  1. Absolutely fantastic result I'll get started on trying to get back some bank charges/credit card charges next I think, although that could really do my head in if it's not straightforward. I shall send a copy of that letter to the court and Ashbourne, thanks. I'll get some of those self adhesive labels in the next couple of days. They'll come in handy for the next set of claims
  2. Reply this morning. "In these circumstances, clearly the claim has been settled. Nevertheless we confirm that no further payments will be pursued by our client pursuant to the contract."
  3. I did expect it to be alot tougher than this, but i'm not complaining. Once I have got this confirmation from them and the cheque is safe to bank, i'll purchase a couple of packets of those address labels and use the rest to pay off other arrears! Then I can start thinking about bank charges and how to reclaim!
  4. I shall write to the solicitors with what you say. I shall do it now whilst I am on the PC. Oh I hope this is the end now. It's looking good that they've refunded anyway.
  5. I THINK we have a result! Received this morning... Letter from Ashbourne's solciitors with a cheque attached They say "In the circumstances, we should be grateful if you would acknowledge safe receipt of the same in full and final settlement of the claim" Does this mean that this is the end? They just want confirmation that I have received the money and that I shall take it no further? Can I now assume that the contract is void and I will never be chased again? Thanks
  6. Thanks. I shall send the letter to them over the weekend. I take it they can't harrass me for money with the court proceedings I have against them? If this went to a court hearing, would this go against them? Is there anything else I can do now? I couldn't believe it when I got the letter. I think they are taking the pee slightly!
  7. I've had the form from the court saying the claim was issued on the 12th June. Today, i've had a letter from Ashbourne dated 17th June demanding £207 plus £35 admin fee and threatening that if I don't pay £51.87 immediately they'll register a bad debt with the Credit Reference Agency. Can they still demand money with a court order against them?
  8. The claim is in. The lady said it will likely be issued tomorrow. Now it's a case of waiting.
  9. Excellent - thanks very much. I've adjusted a couple of things to fit in with what is factual, but i've used most of that above (please don't copyright it!) I shall be taking the forms down to County Court within the next couple of hours with fee etc. I've not added on any extra interest claim. The main thing is getting out of the contract that was defaced, even though Ashbourne admit is just a 12 month contract now, i'm hoping the whole contract is invalid. Thanks
  10. I've filled it in the best I can and will hand it in tomorrow. The court is 5 minutes away from me, which is handy. I'm not overly confident now that they have agreed it's a 12 month contract. I have gone down the route of non enforceable contract and will have to hope that it is enough.
  11. Hi PC finally fixed! Right, I have an N1 form and i'm filling it now - no further response from Ashbourne. 'Brief Details Of Claim' I don't know if I have written too much, but what should my main basis be for the claim? Ashbourne have agreed it's 12 months now, so it can't be that i'm in a 36 month contract. Maybe something to do with being lied to in the first place and feeling I can no longer trust the gym? Thanks
  12. Well, the jokers have ignored me and sent me another request for £22.79, or they shall issue proceedings for the recovery of the debt plus the remainder of the contract. I shall go and issue proceedings first then. For £67.29, will the costs definitely only be £30? I'm not exactly flush right now If they counterclaim, will it cost me? Thanks

  14. I've kept copies of all letters, contract (both sides) and recorded delivery slips. I'll try and cancel on the basis of being mis-sold. Is there anything else I should include?
  15. Yes, I was rather pleased when I saw progress had been made. They included in the letter that I was still 1 month in arrears (with the £5 admin fee added) For the £30 fee, it's worth a go. I shall try and compromise first and see if I can get out of the contract of 1 year (based on being mis-sold in the first place?) I've never used the gym because of all this and feel it impossible to return. If I get nowhere, I shall then file at court Thanks
