OK, I have been so busy with my own work that I have cashed the cheque and have now contacted a lawyer to take them to court as on talking to the court they said "would you do your own plumbing or get a plumber?" so I will publish the writ but to be honest in Scotland it looks like we'll need a lawyer for over £750 claims.

My sister is a lawyer and she said that for over 1500 quid I will need to goto sheriff court not small claims court, and will need to do a writ, and they use a template called a style, her statement was that I shoudl use a debt writ for claiming the money, and have seen them before, it basically looks like a list of claims and who and why, and legal terms of payment dates, etc, which you hand to the court with your fee of 50 quid I think.
  7. On the 1st an 2003 they changed the service charge from 15 GBP to 22.50 GBP without any justification IIRC to merit a raise of 7.50 GBP!!

I did and they cashed the cheque too, but their Data Protection Act area is not budgeing on the statement of "non-regular" filing system for older than 18months stoered statements, so got fed up with the edited from CB, but ain't finished with him yet, beleieve me he's goijng to get a complaint about him, especially as I'm leaving them in the next few weeks, and I'm going to put him down as one of the major factors in my letter to the chairman of the bank!! please dont use this word.

I got them exactly as you would normally, however because I have a high income and business account I have a Clydesdale principle account which means I get free copies of statements and just for easy of use paid for the missing ones at £3 a statement, and just got the missing ones instead of all of them. I can't use moneyclaim or small courts for my claim here in Scotland so my sister is going to do a debt writ for me, so Jmio if you'd like a copy PM me your email, also anyone else who wants it PM me. I got a letter basically telling me it was my fault and not theirs and they are totally within the banking law, yeah but they forgot they aren't a law and are governbed and are now under major pressure, so I think the writ will do the job to be honest, they'll fold like the others!!

After their letter asking me to call them, I was offerred25% at first and refused, then 50%, and then stated politley and clearly that if the full figure wasn't sent to me I'd process the court claim and also claim the 8% whcih was a decent figure so they then said ok, which I thought was just too easy to be true. So before I left on my honeymoon, Gareth Tunnicliffe (nice guy) said I would have a cheque on my return but after 2 weeks in sunny Brazil I came back to no cheque but it turns out that he had gone on and done my totalling on my A&L account as it was run partly by MBNA and today I recieved a cheque for the full figure of £1220 which is a full refund of two accounts. Thanks MBNA, a superb and easy claim if I must say so. Are they hoping you'll keep using them is that why they are not making hard work like Clydesdale who have refused point blank my 3.3k claim? Thanks all on here who helped, donation on it's way!!

After all the rubbish from Gordon Watt and my account manager (got business account too) I got all my statements as I've held a Principle account which allows me free copies of statements, and paid 80 quid for the missing ones for before that, now submitting complaint about Gordon Watt to IC, and also filing claim for £3127, lets see where this goes!! They didn't meet the 40 day dealine but they were only a couple of days out and did update me to say that the early ones were taking some time, but we are where we are now!! Bring it on CB!!

  16. DPA Letter Sent on 10/4/06 Cheques returned with copies of financial transactions. Refund Letter now sent 22/4/06 for £888

Just got the same, no statemets before July, as they deem the act to cover only a "relevant filing system" and they are saying that microsfiche takles maual work therefor not a relevant filing system. So asked to speak to comliance, and they said that they are meeting with the IC tomorrow to discuss this stall tatctic and if they say that it's a relevant they will rpovide all the statements, so I'm off to call the IC again!!
  18. Bookworm, Can you please move above two posts back into a separate thread under Yorkshire as it's Not about MBNA ya donkey!! I never hijacked anyones' threads, I just made a simple comment that MBNA were compliant and much easier to deal with unlike these CB people!!

I have spoken to xxxxx today myself and agreed that I would send all my correspondence on this matter to yourself as he felt it was more relevant to go via yourself. ACCOUNT NUMBER: xxxxxxxx (Dates open: 01/04/92 – 14/05/01) ACCOUNT NUMBER: xxxxxxxx (Dates open: 14/05/01 – present) Thank you for your letter following my DPA request. I would like to advise you that I did not specifically ask for statements to be issued for the above accounts dating back to 01/04/00 as you mention in your letter, but a complete list of transactions and charges relating to my bank accounts (above) since 01/04/00 in accordance with the Data Protection Act disclosure request which carries a statutory fee of £10 which you have forwarded to the your Dept Alison. How you wish to provide this list is entirely up to you, but according to the letter it appears you think I requested statements, which is incorrect, however I did indeed state that I would allow statements to be offered as part of the documentation that you could provide. I would also like to make you aware, that the Clydesdale Bank have now only 30 days in which to comply with the initial DPA request or I will unfortunately have to report my findings to the Information Commissioner.     MBNA Claim

    I sent the DP Letter off and I got this reply from my Clydesdale Bank Private Partner (Which I pay 120 a year for - what a waste): Dear Paul, Account: ********* Account: ********* I refer to your letter of 10.4.06 re our charges. I would advise that all charges have been applied properly and in time with the Bank's charging policy. It is your responsibility to ensure that the account has the funds to meet whatever items are drawn against it. I ackowledge receipt of your £10 and can confirm this gives you access to data per data subject access facility. The data subject access facility will provide copy statements from July onwards for no charge. Statements prior to this date are not included in this facility and are charged at £5 per statement. Can you confirm in writing if you wish to proceed and from what dates you wish the statements ordered. In the meantime I have not ordered any duplicate statements. Every effort is made to ensure that customers are aware of the terms and conditions of their account and our tariff of charges which apply when those terms and conditions are breached. The relevant leaflets would have been issued when you opened your account and are, from time to time, re-issued by way of statement insert and server to remind customers of these conditions. In the circumstances, I am unable to agree toa refund of past charges. I have enclosed for your information a copy of our internal Complaint Handling Procedures. These procedures confirm how to persue your complaint if you remain dissatified with this response, and how to refer to your complaint to the Financial Ombudsman Service if we cannot resolve this matter. If we do not recieve a response from you within eight weeks of the date of this letter, complaint will considered closed. Thank you for bringing this matter to my attention. Regards Craig Walker ----------------------- I got this and then called my Private Partner Banking Manager and he said "I'm not a lawyer and in my 20 years of banking I've never seen anythign like this I just don't know what to do with it." He was kinda stroppy with me as this is obviously causing him paperwork and issues that he doesn't have a process for but has been advised he said on what to reply with!! Then he said I was going to get a letter from the legal deptarment - still waiting (fingers tapping on desk)!! I now feel a second letter coming on regarding theor present stateus in failing to meet the request and ttelling them how many days they have left to furnish the request. Don't get mad, stay patient and then get even I feel is the way. On a good note MBNA said sure here's all tha charges listed and also here's yer 10 quid cheque back!! Not bad I'd say MBNA, so where is the catch? THREAD MOVED, PLEASE DON'T HIJACK SOMEONE ELSE'S THREAD!!!
