  1. Tell me about it Mortlake. Difficulty in accessing Thompson's is one of the biggest headaches I face. I recently had to take a member to E.T. for unfair dismissal acting as a private individual because the regional official who filters requests for legal help turned me down. Got a result as well! Still, I stray of topic.
  2. I have received my statements from the B.O.S. and can identify the charges easily enough. However, the statements just itemise them as "charges as notified". My view is that this is their problem, I asked for itemisation of charges and it has not been given. Am I right in this?

    I used to have a Virgin One account, which is a kind of hybrid mortgage/current account. Has anyone any knowledge of reclaiming charges from this type of account?
  7. I have had one payout of £4,500.00 from BOS without resorting to litigation. However, on the second account i am reclaiming on, I have, last night, filed a claim with MCOL. My reason was that these claims are quite time-consuming -but I only found the section on MCOL on CAG after submitting. So, my fault; I did not include the date i opened my account. I did not supply a schedule of charges to the bank. I did not state in so many words that "That the defendants contractual term which allows charges is unfair and contrary to common law." (Though I did state that the charges represented apenalty and were therefore unlawful). I did not mention the S.15 argument. Can I kiss the £3,500.00 on this account farewell?

  9. Linemonkey, I have had the same letter today; The amount involved is £4,598.00 (sharp intake of breath). My bank is the bank of Scotland. I am in the process of claiming a lesser amount from another account, so I assume that will be forthcoming. My intention is also to reclaim charges accrued between the claim being made and the dosh being received; after all, the new charges were occasioned by the original ones. After that, my aim will be to avoid further chages. The letter states that if I accrue more charges, I won't get them back. But the charges remain unlawful. My interpretation is that the refund is in "full and final settlement" only of the claim to which it relates. My intention is simply to let the bank put the money into my account without msking any response to the bank's letter. I have been asked to sign nothing, and would sign nothing, to prevent me from claiming again as and when necessary. However, I might expect a slightly tougher fight next time - this time, I did not need to use the courts. Does this approach seem correct to other people on this forum?
  10. Thanks for that. What address should I enter as the service adress in MCOL? It won't accept a scottish address. A local branch?
  11. I live in England, buit I am a Bank of Scotland customer. I use central banking rather than having a high street branch, and the postal address for this is in Edinburgh. I am close to making a claim through the courts. Can I use a small claims court in England, or do I have to go through the Scottish courts system? I would like to be able to use the lawpack and the book you advertise, but note that these are only applicable to the English and Welsh courts.
