthly payments I can work out that's the easy bit, its the interest added as a result of these PPI payments and the interest i'm claiming from the point of payment to date that i'm stuggling with. I knew I should have paid more attention a school. Thanks
  15. I have an old Natwest Credit Card account dating back from 2000 to 2003. I realise that any late payment charges will now be Statue Barred as they have exceeded the 6 year limit, which is a pity. It was not that long ago that the PPI insurance mis-selling came to the publics attention, and it is only recently after looking I have come to realise that the monthly Credit Card Repayment Protector payments I made were wasted as the policy would never have paid out as I was self employed. Is it to late for me to try and claim these back from Natwest due to the mis selling of these policies over the years. Any guidance with this would be appreciated. Thanks

I have written to HSBC requesting them to remove all data they hold on the account from both there system and to instruct the CRA's to do the same as they are unable to supply me with either the agreement or default notice. Should I wait for this to happen before making an application to have the CCJ set aside or go straight ahead and make the application. To my advantage HSBC have put in writing that they are unable to provide a copy of the default notice served, due to the amount of time that lapsed which would have been around 2004. Given that HSBC have admitted not having a copy of the default notice, is that enough to support on its own an application to have a CCJ set aside. Any help with this one would be appreciated.

Well despite sending Lowells a DPA request which they have not even acknowleged, let alone sent any documents, I now have a letter from Hamptons Legal who are a division of Lowells threatening me with court action. Not to sure how to play this but I am tempted to write to Hamptons and tell them how Lowells have not complied with my DPA request, which i'm sure they already know as as they are an internal part of Lowells; ask the question how can they process my data to the CRAs without any proof that they are entiitled to, and as the outstanding balance is made up of bank charges then I shall submit the charges claim directly against them rather than the original creditor. If Hamptons still wish to issue proceedings against me then I will welcome this action. Any thoughts on the best way to play this one would be appreciated.
  20. Thanks johnnymitch, that was a great help. I shall write to HSBC today and ask them to remove not only the default but the total entry from the CRA's as they have no agreement for the account. I shall start the process today with Court to get the CCJ removed as well. I know this will mean I will not be able to claim back any charges and payments I have made to date under the CCJ are lost, but I would much prefer to get that CCJ of my credit file as this will be of more benefit in the long term.
  21. I have received HSBCs response to the CCA request I sent regarding my current and Flexiloan accounts. HSBC have sent me the statements for both accounts. HSBC have sent me the Agreement for the Flexiloan account but not the current account. Regarding default notices, HSBC say, 'Unfortunately, I am unable to provide a copy of the default notice served, due to the amount of time that has lapsed'. Incidently, the account was closed 2004, so I think they should have the default notice on file still. My questions are: 1. As HSBC are unable to provide a default notice, let alone the signed Agreement can I get this account or just the default removed from the CRA's. 2. HSBC got a CCJ against me for this account, which I am paying monthly, where do I stand with having this CCJ removed given that HSBC cannot provide me with an Agreement or default notice. Any guidance would be appreciated.
  22. I have a phone on Orange and 141 has always worked for me, I used it only last week. My home phone does not accept witheld number so I always test by phoning home first. I also have a phone on T-Mobile and that does not work.
  23. Point taken, thanks ODC. I will send the original Creditor an SAR today. My concern is though that in the interim whilst I am waiting for the SAR from the original creditor this will not stop Lowells from taking further action even though the full amount is made up of charges. It appears Lowells can continue to chase without the need to prove they have any legal right, a letter from them saying that they can surley is not sufficient.
  24. Actually is there anything I can do to stop Lowells in there tracks and force them to transfer the account back to the original creditor. It would make the process for me a whole lot easier in being able submit my claim for charges directly with the original Creditor without this lot on my back for the money.
