  1. Recieved a letter from the court saying that my court date of 31 Oct 2007 is vacated and the case has been stayed. Anyone know what I do now or is it all over untill 31 Oct 2008
  2. Is it worth contacting them to see if they will settle or is it a waste of time?
  3. I hate Barclays!!, now they have put in a defence 2 wks late. If i had just filed for judgement i would have got it because they thought they had filed a defence but Robert Saunders sent it to the wrong court (probation instead of county). So by me letting them know, they have now filed. Robert Saunders said he was going to settle then files a defence, the two face tw*t. Well AQ being sent out soon I think. Court clerk couldn't believe it.
  4. Have spoke to Robert Saunders and he said that as they didn't file a defence then he would be looking at settling. I have e-mailed him, copied in on Dino saying that unless an offer of the full amount is made by Tuesday then I would be attending court to request judgement. Does this sound like the right course of action?
  5. Well I've waited and waited and they still have not filed a defence. What do i do now, enter into judgement by default. People on here has said that it will take longer if I do but its now been nearly 2 weeks and nothing. HELP PLEASE!!
  6. Barclays acknowledged on the 11th and were suposed to enter into defence by the 24th, i think and they haven't where do i go from here as the courts have told me to fill in the judgement section of the notice of issue. How long should I give them as it has been 3 days now. HELP!!!

  10. How does that work then? How can it delay your claim surely it should speed it up, they are in the wrong by not complying with the courts order to reply by the date shown. How do they get away with it!! :( Thanks for the reply, so you think I should hang on for a bit longer.
  11. I rang the court this morning and they said that barclays hadn't replied and to fill in the bottom section of the Notice of Issue "Request for Judgemnt" and I would be awarded judgement. Should I fill it in and hope for the best or will they file an acknowledgement later, it is 3 days now as they should have replied by the 11th. Cheers

  13. Hi N1 was deemed issued on 27th May which gives untill the 11th June to acknowledge. I haven't heard anything! What now? Should I ring the court? Any advice would be great.
  14. Okay here goes, this is what I'm going to send unless anyone thinks I shouldn't!! Response to settlement offer. Dear Jane Yellowey –Scales (Customer Relations Advisor), Thank you for your letter dated 02/06/07. I respectfully decline your offer of Full and Final settlement. You may not have been aware that I commenced legal action against you for the full amount plus interest and costs on 23/05/07 and I would ask that you now refer this matter to your legal department for further instruction. As you are probably aware the courts are inundated with claims at present and as such I am prepared to settle without court action. My claim to date is for £3780.22. Should you wish to settle this claim in full and avoid further costs (i.e. daily interest, loss of earnings to attend court, wasted court costs) and court proceedings then I am prepared to accept £3500 in full and final settlement. Should you accept this please credit my account within 7 days. If you do not respond within 7 days I will assume that you do not accept this and a copy of this letter will be kept together with all other correspondence as part of my evidence to be submitted to the court. I trust this clarifies my position. Yours faithfully, What do you think???
  15. Yeah its from the template just added a bit and wanted to make sure it was fine. Thanks for the replys. Do you think I should mention another offer much closer to the amount as I would settle for a little bit less? The very sound of court and lawyers etc scares most people but through this site it really makes the process alot less stressfull. (My Mother in law is doing the same through a solicitor and it is going to cost her £200!!!!)

  17. Hi all Offer recieved this morning for £1975 as goodwill gesture etc etc. £1650 short of total inc interest. Not too sure what to do now, would be easier to take money and boy could I do with it right now but £1650 is still alot of money :confused: . Decision time I guess!! 1. 2. 3... decided, stuff em letter of rejection on its way:) .

  19. You are right Micky court is very helpfull, I just went down and signed the forms no problem. So now they will get served on Barclays in the next 4 days or so. Cheers

  22. Well I have been to the court and paid the fee....OMG:eek: , now it gets serious!!! And now I'm going to be skint this month, could have really done with that £120:(. Hey oneofakind it really was full of shellsuits and charvas outside. :D Ha ha
