  1. Thanks for your responses, the letter did say this was there final response regarding this matter and they kindly sent a "how to sort out your finances" leaflet! I think we will just wait on the main case to get settled now, nearly all the charges are prior to July 08, we sent them a letter blasting them for adding charges and interest and then thanking them in advance for there inpersonal automated response...not only did we got no response nomore interst or charges or threatening phonecalls have been made thankfully! Thanks for all your help!
  2. Hi all, first time post so bear with me! I have been help[ing my brother in law put his claim into Barclays for bank charges, the total charges are amounting to approx £1700 and we added interest and court fees etc on and the claims up to about £2300 now. The claim was stayed as all the others were and recently on the advice of the CAB we put in a hardship claim. Barclays have sent a letter saying as a 'goodwill gesture' they have paid £1110 into the account. This is a start but I wondered what your advice would be for the next steps? SHould we just wait until the test case has finished or wrtie to Barclays. The letter from the bank said that they were paying hte money in to the account and basically if we were not happy with that they contact the ombudsman as they were going to do nothing else. ANY help greatly apprecaited, thanks
  3. HI all, Thanks to all who replied previously, i went to court with my friend, all was fine. Met a few really nice people. Well done to srfrench i particulalry like when they tried to make out that they had paid you in full, when she said she was trying to strike out your claim and then you said you where applying to strike out the defence that was particularly impressive, also thanks to the gentleman who got the round of applause for basically having a go at the hsbc guy! On a more serious note, as the barclays rep. didnt notify people about the application for a stay and didnt apply in court, or couldn't!, he is going to do so in the next week, is anyone else going to object, templates on the website coming in very handy again, i think he thought we all were going to consent to the stay. Any thoughts appreciated Regards and thanks again!
  4. Hi, cheers jenny for your support, all advice greatly appreicated. Will he have to say much, anything, should he try and refuse the stay or not, use the time to get a bit more prepared??? Can i go with him? Thanks
  5. Hi, PLEASE HELP!, my friend is hinting about not going, he spoke to the court and explained that he had no notification about the CMI, it turns out when the courts were transferred they got the wrong postcode, the court person said he should just bring a CMI with him tomorrow and that would be ok. He has also spoken to the barclays lit department who said that they will not settle as they expect to win the OFt test case!, and that they have organised for a barrister to be at leeds tomorrow, who is going to apply for a stay. Does anyone have any info on what he will have to do, he is worried about having to stand next to a barrister and get completely torn apart by loads of legal mumbo jumbo! He has the CMI and a copy of the particulars, all documents sent and recieved so far and 3 copies of charges schedules. He is case number 130 odd. Any details on procedure or what he will have to do/say or not say would be greatly appreciated, PLEASE HELP!! regards
  6. HI, thanks for your quick response, my firend isn.t very confident at public speakig or anything like that, what will he have to do at the court? He will be very nervous, should he ring the court and tell them he will be attending, the letter from barclays says that the case will be held...or thats the impression it gives leading to his thought that the case would not be tomorrow! Regards
  7. Hi people, I claimed my charges back months ago from HSBC, lovely people! anywho, a friend of mine asked about it and i pointed him in the direction of this website, i photocopied a few letters for him and answered a few question when he asked, he has just phoned me and asked if he has to go to court tomorrow! He is at leeds merc court, the last correspondence he had was from Barclays saying about holding the case due to the OF test case. Any advice greatly and urgently appreciated, what should we do? My case never court near the court room, it was over a year ago now, he send the schedule to the bank and was told no questionnaire was needed by the court, i think...
